An Act to Amend the Jury Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 Subsection 13(2) of the Jury Act,

chapter J-3.1 of the Acts of New Brunswick, 1980, is repealed and the fol- lowing is substituted: 13(2) The persons to be summoned may be selected (

a) at random in accordance with the regulations from the names of persons apparently resident in the ju- dicial district or a distinct part of it that are on a list pro- vided for in the regulations, or (

b) if a list provided for in the regulations indicates the linguistic preference of the persons named on the list, (

i) in accordance with paragraph (a), (ii) at random in accordance with the regulations from the names of persons on the list who are appar- ently resident in the judicial district or a distinct part of it and whose linguistic preference, according to the list, is the official language in which the proceed- ing is to be conducted, or PROJET DE LOI 36 Loi modifiant la

a) au sort, conformément aux règlements, parmi celles qui semblent résider dans la circonscription judi- ciaire ou dans une subdivision distincte de celle-ci et dont les noms figurent sur une liste prévue aux règle- ments, ou

b) si une liste prévue aux règlements indique la pré- férence linguistique des personnes dont les noms figu- rent sur celle-ci, (

i) conformément à l’alinéa a), (ii) au sort, conformément aux règlements, parmi les personnes dont les noms figurent sur la liste et qui semblent résider dans la circonscription judi- ciaire ou dans une subdivision distincte de celle-ci et dont la préférence linguistique est, selon la liste, la langue officielle dans laquelle la procédure aura lieu, ou

Section 1 The existing provision is as follows: 13(2) The persons to be summoned shall be selected at random in ac- cordance with the regulations from the names of persons apparently resident in the judicial district or a distinct part of it that are on a list provided for in the regulations.

Section 2 Commencement provision. NOTES EXPLICATIVES

Article 1 La disposition actuelle se lit comme suit : 13(2) Les personnes à être assignées doivent être choisies au sort conformément aux règlements d’entre les noms de personnes qui sem- blent résider dans la circonscription judiciaire ou dans une subdivision distincte de celle-ci et dont les noms figurent sur la liste prévue aux rè- glements.

Article 2 Entrée en vigueur.
