APPENDIX C

ORDER

1 In this Order, "annexed land" means the land described in Appendix A

and shown on the sketch in Appendix B.

2(1) For taxation purposes in 2002 and later years up to and including

2011, the annexed land and the assessable improvements to it

(

a) must be assessed by the Village of Irricana on the same basis

as if they had remained in the Municipal District of Rocky View No. 44, and

(

b) must be taxed by the Village of Irricana in respect of each

assessment class that applies to the annexed land and the assessable

improvements to it using the tax rate established by the Municipal District

of Rocky View No. 44.

(2) Subsection (1) does not apply where the annexed land or the

assessable improvements to it are held by the Crown in right of Alberta or

Canada.

Section 2 ceases to apply to a portion of the annexed land and the

assessable improvements to it in the taxation year immediately following

the taxation year in which

(

a) the portion becomes a new parcel of land created as a result of

subdivision or separation of title by registered plan of subdivision or by

instrument or any other method that occurs at the request of, or on behalf

of, the landowner,

(

b) the portion becomes a residual portion after a new parcel

referred to in clause (

a) has been created and the residual portion is 3

acres or less,

(

c) the portion is, at the request of or on behalf of the

landowner, redesignated by an amendment to the Village of Irricana Land Use

bylaw,

(

d) the portion is, at the request of or on behalf of the

landowner, subject to a local improvement tax bylaw and is provided with

water and sewer services by the Village of Irricana pursuant to that bylaw,

(

e) the portion is connected to water and sewer services provided

by the Village of Irricana.

4 After

section 2 ceases to apply to a portion of the annexed land in a

taxation year, the portion of the annexed land and the assessable

improvements to it must be assessed and taxed for the purposes of property

taxes in that year on the same basis as the assessment and taxation of

property of the same assessment class in the Village of Irricana.

NOTICE OF INTENTION TO DESIGNATE PROVINCIAL HISTORIC RESOURCE

(Historical Resources Act)

Notice is hereby given that sixty days from the date of service of this

Notice and its publication in Alberta Gazette, the Minister of Community

Development intends to make an Order that the structure known as the Milnes

Block, together with the land legally described as:

Plan 147N, Block 3, the North 10 feet of Lot 9 and all of Lot 10, and

municipally located at 105, 107, 109-50 Avenue West, and 4925 and 4927-1

Street West, Claresholm, Alberta

be designated as a Provincial Historic Resource under

section 20 of the

Historical Resources Act, R.S.A. 2000 c.H-9.

The reasons for the designation are as follows:

The Milnes Block is a large two-story Edwardian Commerical style building

with load bearing brick walls sandstone trims. The ground level has

rusticated brick columns. It was constructed in 1910 for T.C. Milnes, a

prominent realtor, rancher, and entrepreneur. Milnes was also a prominent

public citizen, serving a term as the Mayor of Claresholm and running

successfully as the independent candidate for the Claresholm riding in the

Provincial election of 1921. Over the years the Milnes Block came to

accomodate a wide variety of commercial ventures, including banks and

restaurants. It has always been the centre of business activity in the

community. It is a very good example of the Edwardian Commercial style and

retains a high degree of its original intergrity. It is a prominent

landmark and is integral to the historical continuity of the streetscape in

Claresholm.

Its historical significance lies in its structural representation of the

growth of Claresholm during the early part of the twentieth century, and in

its association with its first and principal owner, Charles Milnes.

It is therefore considered that the preservation and protection of the

resource is in the public interest.
