We feel it is important to have public hearings for orders: • Better consideration of diverse perspectives ; • Unequal levels of experience and resources available to various potential stakeholders; • Opportunity to respond to arguments from other stakeholders.

Current text offers: • Latitude for the CRTC to issue appropriate terms of service in light of the information it obtains and the consultations it conducts; • Difficult to predict the evolution of future technologies and uses; The CRTC will take into account other sections : • 2.1. and 2.2 : users are not covered by the Act; • 2(3): CRTC policies and regulations must respect the freedom of expression of broadcasting undertakings; • 5(2)(a.1): the CRTC must take into account the characteristics of the services, their impact on the industry and broadcasting policy; • 5 (2) (h): the CRTC must avoid imposing obligations that do not contribute significantly to broadcasting policy.
Section 9(4) will allow the CRTC to exempt "by order, and on any terms and conditions that the CRTC considers appropriate, operators of broadcasting undertakings of the class specified by the CRTC from any obligation under this Part, the regulations made under this Part or an order made under
section 9.1, the enforcement of which the CRTC considers does not contribute significantly to the implementation of Canadian broadcasting policy. • The Governor in Council has the ability to issue directions to the CRTC to review its decisions (especially with our proposed amendment to
section 28(1)). Changes to sections 4.1 and 4.2 would not add anything to the users and would only reduce the requirements for social media companies by limiting, possibly eliminating, the amount of programming that can be subject to the Act.
