An Act to Amend the Provincial Offences Procedure Act Loi modifiant la

chapter P-22.1 of the Acts of New Brunswick, 1987, is amended 1 Le paragraphe 10(1) de la

a) in paragraph (

g) by striking out “and” at the end of the paragraph;

Section 55 of the Act is repealed and the following is substituted: 7 L’article 55 de la Loi est abrogé et remplacé par ce qui suit : 55(1) Despite any provision of this Act or any other Act, a judge may release a defendant without the imposi- tion of a fine, a term of imprisonment or any other sen- tence that a judge may or shall impose under this Act or any other Act if the judge has convicted the defendant of an offence that does not, on conviction, carry a manda- tory term of imprisonment and the judge is of the opin- ion that 55(1) Par dérogation à toute autre disposition de la présente loi ou de toute autre Loi, le juge peut libérer le défendeur sans l’imposition d’une amende, d’une peine d’emprisonnement ou de toute autre sentence, qu’il peut ou doit imposer en vertu de la présente loi ou de toute autre Loi s’il l’a déclaré coupable d’une infraction qui ne comporte pas de peine d’emprisonnement obligatoire et qu’il conclut à tout ce qui suit : Projet de loi 52 Loi modifiant la

i) it is not in the public interest to impose a fine or a term of imprisonment, and (

Section 86 of the Act is repealed and the following is substituted: 12 L’article 86 de la Loi est abrogé et remplacé par ce qui suit : 86(1) A defendant is in default of payment of a fine if the fine has not been fully paid within the time set by

Section 347.1 of the Motor Vehicle Act,

chapter M-17 of the Revised Statutes, 1973, is amended 13 L’article 347.1 de la

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 347.1(1) Subject to subsections (1.01) and (1.1), if a person is convicted of an offence under this Act, the reg- ulations, subsection 4(1) or (2) or 7(5) or (6) of the Transportation of Dangerous Goods Act or a local by- law, other than an offence under

section 105.1, 345 or 346, and a fine is imposed, the fine is immediately due and payable and the judge or the clerk of the Court in which the fine was imposed shall, instead of proceeding under the Provincial Offences Procedure Act , prepare and immediately forward to the person with a copy to the Registrar, a notice, in the form which the Registrar may require, stating that, if the person holds a licence, the licence will be revoked and the person’s driving priv- ilege suspended or, if the person does not hold a licence, the person’s driving privilege will be suspended, if full payment of the fine is not received by the Registrar within 90 days after the date of the notice, if the amount of the fine is less than $ 1,200, or within 180 days after the date of the notice, if the amount of the fine is $ 1,200 or more. 347.1(1)

Loi sur la procédure applicable aux infractions provinciales, rédiger et envoyer immédiatement un avis à la personne ainsi qu’une copie de cet avis au registraire, en la forme que le registraire peut exiger, déclarant que le droit de conducteur de cette personne sera suspendu et son per- mis sera révoqué au cas où elle est titulaire d’un permis ou, si elle n’est pas titulaire d’un permis, son droit de conducteur sera suspendu, si le registraire ne reçoit pas le paiement entier de l’amende dans les quatre-vingt-dix jours de la date de l’avis si le montant de l’amende est inférieur à 1 200 $, ou dans les cent quatre-vingts jours de la date de l’avis si le montant de l’amende est égal ou supérieur à 1 200 $.

Section 2 of

An Act Respecting the Surcharge Payable under the Victims Services Act,

chapter 4 of the Acts of New Brunswick, 2019, is repealed. 14 L’article 2 de la Loi concernant le montant sup- plémentaire exigé en vertu de la

Loi sur les services aux victimes,

chapitre 4 des Lois du Nouveau- Brunswick de 2019, est abrogé.
