OIC Text: The Governor in Council on the report and recommendation of the Minister of Transportation and Public Works dated August 18, 2000, pursuant to

Section 18 of

Chapter 371 of the Revised Statutes of Nova Scotia, 1989, the Public Highways Act, is pleased to: (

a) extinguish the right of the public to use that portion of the pubic highway system containing 16,614 square feet, more or less, situate at or near Smelt Brook, Victoria County, and more particularly described in

Schedule "A" and shown outlined in red on

Schedule "B" which schedules are attached to and form part of the report and recommendation together with an easement in favour of Douglas Grant Briand and Susan Bernetta Briand, their heirs, successors, executors and assigns over a parcel of land measuring 30 feet by 30 feet adjacent to the southeast corner of the above lot described in

Schedule "A" for the purpose of using and maintaining the existing well and water lines therein; (

b) convey the said land to Everetta MacKinnon of Eastern Passage, Halifax County, for the price of $331.10; and (

c) authorize the Minister of Transportation and Public Works to make and execute a Deed of Conveyance in such form as the Minister determines.
