OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Active Transit, dated June 15, 2021, and pursuant to
Section 18 of
Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act and
Section 11 of
Chapter 452 of the Revised Statutes of Nova Scotia, 1989, the Surplus Crown Property Disposal Act is pleased to: (
a) extinguish the right of the public to use that portion of the public highway, identified as Parcel A and Parcel D, containing a combined area of 994 square metres (0.245 acres), more or less, located at or near Creamery Road, Tatamagouche, Colchester County, more particularly described in
Schedule "A" and shown on
Schedule "B" attached to and forming part of the Report and Recommendation; (
b) authorize the conveyance of Parcel A and Parcel D to Creamery Square Association of Tatamagouche, Colchester County for the nominal consideration of $1.00; (
c) authorize the Minister of Transportation and Active Transit to make and execute a Deed of Conveyance in such form as the Minister determines to cause the conveyance of the lands herein above described; and (
d) authorize the Minister of Transportation and Active Transit to execute such documents as may be necessary to achieve the purpose of this Order.
