Section 1 of the Family Services Act,

chapter F-2.2 of the Acts of New Brunswick, 1980, is amended 1 L’article 1 de la

a) in the definition “community social services” or “social services” by adding after paragraph (

t) the following:

c) has frequent contact with a person residing in a community placement resource or a child receiving kinship services by virtue of the adult’s relationship with the operator, staff member, care provider, foster parent or kinship caregiver; (personne associée) “kin” means extended family members, relatives or other significant persons who have an attachment to a child or are known to a child, but does not include a pa- rent, and “kinship” has the corresponding meaning; (pa- renté) “kinship caregiver” means an adult who is kin to a child and who cares for a child as part of his or her fam- ily; (parent-substitut) « personne associée » s’entend d’un adulte, à l’exclu- sion du responsable, du membre du personnel, du four- nisseur de soins, du parent nourricier, du parent-substitut et d’une personne bénéficiaire de services dans un centre de placement communautaire ou dans une famille alter- native, qui :

section 3 the following: 2 La Loi est modifiée par l’adjonction de ce qui suit après l’article 3 : Determination of suitability Établissement de l’aptitude 3.1(1) The Minister may determine that an operator, a staff member or a class of persons prescribed by regula- tion is not suitable to provide social services or services in a community placement resource in the following cir- cumstances: 3.1(1) Le ministre peut établir qu’un responsable, un membre du personnel ou une catégorie de personnes que prévoient les règlements est inapte à fournir des services sociaux ou à assurer des services dans un centre de pla- cement communautaire dans les cas suivants : (

a) he or she is the subject of a court order made un- der this Act in relation to a danger to the security or development of a child as described in paragraphs 31(1)(

a) to (g);

a) the person shall not provide social services or services in a community placement resource or have contact with a recipient of social services or a resident in a community placement resource, and

Section 23 of the Act is amended in the definition “community placement resource” by striking out “a group home” and substituting “a kinship placement, a child-specific placement, a group home, a treatment cen- tre”. 5 L’article 23 de la Loi est modifié à la définition de « centre de placement communautaire » par la sup- pression de « d’un foyer de groupe » et son remplace- ment par « d’un foyer d’un parent-substitut, d’un foyer de placement particulier d’un enfant, d’un foyer de groupe, d’un centre de traitement ». 6 The heading “Release of information” preceding

section 31.1 the following: 9 La Loi est modifiée par l’adjonction de ce qui suit après l’article 31.1 : Kinship services Services à la parenté 31.2(1) After the Minister completes an investigation, if the Minister has determined that the security or devel- opment of a child is in danger and a plan for the care of the child has been established which does not include placing the child as a child in care, the child may receive kinship services in the home of a kinship caregiver if, in the opinion of the Minister, the kinship caregiver is ca- pable of providing for the child in accordance with standards prescribed by the Minister or by regulation. 31.2(1) Ayant conclu, son enquête terminée, que la sé- curité ou le développement d’un enfant est menacé et qu’a été établi un plan pour le soin de l’enfant n’étant pas assorti d’une disposition prévoyant sa prise en charge, l’enfant peut recevoir des services à la parenté dans le foyer d’un parent-substitut, si le ministre estime que celui-ci est apte à pourvoir au soin de l’enfant en conformité avec les normes qu’il a prescrites ou celles que prévoient les règlements. 31.2(2) The Minister may enter into an agreement with a kinship caregiver, who fulfils the eligibility conditions for assistance prescribed by regulation, to provide finan- cial or other assistance to the kinship caregiver if, in the opinion of the Minister, financial or other assistance is 31.2(2) Le ministre peut conclure avec un parent- substitut remplissant les conditions d’admissibilité que fixent les règlements une entente prévoyant la fourniture à celui-ci d’une aide, notamment financière, s’il l’estime nécessaire pour satisfaire aux besoins essentiels ou ex- ceptionnels de l’enfant.

required to provide for the basic or exceptional needs of the child. 31.2(3) The agreement referred to in subsection (2) may remain in force until the termination of the place- ment. 31.2(3) L’entente que prévoit le paragraphe (2) peut demeurer en vigueur jusqu’à la fin du placement. 10

section if the Minister has transferred guardianship of a child in accordance with

Section 143 of the Act is amended 20 L’article 143 de la Loi est modifié (

a) by adding after paragraph (
