Senate Committees

October 26, 2023 Vincent Labrosse Procedural Clerk | Committees Directorate S ENATE OF CANADA Chambers Building, room LCJC@SEN.PARL.GC.CA Dear Mr. Labrosse, Thank you for your email of October 13, 2023 inviting the Grand Council of the Crees (Eeyou Istchee)/Cree Nation Government to appear on November 1, 2023 before the Standing Senate Committee on Legal and Constitutional Affairs as part of its study of Bill S-13:

An Act to amend the

Interpretation Act and to make related amendments to other Acts. Bill S-13 proposes a universal “non-derogation clause” for inclusion in the

Interpretation Act1 that would apply to all federal legislation: 8.3

(1) Every enactment is to be construed as upholding the Aboriginal and treaty rights of Indigenous peoples recognized and affirmed by

section of the Constitution Act, 1982, and not as abrogating or derogating from them. The Grand Council of the Crees (Eeyou Istchee)/Cree Nation Government supports the proposed “non-derogation clause” for the reasons set out at greater length in the attached letter of January 19, 2021 from former Grand Chief Dr. Abel Bosum to former Justice Minister David Lametti. In view of the above, the Grand Council of the Crees (Eeyou Istchee)/Cree Nation Government does not consider it necessary to appear before the the Standing Senate Committee on Legal and Constitutional Affairs to make submissions on Bill S-13.

We wish to thank the Standing Committee for the invitation to appear, and express our willingness to collaborate with the Government of Canada to advance this important legislation. 1 R.S.C., 1985, c.
