On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Administrative Penalties Regulation, B.C. Reg. 35/2011, is amended as set out in the attached

Schedule 1, and

(

b) the Investigations Regulation, B.C. Reg. 134/2019, is amended as set out in the attached

Schedule 2.

(

Schedule 2

1 Sections 1 and 2 of the Investigations Regulation, B.C. Reg. 134/2019, are repealed and the following substituted:

Definition

1 In this regulation, "Act" means the Energy Resource Activities Act .

Drilling and Production Regulation

2 The following provisions of the Drilling and Production Regulation are prescribed for the purposes of

section 61.1 (1) of the Act:

(a)

section 41 (1), (1.1), (2), (3), (4), (4.01) and (4.02);

(

b) section 41.1 (2), (4), (5), (5.2) to (7.1), (10) and (12) to (20);

(

c) section 41.2 (2);

(d)

section 44 (1) (b), (b.1), (

c) and (d.1) and (2);

(

e) section 52.02;

(

f) section 52.021 (3), (4) and (5);

(

g) section 52.03 (1), (5), (6) and (7);

(

h) section 52.04 (2), (3) and (5) to (8.1), (9), (10), (11) and (13);

(

i) section 52.05 (2) to (4.1), (4.4) and (5);

(

j) section 52.06 (1), (2), (4) and (7);

(

k) section 52.061 (2), (5) and (6);

(

l) section 52.07;

(

m) section 52.08 (3) to (6) and (9);

(

n) sections 52.09, 52.10 and 52.12.

Pipeline Regulation

2.1 The following provisions of the Pipeline Regulation are prescribed for the purposes of

section 61.1 (1) of the Act:

(

a) section 7.1 (1);

(b)

section 12 (2).

Processing Facility Regulation

2.2 The following provisions of the Processing Facility Regulation are prescribed for the purposes of

section 61.1 (1) of the Act:

(

a) section 21;

(

b) section 26 (d).
