1 2006 BILL 67 Right to Read Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows:

Definitions 1 The following

definitions apply in this Act. “Committee” means the committee established in sec- tion 2. (Comité) “Minister” means the Minister of Education. (ministre) “objectives” means the objectives aimed at the en- hancement of school libraries established in

section 4. (objectifs) “term” means four years. (mandat) Establishment of Committee 2 A body for study and consultation, hereinafter called “the Committee” is established under the name “Commit- tee for Restoring School Libraries” in English and “le Co- mité pour l’amélioration des bibliothèques scolaires ” in French. Désigne les objectifs visant l’amélioration des bibliothèques scolaires tels qu’établis à l’article 4. (objectives) Création du Comité 2 Un organisme d’étude et de consultation appelé en français « le Comité pour l’amélioration des bibliothèques scolaires » et en anglais « Committee for Restoring School Libraries », est créé, appelé par la suite « le Comité » dans la présente loi.

Loi sur le droit de lire Duties of the Committee 3 The Committee shall (

a) provide advice and counsel to the Minister on the objectives; and (

b) report to the Legislative Assembly, as established by

section 5, on the progress made towards the objec- tives and the additional steps required to ensure their attainment. Objectives 4 The Minister shall consult with the Committee in or- der to attain the following objectives by December 31, 2010: (

a) equipping every school, as defined by the Educa- tion Act, with a school library which is an effective cen- tre for the development of reading, research and problem-solving skills; (

b) maintaining data for each district regarding (

i) spending on library books and other media; (ii) number of provincial holdings of books and other media; (iii) number of library books by Canadian authors; (iv) number of qualified librarians and teacher li- brarians in schools; and (

v) number of hours which school libraries are open, staffed, and available to students; (

c) implementing an increase in library books and other media holdings by fifty percent from the levels in place on January 1, 2005; (

d) ensuring that school libraries increase the propor- tion of their holdings which are the copyrighted works of Canadian authors; (

e) creating a professional designation for the posi- tion of teacher-librarian and school librarian; Fonctions du Comité 3 Le Comité :

Objectifs 4 Le ministre doit consulter le Comité afin de s’assurer que les objectifs suivants soient atteints avant le 31 dé- cembre 2010 :

a) équiper chaque école, telle que définie dans la

Loi sur l’éducation, d’une bibliothèque scolaire qui est un centre propice pour le développement de la lecture, de la recherche et des habiletés en résolution de problè- mes;

b) pour chaque district scolaire, recueillir les données suivantes : (

i) les dépenses associés à l’achat de livres et autres médias, (ii) le nombre de livres en bibliothèque et autres médias appartenant à la province, (iii) le nombre de livres en bibliothèque d’auteurs canadiens, (iv) le nombre de bibliothécaires qualifiés et d’enseignants-bibliothécaires dans les écoles, (

v) nombre d’heures que la bibliothèque est ouverte, surveillée et disponible pour les étudiants;

c) réaliser une augmentation du nombre de livres et autres médias en bibliothèque de 50 % par rapport au nombre en place le 1 er janvier 2005;

d) s’assurer que les bibliothèques scolaires augmen- tent la proportion de livres d’auteurs canadiens proté- gés par un droit d’auteur;

e) créer une désignation professionnelle pour le poste d’enseignant-bibliothécaire et de bibliothécaire sco- laire;

f) ensuring that schools have access to librarians and teacher librarians who are available to teaching faculty to assist in the development of curriculum and peda- gogy; (

g) ensuring that students at every school have ade- quate access to their library and librarians during in- structional time, and for reasonable times outside nor- mal hours of in-class instruction; and (

h) developing provincial standards for the dedicated funding of the maintenance and enhancement of school library collections. Committee Report 5(1) The Committee shall report to the Legislative As- sembly each calendar year no later than the thirty-first day of December, by filing a report with the Speaker of the Legislative Assembly. 5(2) The report of the Committee shall contain (

a) a report on progress toward the objectives; (

b) information on the level of funding, by district, designated to school libraries; (

c) recommendations for making further progress on the objectives, including the levels of funding; and (

d) any further information the Committee shall see fit. 5(3) The Minister may, by regulation, impose additional requirements upon the report of the Committee. 5(4) The Minister shall, within ninety days of receipt of the report of the Committee by the Legislative Assembly, lay before the Legislative Assembly a response to any rec- ommendations made by the Committee. Composition of Committee 6(1) The Committee shall consist of up to nine members appointed by the Minister. 6(2) The Minister shall appoint a Chairperson.

g) s’assurer que les étudiants de chaque école peu- vent facilement accéder à leur bibliothèque et deman- der de l’aide aux bibliothécaires pendant la période d’enseignement, et pour des périodes raisonnables en dehors des heures normales d’enseignement;

h) développer des normes provinciales pour le finan- cement consacré à l’entretien et l’amélioration des col- lections des bibliothèques scolaires. Rapport du Comité 5(1) À chaque année, le Comité rendra compte à l’As- semblée législative au plus tard le 31 décembre de l’année civile, en déposant un rapport au président de l’Assemblée législative. 5(2) Le rapport doit contenir :

a) un rapport sur le progrès des objectifs;

b) des données sur le niveau de financement, par dis- trict scolaire, accordé aux bibliothèques scolaires;

c) des recommandations pour améliorer l’atteinte des objectifs, y compris les niveaux de financement;

d) toutes autres informations que le Comité considère appropriées. 5(3) Le ministre peut, par règlement, imposer des exi- gences supplémentaires pour le rapport du Comité. 5(4) Le ministre doit, dans les quatre-vingt-dix jours suivant la réception du rapport du Comité par l’Assem- blée législative, porter devant l’Assemblée législative une réponse à toutes les recommandations faites par le Co- mité. Composition du Comité 6(1) Le Comité est composé d’un maximum de neuf membres nommés par le ministre. 6(2) Le ministre nomme une personne à la présidence.

Loi sur le droit de lire 6(3) The Minister shall ensure that at least one member of the Committee is a school librarian employed within the Province of New Brunswick. 6(4) The Minister shall ensure that at least three mem- bers of the Committee are school teachers employed within the Province of New Brunswick. 6(5) The Minister shall ensure representation from the Anglophone and Francophone education systems when appointing members of the Committee. 6(6) The Minister shall, in making appointments under subsection (4), consult with the associations representing teachers in negotiations under the Public Service Labour Relations Act.

Reappointment or replacement of members 7(1) The members of the Committee shall continue to serve notwithstanding the expiry of their term until notice is given to the Minister. 7(2) The Minister shall fill any vacancy upon the Com- mittee as required. 7(3) The Minister may, by regulation, establish com- pensation to be paid to members of the Committee. Consequential Amendments 8 Subsection 57(1) of the Education Act,

chapter E-1.12 of the Acts of New Brunswick, 1997, is amended (

a) by adding after paragraph (

e) the following: (e.1) respecting the minimum levels of funding and hours of operation for school libraries; (

b) by adding after paragraph (w.1) the following: (w.1.1) respecting the qualifications needed for the designation of teacher-librarian; Lapse 9 This Act shall lapse on December 31, 2010. 6(3) Le ministre s’assure qu’il y a au moins un membre du Comité qui est un bibliothécaire employé au Nouveau- Brunswick. 6(4) Le ministre s’assure qu’au moins trois membres du Comité sont des enseignants employés au Nouveau- Brunswick. 6(5) Le ministre doit s’assurer que les systèmes d’édu- cation francophone et anglophone sont représentés lorsqu’il nomme les membres du Comité. 6(6) Le ministre doit, lors des nominations en vertu du paragraphe (4), consulter les associations qui représentent les enseignants lors de négociations en vertu de la Loi re- lative aux relations de travail dans les services publics.

Renouvellement des nominations ou remplacement des membres 7(1) Les membres du Comité demeureront en fonction, nonobstant l’expiration de leur mandat, jusqu’à ce qu’ils donnent avis au ministre. 7(2) Le ministre rempli tout poste vacant du Comité au besoin. 7(3) Le ministre peut, par règlement, établir une rému- nération à être payée aux membres du Comité. Modifications corrélatives 8 Le paragraphe 57(1) de la

Loi sur l’éducation, cha- pitre E-1.12 des Lois du Nouveau-Brunswick de 1997, est modifié :

a) par l’adjonction, après l’alinéa e), de ce qui suit : e.1) respecter le niveau minimum de financement et d’heures d’opération pour les bibliothèques scolaires;

b) par l’adjonction, après l’alinéa w.1), de ce qui suit : w.1.1) respecter les qualifications requises pour la dé- signations des enseignants-bibliothécaires; Expiration 9 La présente loi expire le 31 décembre 2010.

5 Right to Read Act Bill 67 Commencement 10 This Act or any provision of it comes into force on a day or days to be fixed by proclamation. Entrée en vigueur 10 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur au jour ou aux jours fixés par pro- clamation.
