section 44.03 the following: 1 La

article “Reserves” means the component of the Canadian Forces referred to in the National Defence Act (Canada) as the reserve force; “reservist” means a reservist on Class “C” Reserve Ser- vice within the meaning of

article 9.08 of the Queen’s Regulations and Orders for the Canadian Forces (Can- ada); “service” means active duty or training in the Reserves. « Réserve » désigne l’élément constitutif des Forces canadiennes désigné à

Loi sur la défense nationale (Canada); « réserviste » désigne un réserviste en service de réserve de la classe « C » au sens de l’article 9.08 des Ordonnances et règlements royaux applicables aux Forces cana- diennes (Canada); « service » désigne le service actif ou l’instruction au sein de la Réserve. 44.031(2) An employer shall not dismiss, suspend or lay off an employee who is a reservist, or refuse to employ a person who is a reservist, for the sole reason that the em- ployee or the person is a reservist. 44.031(2) Un employeur ne peut licencier, suspendre ou mettre à pied un salarié qui est un réserviste ni refuser d’employer une personne qui est un réserviste pour des raisons découlant uniquement du fait que le salarié ou la personne est un réserviste. 1

44.031(3) An employer shall, upon the request of an employee who is a reservist, grant the employee a leave of absence without pay of up to eighteen months for the pur- pose of service if, 44.031(3) Un employeur doit, suite à la demande d’un salarié qui est un réserviste, accorder à ce salarié un congé sans solde d’une durée maximale de dix-huit mois pour service selon ce qui suit : (

a) in the case of a first leave of absence, the em- ployee has been in the employ of the employer for at least six months, or

b) in the case of a second or subsequent leave of ab- sence, at least twelve months have elapsed since the date the employee returned to work from the most recent leave of absence granted under this section.

section shall give the employer notice that is reasonable under the circumstances of the employee’s intention to take the leave, the anticipated commencement date of the leave and the expected date of return to work. 44.031(4) Un salarié qui a l’intention de prendre un con- gé en vertu du présent
