OIC Text: The Governor in Council on the report and recommendation of the Minister of Justice dated February 26, 2004, and pursuant to
Section 4 of
Chapter 348 of the Revised Statutes of Nova Scotia, 1989, the Police Act, is pleased to: (
a) reappoint M. Frances Hinton of Halifax, Halifax Regional Municipality, as a member of the Nova Scotia Police Commission, for the purposes only of completing the Ministerial Inquiry into the death of James Guy Bailey, Jr. commenced in 2001, for a further term of office commencing March 30, 2004, and expiring on the completion of that Ministerial Inquiry; (
b) reappoint Betty Thomas of Dartmouth, Halifax Regional Municipality, as a member of the Nova Scotia Police Commission, for the purposes only of completing the Ministerial Inquiry into the death of James Guy Bailey, Jr. commenced in 2001, for a further term of office commencing March 30, 2004, and expiring on the completion of that Ministerial Inquiry; and (
c) order that the Province shall defend, negotiate or settle claims or charges made against M. Frances Hinton and Betty Thomas and indemnify them from personal liability provided that the Province is satisfied the claim arises out of their activities in relation to their appointments and is not based on fraud or criminal activity and where the Province so defends them, the Province will be in control of the case.
