Sand Beach Designation

made under subsection 5(1) of the

Beaches Act

R.S.N.S. 1989, c. 32

O.I.C. 76-1283 (November 2, 1976), N.S. Reg. 152/76

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 24th day of September, A.D., 1976, pursuant to

Section 5(1) of

Chapter 6 of

the Statutes of Nova Scotia, 1975, the Beaches Preservation and Protection Act , is pleased to

designate as a beach an area of land lying landward from the mean high water mark of the

beach at Sand Beach, in the County of Yarmouth, Province of Nova Scotia, as shown outlined

in red on the copy of Crown Land Records Office Plan No. E-7-77, marked

Schedule “B”, and

described in

Schedule “A”, both attached to and forming part of the report and

recommendation.

Schedule “A”

All that certain area of land lying landward from the mean high water mark of Sand Beach, in

the County of Yarmouth, Province of Nova Scotia as shown outlined in red on the copy of

Crown Land Records Office Plan No. E-7-77, attached hereto and marked

Schedule “B” and

being more particularly described as follows:

Beginning at an iron post shown as No. 1 on said plan and situate on the east side of Yarmouth

Sound on a bearing south sixty-eight degrees fifty-three minutes east from the Bunker Island

Light and on a bearing north fifty-three degrees six minutes east from the East Cape Fourchu

Light; said iron post being approximately two hundred feet from the mean high water line and

sixteen feet north of the centreline of the road leading to Sand Beach;

From thence (by astronomic bearings) north fifteen degrees zero minutes east four hundred and

ninety-one decimal seven feet to an iron post shown as No. 2 on said plan and situate on the

boundary between lands now or formerly owned by Landry and Fred Bourque;

Thence north four degrees thirty-six minutes west, six hundred and eighty-eight decimal four

feet to an iron post shown as No. 3 on said plan;

Thence north eighty-five degrees thirty-four minutes west on a direct line towards the Bunker

Island Light one hundred and nine feet to the mean high water line;

Thence continuing in the direction of the Bunker Island Light north eighty-five degrees

thirty-four minutes west, four hundred feet to a point below the low water line;

Thence south seven degrees twelve minutes west, nine hundred and ninety-two decimal one

feet to a point standing on the direct line between the Bunker Island Light and the place of

beginning.
