An Act to Amend the Licensed Practical Nurses Act

WHEREAS the Association of New Brunswick Li- censed Practical Nurses, prays that it be enacted as here- inafter set forth; THEREFORE Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: 1 The Licensed Practical Nurses Act,

chapter 60 of the Acts of New Brunswick, 1977, is amended in

section 1 (

a) by repealing the definition “approved school of practical nurses” and substituting the following: “approved school of practical nurses” means a school to which a certificate of approval has been issued by the Board of Directors pursuant to by-law; (

b) by repealing the definition “practical nurse” and substituting the following: “licensed practical nurse” means a graduate of an ap- proved school of practical nurses who is not a registered nurse in New Brunswick, undertakes the care of patients under the direction and in collaboration with a registered nurse or duly qualified medical practitioner, or pharmacist for custodial convalescent, sub-acutely ill, chronically ill patients, and who assists registered nurses in the care of PROJET DE LOI 40 Loi modifiant la

chapitre 60 des Lois du Nouveau-Brunswick de 1977, est modifiée à l’article 1 :

a) par l’abrogation de la définition « école agréée d’infirmières et d’infirmiers auxiliaires » et son rem- placement par ce qui suit : « école agréée d’infirmières et d’infirmiers auxiliaires » désigne une école à laquelle le Conseil d’administration a délivré un certificat d’agrément conformément aux règle- ments administratifs;

b) par l’abrogation de la définition « infirmière ou infirmier auxiliaire » et son remplacement par ce qui suit : « infirmière ou infirmier auxiliaire autorisé » désigne la diplômée ou le diplômé d’une école agréée d’infir- mières et d’infirmiers auxiliaires qui n’est pas une infir- mière ou un infirmier immatriculé du Nouveau- Brunswick et qui dispense, sous la direction d’une infir- mière ou d’un infirmier immatriculé, d’un médecin dû- ment qualifié, d’une pharmacienne ou d’un pharmacien,

c) by adding the following definition in alphabeti- cal order: “graduate licensed practical nurse” means those stu- dents registered under subsection 9(6) of the Act and the role and function of these members shall be established by the Board of Directors as set out in the by-laws; 2

Section 4 of the Act is amended (

a) in paragraph (1)(

h) by striking out “student as- sistants” and substituting “graduate practical nurses”; (

b) by repealing subsection (2) and substituting the following: 4(2) There shall be an Executive Committee elected for a two year term at every other annual meeting and said Executive Committee shall consist of a President, First Vice President, Secretary and Treasurer and each member of the Executive Committee may only be re-elected for one additional term in that position. (

c) by adding after subsection (3) the following: 4(4) There shall be a Board of Directors which shall be comprised of the Executive Committee as well as six re- gional members. 4(5) Regional members shall be nominated by the local chapters within 30 days of the annual meeting and the Ex- ecutive Committee shall choose one regional member from each of the local chapters, which members shall have a three year term and may be appointed for one additional three year term, and if a local

chapter does not submit a name of a person to sit as a regional member, the Execu- tive Committee may select a member to represent that lo- cal chapter. 4(6) If a regional member does not complete his or her term, the Executive Committee may select a replacement member. ou en collaboration avec cette personne, des soins aux ma- lades sous simple surveillance, en convalescence ou at- teints d’affections subaiguës ou chroniques et qui assiste, en dispensant les services correspondant à sa formation, l’infirmière ou l’infirmier immatriculé dans les soins à donner aux malades atteints d’affections aiguës;

b) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 4(2) Tous les deux ans à l’Assemblée annuelle, un Co- mité de direction composé d’un président, d’un premier vice-président, d’un secrétaire et d’un trésorier doit être élu pour un mandat de deux ans, et chaque membre du Co- mité de direction ne peut être réélu à son poste que pour un mandat additionnel.

c) par l’adjonction, après le paragraphe (3), de ce qui suit : 4(4) Est constitué un Conseil d’administration, com- posé du Comité de direction et de six membres régionaux. 4(5) Les membres régionaux sont mis en candidature par les chapitres locaux dans les 30 jours précédant l’As- semblée annuelle, et le Comité de direction choisit un membre régional de chacun des chapitres locaux; ces membres ont un mandat de trois ans et peuvent être nom- més pour un mandat additionnel de trois ans, et si un cha- pitre local ne propose pas le nom d’une personne pour sié- ger comme membre régional, le Comité de direction peut choisir un membre pour représenter ce

chapitre local. 4(6) Si un membre régional ne termine pas son mandat, le Comité de direction peut choisir un membre rempla- çant.

An Act to Amend the Licensed Practical Nurses Act Bill 40 4(7) The Board of Directors at their first meeting after their election shall appoint two public members and the public members shall serve for three years and may be ap- pointed for one additional three year term. 3

Section 5 of the Act is amended (

a) by repealing subsection (1) and substituting the following: 5(1) The affairs of the Association shall be under the management of the Board of Directors. (

b) by repealing subsection (2). 4

Section 6 of the Act is repealed and the following is substituted: 6 The minimum educational qualifications for admis- sion as a student in an approved school of practical nurses shall be graduation from a high school academic educa- tion program, containing three compulsory subjects at se- nior high school level of which two shall be in science, one of which shall be academic level biology and one shall be academic level mathematics, or equivalent train- ing or education as determined by the Executive Commit- tee. 5 The Act is amended by adding after

section 6 the fol- lowing: 6.1 All members shall be subject to mandatory continu- ing education as determined by the Board of Directors from time to time. 6

Section 7 of the Act is amended (

a) in paragraph (

b) by striking out “nursing assis- tants” and substituting “licensed practical nurses”; (

b) by adding after paragraph (

c) the following: (c.1) require members to take continuing educa- tion programs as approved by the Association; (

c) in paragraph (

e) by striking out “nursing assis- tants” and substituting “licensed practical nurses”. 7 The Act is amended by adding after

section 7 the fol- lowing: 4(7) Le Conseil d’administration, à sa première réunion suivant son élection, doit nommer deux représentants du public, qui siègent pour un mandat de trois ans et peuvent être reconduits pour un mandat additionnel de trois ans. 3 L’article 5 de la Loi est modifié :

b) par l’abrogation du paragraphe (2). 4 L’article 6 de la Loi est abrogé et remplacé par ce qui suit : 6 La formation minimum pour l’admission comme étu- diante ou étudiant dans une école agréée de soins infir- miers auxiliaires est l’obtention d’un diplôme d’études se- condaires comprenant trois matières obligatoires au niveau secondaire supérieur, y compris deux en sciences, l’une en biologie à ce niveau scolaire, l’autre en mathéma- tiques à ce niveau scolaire, ou une formation ou des études équivalentes déterminées par le Comité de direction. 5 La Loi est modifiée par l’adjonction, après l’arti- cle 6, de ce qui suit : 6.1 Tous les membres sont tenus de suivre une éduca- tion permanente obligatoire déterminée par le Conseil d’administration au besoin. 6 L’article 7 de la Loi est modifié :

a) à l’alinéa b), par l’adjonction de « autorisé » après « infirmier auxiliaire »;

b) par l’adjonction, après l’alinéa c), de ce qui suit : c.1) exiger que les membres suivent les pro- grammes d’éducation permanente approuvés par l’Association;

c) à l’alinéa e), par l’adjonction de « autorisés » après « infirmiers auxiliaires ». 7 La Loi est modifiée par l’adjonction, après l’arti- cle 7, de ce qui suit :

a) the admission, suspension, expulsion, removal, discipline and reinstatement of members, and condi- tions precedent to membership in the Association; (

b) the development, establishment, adoption, main- tenance and administration of rules of professional conduct and the standards of fitness, moral character and conduct of members, students and professional corporations; (

c) the regulation of professional liability insurance for members and professional corporations including requirements of such insurance for all or certain classes or categories of members and professional corporations whether such insurance is provided by or through the Association or otherwise; (

d) the development, establishment and maintenance of standards for the practice of practical nursing; (

e) the development, establishment and maintenance of standards for practical nursing education consistent with the changing needs of society; (

f) the definition by education, experience or other- wise general or specialized areas of practical nursing practice; (

g) prescribing standards of continuing practical nursing education for all persons registered under the Act; and (

h) prescribing limitations on the right to practice, shall not be effective or be acted upon until confirmed by the Minister of Health. 8

Section 8 of the Act is amended (

a) in paragraph (

a) by adding “licensed” before “practical”; (

b) in paragraph (

c) by adding “licensed” before “practical”; 7.1 Aucun règlement administratif adopté, modifié ou abrogé par le Conseil d’administration concernant les questions suivantes ne peut prendre effet ou devenir appli- cable avant d’avoir été confirmé par le Ministre :

c) la réglementation de l’assurance des membres et des corporations professionnelles en matière de respon- sabilité professionnelle, qui pourrait même être rendue obligatoire pour l’ensemble des membres et des corpo- rations professionnelles ou pour ceux et celles de cer- taines catégories, qu’elle soit ou non offerte par l’Asso- ciation ou par son entremise;

d) l’élaboration, l’établissement et la prorogation des normes applicables à l’exercice des soins infirmiers au- xiliaires;

e) l’élaboration, l’établissement et la prorogation des normes applicables aux études en soins infirmiers auxi- liaires et adaptées aux besoins changeants de la société;

f) la définition, en fonction de la formation, de l’ex- périence ou d’autres critères, de certains champs d’exercice général ou spécialisé des soins infirmiers auxiliaires;

g) la prescription de normes de formation continue en soins infirmiers auxiliaires pour toutes les personnes immatriculées en vertu de la Loi;

h) l’imposition de limitations au droit d’exercer la profession. 8 L’article 8 de la Loi est modifié :

a) à l’alinéa a), par l’adjonction de «a u t o r i s é s» après « auxiliaires »;

b) à l’alinéa c), par l’adjonction de «a u t o r i s é s» après « auxiliaires »;

Section 9 of the Act is repealed and the following is substituted: 9(1) The membership of the Association shall consist of all persons registered and in good standing in accordance with this Act and the by-laws and regulations, as well as those members registered under the provisions of The Registered Nurses Act, 1957. 9(2) A person who applies to the Board of Directors in the prescribed form for membership shall be registered as a member of the Association if (

a) the person is trained in Canada as a licensed prac- tical nurse and satisfies the Board of Directors that the person: (

i) obtained the educational qualifications set out in

section 6 of this Act; (ii) graduated and holds an appropriate certifica- tion from an approved school; (iii) successfully completed the national examina- tion; and (iv) paid the prescribed fees; (

b) the person is licensed as a practical nurse with their regulator in another Province or Territory within Canada and paid the prescribed fees; or (

c) the person is trained outside of Canada as a li- censed practical nurse, or equivalent training, and sat- isfies the Board of Directors that the person: (

i) graduated from an institution which the Board of Directors approves and which offers a detailed course of study and training as a licensed practical nurse, or equivalent training; (ii) successfully completed the national examina- tion; and

b) si elle a été autorisée à exercer les soins infirmiers auxiliaires par l’organisme de réglementation d’une autre province ou d’un territoire du Canada, a payé la cotisation prescrite; ou

c) si elle a reçu hors du Canada sa formation en soins infirmiers auxiliaires autorisés ou une formation équi- valente, (

i) convainc le Conseil d’administration qu’elle a obtenu un diplôme d’un établissement que le Conseil d’administration reconnaît et qui offre un programme d’études et de formation détaillé en soins infirmiers auxiliaires ou une formation équiva- lente, (ii) réussit l’examen national, et

b) shall be subject to any conditions, limits or restric- tions that are attached to the license from the jurisdiction from which the person transferred. 9(4) Notwithstanding subsections (1) and (2), a re-entry candidate applying for membership or renewal of mem- bership in the Association, must satisfy the Board of Di- rectors that the candidate successfully completed the course of re-entry examination and training prescribed by by-law. 9(5) Every person who is, on the coming into force of this Act, registered as a member of the Association shall, provided they pay the prescribed fees for membership, be registered as a member of the Association. 9(6) In addition to those persons to whom subsections (1) and (2) applies, any person who has successfully grad- uated from an approved school of practical nurses may be issued by the Board of Directors a graduate licensed prac- tical nurse membership upon payment of the prescribed fees as set by by-law and such members shall be entitled “graduate licensed practical nurse”. 9(7) If a graduate licensed practical nurse, who has ob- tained membership under subsection (6), fails the national examination, membership as a graduate licensed practical nurse shall be revoked. 9(8) The role and function of those members registered under subsection (6) shall be established by the Board of Directors and set out in the by-laws. 9(9) The Board of Directors may, from time to time, is- sue honorary memberships in the Association to those persons as determined by the Board of Directors recogniz- ing them for distinguished service or valuable assistance to the Association and such members shall be entitled to receive any bulletins or publications issued by the Associ- ation but shall have no voting or other rights. 9(10) Notwithstanding subsections (1) and (2), a li- censed practical nurse who is not actively engaged in any nursing field but would otherwise meet the criteria for membership in the Association, may be issued by the Board of Directors, upon payment of the prescribed fee, (iii) a payé la cotisation prescrite. 9(3) Toute personne qui fait une demande d’adhésion conformément à l’alinéa 2b) est assujettie aux conditions, limites ou restrictions afférentes au permis qu’elle a ob- tenu du ressort dont elle provient. 9(4) Nonobstant les paragraphes (1) et (2), un candidat ou une candidate à la réadmission qui demande à adhérer à l’Association ou à renouveler son adhésion doit convaincre le Conseil d’administration qu’il a réussi l’examen du cours de réadmission et a suivi la formation prescrite par les règlements administratifs. 9(5) Toute personne qui, à l’entrée en vigueur de la Loi, était membre immatriculé de l’Association, pourvu qu’elle ait payé la cotisation prescrite, demeure membre immatriculé de l’Association. 9(6) En plus des personnes à qui les paragraphes (1) et (2) s’appliquent, toute personne qui a obtenu son diplôme d’une école agréée de soins infirmiers auxiliaires peut être admise comme membre par le Conseil d’administration à

An Act to Amend the Licensed Practical Nurses Act Bill 40 an inactive membership, and this may include those li- censed practical nurses who have received honorary memberships. 9(11) An inactive member registered under subsection (10) shall not be eligible to hold office as a member of the Board of Directors or the Executive Committee but shall be eligible to hold office as an officer or president of any

chapter of the Association and shall be eligible to vote in elections and at meetings of the Association. 10 The Act is amended by adding after

section 9 the following: 9.1(1) The Registrar may issue a temporary membership upon written application and receipt of (

a) the prescribed fee; (

b) satisfactory proof that the applicant is or would be eligible for membership in the Association; and (

c) proof that the applicant is a member in good standing and properly licensed as a practical nurse in another jurisdiction. 9.1(2) Notwithstanding subsection (1), the Board of Di- rectors may waive the requirement for payment of pre- scribed fees for any person applying for temporary mem- bership. 9.1(3) Any person to whom a temporary membership has been issued pursuant to this Act shall be entitled to work as a licensed practical nurse in New Brunswick in accor- dance with the provisions of this Act for the time period specified in the temporary membership, but no such time period shall exceed 90 consecutive days inclusive of the dates of commencement and termination thereof. 9.1(4) A person who has been issued a temporary mem- bership shall not be entitled to hold any office in the As- sociation nor shall the person be allowed to vote in any elections or meetings of the Association. 9.1(5) An applicant who is refused membership in the Association shall be given written reasons for the refusal and the applicant may, by written notice, appeal that deci- sion to the Executive Committee which shall consider the appeal within 30 days of the receipt of the notice and upon paiement de la cotisation prescrite, en tant que membre nonactif. 9(11) Un membre nonactif immatriculé conformément au paragraphe (10) ci-dessus n’est pas admissible à l’exer- cice d’une charge de membre du Conseil d’administration ni du Comité de direction, mais il est admissible à l’exer- cice d’une charge de dirigeant ou de président d’un cha- pitre de l’Association et a le droit de voter aux élections et aux assemblées de l’Association. 10 La Loi est modifiée par l’adjonction, après l’arti- cle 9, de ce qui suit : 9.1(1) Le registraire peut accorder l’adhésion à

a) de la cotisation prescrite;

b) d’une preuve satisfaisante montrant que le candi- dat ou la candidate est ou serait admissible en tant que membre de l’Association; et

c) d’une preuve montrant que le candidat ou la candi- date est un membre en règle dûment immatriculé dans un autre ressort en tant qu’infirmière ou infirmier auxi- liaire. 9.1(2) Nonobstant le paragraphe (1), le Conseil d’admi- nistration peut dispenser de l’obligation de payer la coti- sation prescrite toute personne qui demande d’adhésion à

titre de membre temporaire. 9.1(3) Toute personne à qui l’adhésion à

titre de membre temporaire a été accordée conformément à la Loi a le droit de travailler comme infirmière ou infirmier au- xiliaire au Nouveau-Brunswick conformément aux dispo- sitions de la Loi pendant la période spécifiée dans le per- mis temporaire, mais cette période, y compris les dates de début et de fin de la période, ne peut jamais excéder 90 jours consécutifs. 9.1(4) Une personne qui a obtenu l’adhésion à

titre de membre temporaire n’a le droit d’exercer aucune charge dans l’Association et n’a pas le droit de voter aux élec- tions et aux assemblées de l’Association. 9.1(5) Un candidat ou une candidate à qui l’adhésion comme membre de l’Association est refusée doit être avisé par écrit des motifs du refus et peut, par voie d’avis écrit, appeler de la décision devant le Comité de direction, qui examine l’appel dans les 30 jours suivant la réception

Section 11 is amended (

a) by repealing subsection (2) and substituting the following: 11(2) A certificate of approval for an approved school of practical nurses shall be issued annually by the Board of Directors if the Board of Directors is satisfied that the curriculum and the operation of the school meets the stan- dards as set out by the Association in the by-laws. (

b) by adding after subsection (2) the following: 11(2.1) Prior to the initial approval of an approved school of practical nurses by the Board of Directors or if there is a change in curriculum of an approved school, the Board shall obtain the consent of the Minister of Health and the Minister of Post-Secondary Education, Training and Labour before issuing a certification of approval. 12

Section 32 of the Act is amended by adding after subsection (3) the following: 32(4) If the Registrar deems it appropriate, any meeting of the Complaints Committee may be held by conference call or by video-conference. 13

a) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 11(2) Un certificat d’agrément d’une école agréée de soins infirmiers auxiliaires sera délivré annuellement par le Conseil d’administration si le Conseil est convaincu que le programme d’études et le fonctionnement de l’école sont conformes aux normes énoncées dans les rè- glements administratifs de l’Association.

b) par l’adjonction, après le paragraphe (2), de ce qui suit : 11(2.1) Avant l’agrément initial d’une école agréée par le Conseil d’administration, ou si un changement est ap- porté au programme d’études d’une école agréée, le Conseil doit obtenir le consentement du ministre de la Santé et du ministre de l’Éducation postsecondaire, de la Formation et du Travail avant de délivrer un certificat d’agrément. 12 L’article 32 de la Loi est modifié par l’adjonction, après le paragraphe (3), de ce qui suit : 32(4) Si le registraire le juge opportun, toute réunion du Comité des plaintes peut être tenue par conférence télé- phonique ou par vidéoconférence. 13 L’article 34 de la Loi est modifié par l’adjonction, après le paragraphe (5), de ce qui suit : 34(6) Si le comité, à sa discrétion, le juge opportun, il peut tenter officiellement de régler la plainte par voie de médiation.
