Order in Council 330/2021

On the recommendation of the undersigned, the Lieutenant Governor of Ontario, by and with the advice and concurrence of the Executive Council of Ontario, orders that:

Whereas Ontario Mortgage and Housing Corporation (“ OMHC ”), previously named Ontario Housing Corporation, is a statutory Crown agency continued under the Ontario Mortgage and Housing Corporation Act with administration and control of certain assets, including the lands described in

Schedule A and

Schedule B attached hereto;

And

whereas the Ontario Legislature has passed the Ontario Mortgage and Housing Corporation Repeal Act, 2020, which will dissolve OMHC and transfer and vest all its assets, liabilities, rights and obligations to and in the Crown in right of Ontario;

And

whereas the Act has been proclaimed to come into force on March 31, 2021 (the “Effective Date”);

And

whereas it is expedient for Her Majesty the Queen in Right of Ontario as represented by the Minister of Municipal Affairs and Housing to, as of the Effective Date, administer and control all of the non-land assets (other than cash), rights, liabilities and obligations of OMHC , including those under its contracts, securities and other instruments (the “Non-Land Assets and Liabilities”);

And

whereas it is expedient for Her Majesty the Queen in Right of Ontario as represented by the Minister of Municipal Affairs and Housing to, as of the Effective Date, administer and control all the rights and obligations of OMHC under those leases, charges and mortgages under OMHC 's administration and control, including any such leases, charges and mortgages registered in the name of Ontario Housing Corporation, Ontario Mortgage Corporation, Housing Corporation Limited or Ontario Land Corporation (the "Leases, Charges and Mortgages");

And

whereas it is expedient for Her Majesty the Queen in Right of Ontario as represented by the Minister of Municipal Affairs and Housing to, as of the Effective Date, administer and control the lands set out in

Schedule A (the “ MMAH Lands”);

And

whereas it is expedient for Her Majesty the Queen in Right of Ontario as represented by the Minister of Transportation to, as of the Effective Date, administer and control the lands set out in

Schedule B (the “ MTO Lands”);

And

whereas it is expedient for Her Majesty the Queen in Right of Ontario as represented by the Minister of Municipal Affairs and Housing to, as of the Effective Date, administer and control all lands under the administration and control of OMHC other than the MMAH Lands and MTO Lands;

Now therefore , pursuant to the Royal Prerogative,

the administration and control of (

i) the Non-Lands Assets and Liabilities, (ii) the Leases, Charges and Mortgages, and (iii) the MMAH Lands, together with any rights or interests appurtenant to the MMAH Lands, and (iv) all lands under the administration and control of OMHC other than the MMAH Lands and MTO Lands, together with any rights or interests appurtenant to the lands are hereby transferred as of the Effective Date by this Order-in-Council from OMHC to Her Majesty the Queen in Right of Ontario as represented by the Minister of Municipal Affairs and Housing; and

the administration and control of the MTO Lands, together with any rights or interests appurtenant to the MTO Lands, are hereby transferred by this Order-in-Council as of the Effective Date from OMHC to Her Majesty the Queen in Right of Ontario as represented by the Minister of Transportation.
