Article 12 of the Rules as set out in the resolution of December 1, 2000 are approved except for the reference "or 5(3)" in

Article 12.01A; 3. the amendments to

Article 10.04 as set out in the resolution of December 1, 2000, are effective April 1, 2001; and 4. the amendments to Appendix 1 of the Rules, as set out in the attached resolution of the Council of the College dated February 12, 2001, are approved and are effective April 1, 2001. PROPOSED AMENDMENT

ARTICLE 1 -

INTERPRETATION 1.01 Gender. In these Rules, wherever the singular or masculine or neuter is used, the same will be construed to mean the plural or feminine or body corporate where the context so requires. 1.02 Delegation. Where, in these Rules, Council appoints a person, committee, or panel under

Section 28 (3) of the Act to carry out, or a person, committee, or panel is charged with, a specific power, duty, or function: (

a) the term "Council" means the person, committee, or panel so appointed for the purpose of carrying out the powers, duties, or functions Council has delegated to it; and (

b) either Council or the person, committee, or panel so appointed may carry out the delegated powers, duties, or functions. The Executive Committee may take action on all matters on which Council may take action, and may exercise all the powers, functions, and duties of Council, except if the Executive Committee is expressly prohibited from doing so under the Act or the Rules or from a direction from Council. The Executive Committee may not amend these Rules. 1.03 Sturgis rules.

The rules set forth in Sturgis New Edition will apply to all meetings and procedures of Council, the College, committees, and panels, except if they are inconsistent with the Act or the Rules. 1.04 NSF charge. PROPOSED AMENDMENT

ARTICLE 8 - LIMITED MEMBERS AND LIMITED ALLIED DENTAL PERSONNEL 8.01 Requirements for dental student practitioners. Council hereby delegates to the registrar the power and discretion and for such period and upon such terms and conditions as the registrar deems fit, to issue a permit to practise dentistry as a limited member in the category of "dental student practitioner" to a person who: (

a) is enrolled as an undergraduate student at The University of British Columbia or at another post- secondary educational institution whose faculty of centistry and program for dental student practitioners is approved by Council; (

b) has passed the second to last year in that faculty of dentistry; (

c) is recommended to the college by The University of British Columbia faculty of dentistry or other faculty of dentistry referred to in

Article 8.01(a); and (

d) delivers to the registrar an application, duly completed by that person, to be registered as a limited member under

Section 26(3) of the Act in the category of "dental student practitioner" together with the prescribed fee for registration, which the registrar will refund if the permit is not issued. No person may practise as a dental student practitioner except: (

e) if that person holds a valid permit issued pursuant to this

Article 8.01; and (0 under the personal supervision of a member who is duly licensed and in good standing, and to the extent only that such member delegates duties to the dental student practitioner. The term "personal supervision" in this

Article 8.01 means that the supervising member must be present in the dental office at all times when the dental student practitioner is performing any of the duties delegated to them upon a patient, must examine the patient at the beginning of the appointment, and must evaluate the treatment after it is completed and prior to the patient being dismissed.

The supervising member will be responsible for the dental student practitioner's activities and must personally review the treatment plan and the treatment rendered in accordance with the protocols of the dental student practitioner program at the faculty of dentistry at The University of British Columbia or institution which such dental student practitioner attends. 8.02 Requirements for dental interns/residents.

Council hereby delegates to the registrar the power and discretion and for such period and upon such terms and conditions as the registrar deems fit, to issue a permit to practise dentistry as a limited member in the category of "S-ntal intern" to a person who delivers to the registrar: (

a) a notarized copy, or other evidence satisfactory to the registrar, of a doctoral degree in dentistry from a post-secondary educational institution whose faculty of dentistry is approved by the Commission on Dental Accreditation of Canada, the Canadian Dental Association; the Commission on Dental Accreditation of the American Dental Association or the American Dental Association; except for post-secondary educational institutions specifically riot approved by Council, or an NDEB certificate; dentists act & rules1Article 81Article 8, Revision, Dec I, 2000 without strikcouts.doc

b) an indenture of internship in form and substance acceptable to the registrar, duly executed by that person and by the director of the dental department or dental service of a hospital or other institution approved by Council, which internship will be for a period of no more than 12 months, except if the registrar approves an extension of that period; and (

c) an application, duly completed by that person, to be registered as a limited member under

Section 26(3) of the Act in the category of "dental intern" together with the prescribed fee for registration, which the registrar will refund if the permit is not issued. No person may practise as a dental intern except: (

a) if that person holds a valid permit issued pursuant to this

Article 8.02; (

b) that a dental intern may perform only those duties which Council or the dental intern's hospital or other approved institution prescribes. 8.03 Requirements for other limited members. Council hereby delegates to the registrar the power and discretion and for such period and upon such terms and conditions as the registrar deems fit, to issue a permit as a limited member to a person who: (

a) desires registration as a limited member solely for the purpose of': (

i) taking or presenting a denta: course, (ii) conducting or engaging in a clinical presentation, study club, or research program, at or under the sponsorship of a faculty of dentishy at a university, dental or other group, or society which the registrar approves, or (iii) such other purpose as the registrar deems reasonable and of merit; and (

b) is practising dentistry within the terms of their employment if they are an employee of the Canadian armed services or of the Government of Canada or a department thereof, and is duly licensed to practise dentistry in a province or territory of Canada; and (

c) delivers to the registrar: (

i) a notarized copy, or other evidence satisfactory to the registrar, of a doctoral degree in dentistry or equivalent qualification from a post-secondary• educational institution, satisfactory to the registrar, or an NDEB certificate ; (ii) evidence, satisfactory to the registrar, of current registration andior licensure in another jurisdiction, (iii) an application, duly completed by that person, to be registered as a limited member under

Section 26(3) of the Act together with the prescribed fee for limited registration, which the registrar will refund if the permit is not issued, and (iv) a letter of good standing, satisfactory to the registrar, dated within three months of the application date, from all previous and current regulatory and licensing authorities of any jurisdiction where such person is or was licensed, stating that such person is or was duly licensed and in good standing is that jurisdiction and that their licence was not or has not been suspended, cancelled, limited or restricted and that no investigation, review or proceeding is taking place in that jurisdiction which could result in the suspension or

3 cancellation of that person's authorization to practise dentistry. No person may practise as a limited member except if that person holds a valid permit issued pursuant to this

Article 8.03. 8.04 Requirements for limited certified dental assistant. Council hereby delegates to the registrar the power and discretion and for such period and upon such terms and conditions as the registrar deems fit, to issue a permit as a "limited certified dental assistant", to a person who: (

a) desires registration as a limited certified dental assistant solely for the purpose of: (

i) taking or presenting a dental auxiliary course for certified dental assistants the content of which has been approved by the registrar, conducting or engaging in a clinical presentation, study club, or research program, at or under the sponsorship of a faculty of dentistry at a university, or dental or other group or society which the registrar approves, or (iii) such other purpose as the registrar deems reasonable and of merit; (

b) delivers to the registrar: (

i) evidence, satisfactory to the registrar, of current registration and/or licensure in another jurisdiction, equivalent to BC, (ii) an application, duly completed by that person, to be registered as a limited certified dental assistant, together with the prescribed fee for limited registration, which the registrar will refund if the permit is not issued, and (.ii) a letter of good standing, satisfactory to the registrar. dated within one month of the application date, from all previous and current regulatory and licensing authorities of any jurisdiction where such person is or was licensed, stating that such person is or was duly licensed and in good standing in that jurisdiction and that their licence was not or has not been suspended, cancelled, limited or restricted and that no investigation, review or proceeding is taking place in that jurisdiction which could result in the suspension or cancellation of that person's authorization to practise as a certified dental assistant.

No person may carry out delegated duties or procedures as a limited certified dental assistant, except if that person holds a valid permit issued pursuant to this

Article 8.04. 8.05 limitation on practice. A person who is registered as a dental student practitioner, a dental intern, a limited member, or a limited certified dental assistant, as the case may be, may not practise dentistry or perform dental services or carry out delegated duties or procedures, as the case may be, except in accordance with the terms and conditions of that person's permit, and in accordance with the Act and the rules. 8.06 Revocation of permit.

Council hereby delegates to the registrar the power to revoke a permit issued under Articles 8.01, 8.02, 8.03, or 8.04 at any time. 8.07 Conduct and ethics. The requirements in the Act and rules which pertain to registrants including, without limitation, the rules of conduct and ethics set forth in

Article 5 will apply to all persons to whom permits are issued under this

Article 8, except insofar as Council deems any of them to be inapplicable.

PROPOSED AMENDMENT

ARTICLE 10 — ALLIED DENTAL PERSONNEL 10.01 Allied Dental Personnel. Council hereby establishes the following allied dental personnel categories of persons to carry out certain duties and procedures related to the treatment of patients in accordance with these Rules: (

a) persons not registered under the Rules who will be known as dental assistants; and (

b) persons registered under the Rules who will be known as certified dental assistants. 10.02

Definitions. In this

Article 10, and otherwise in these Rules if the context so requires: (a) "certified dental assistant applicant" means a person who applies to be registered under the Rules pursuant to

Article 10.03 as a certified dental assistant and (b) "certified dental assistant examination" means the examination referred to in

Article 10.05(a). (c) "dental hygienist" means a registered member in good standing of the College of Dental Hygienists of British Columbia 10.03 Registration requirements for certified dental assistants. An✓ person who applies to be registered under the Rules as a certified dental assistant and who meets any other requirements for registration set forth in the Act and in the Rules, is eligible for registration if that person: (

a) is a graduate of a dental assisting program, dental hygiene program or dental program (any one of which, in any event, being acceptable to the certified dental assistant examination committee) and either passes the requisite certified dental assistant examination prescribed by the certified dental assistant examination committee or delivers to the registrar a copy, or other evidence satisfactory to the registrar, of that person's certificate or diploma referred to in

Article 10.05(e), and evidence satisfactory to the registrar that such person is the person named therein; and (

b) delivers to the registrar: (

i) an application to be registered under the Rules as a certified dental assistant duly completed by the certified dental assistant applicant, together with the prescribed fee for registration under the Rules, which the registrar will refund to the certified dental assistant applicant if that applicant is not registered under the Rules, (ii) evidence satisfactory to the registrar that: the certified dental assistant applicant has not contravened this Act or any Rule made under it; the certified dental assistant applicant has not been convicted in Canada or elsewhere of any offence that, if committed by a person registered under the Act or the Rules, would constitute unprofessional conduct or conduct unbecoming a person registered under the Act or the Rules; the certified dental assistant applicant's past conduct does not demonstrate any pattern of incompetency or untrustworthiness, which would make registration contrary to the public interest; the certified dental assistant applicant is a person of good character; and the certified dental assistant applicant's entitlement to perform the duties of a certified dental assistant has not been limited or had restrictions or conditions attached thereto in British Columbia or in any other jurisdiction at any time. notice of intention to take the certified dental assistant examination,

ARTICLE 10 REVISION, DECEMBER 2000 WITMS TRIKEOUTS

(iv) the prescribed fee for the certified dental assistant examination, and (

v) a letter of good standing, satisfactory to the registrar, dated within one month of the application date, from all previous and current regulatory and licensing authorities of any jurisdiction where such person is or was licensed, stating that such person is or was duly licensed and in good standing in that jurisdiction and that their licence was not or has not been suspended, cancelled, limited or restricted and that no investigation, review or proceeding is taking place in that jurisdiction which could result in the suspension or cancellation of that person's authorizatico to practise as a certified dental assistant.

No other person is eligible for registration under the Rules. 10.04 Reinstatement. A former certified dental assistant who ceased to be registered by reason only of a failure to renew their licence pursuant to

Article 11 or a thilure to comply with continuing education requirements pursuant to

Article 17 is eligible for reinstatement by Council where the former certified dental assistant: (

a) applies for reinstatement in the form required by Council not later than 90 days following the expiration of their registration; (

b) except for a failure to renew their licence pursuant to

Article 11 or a failure to comply with continuing education requirements pursuant to

Article 17, is not in contravention of the Act or these Rules; (

c) pays the appropriate fees as set out in Appendix 1; and (

d) complies with such conditions as may be imposed by Council where the registration ceased as a result only of the registrant's failure to comply with continuing education requirements pursuant to

Article 17. 10.05 Certified dental assistant examination committee. Council will appoint from time to time registrants and public representatives as members of the certified dental assistant examination committee , to hold office at Council's pleasure. The certified dental assistant examination committee will from time to time: (

a) prescribe the subjects and criteria to be included in any certified dental assistant examination; (

h) prescribe the times and places in each year in which any certified dental assistant examination will be held; (

c) designate examiners and alternates for each certified dental assistant examination from the pool of examiners approved by Council; (

d) determine the passing marks for each certified dental assistant examination; and (

e) recommend to Council what certificates, diplomas or degrees evidencing graduation from a program for the training of certified dental assistants, dental hygienists or dentists may be accepted in lieu of a certified dental assistant applicant being obliged to take a certified dental assistant examination as a prerequisite to registration. Council may accept, reject or refer the recommendation back to the certified dental assistant examination committee by simple resolution. 10.06 Supplies.

Each certified dental assistant applicant will furnish all materials and equipment required for the certified dental assistant examination, as required by, and satisfactory to, the certified dental assistant examination committee or the examiners. 10.07 Reporting, appealing, and reviewing marks. The examiners who conduct any certified dental assistant examination will report the results thereof for each certified dental assistant applicant to the registrar within four calendar days after the date of the examination.

The registrar will mail each certified dental assistant applicant's results to the certified der:tal assistant applicant at the

address shown on the application. Certified dental assistant applicants may telephone the registrar to obtain their results.

Within 30 calendar days after the date of mailing a certified dental assistant applicant's results, and whether or not the certified dental assistant applicant has received written results by mail, the certified dental assistant applicant may, upon payment of the applicable fee set out in Appendix 4, appeal the results to the certified dental assistant examination committee, and that committee will then review the results and either amend or affirm them and will report its decision to the registrar.

The registrar will then declare and publish the results of such certified dental assistant examination and report the results of any appeal to any certified dental assistant applicant who appealed. 10.08 Re-examination. A certified dental assistant applicant who has failed an examination on one occasion may apply again under

Article 10.03 to take a further certified dental assistant examination and subject to compliance with those provisions, that person shall be entitled to do so. The certified dental assistant examination committee may, acting in the course of an appeal under

Article 10.07, permit the certified dental assistant applicant: (

a) to undertake any further certified dental assistant examination without cost; or (

b) who has failed the certified dental assistant examination on a second occasion, to take the certified dental assistant examination once more, if the certified dental assistant examination committee is of the opinion that the certified dental assistant applicant failed the certified dental assistant examination for reasons beyond that person's control. 10.09 Further re -examination. Subject to

Article 10.08, a certified dental assistant applicant who has failed a certified dental assistant examination twice may not take a further certified dental assistant examination except if that person: (

a) undertakes further study which is satisfactory to Council; or (

b) otherwise satisfies Council that they should be permitted to take a further certified dental assistant examination by reason of extraordinary circumstances, and that person applies again under

Article 10.03. 10.10 Improper conduct. If, in an examiner's opinion, a certified dental assistant applicant displays improper conduct during the course of a certified dental assistant examination, that person will be disqualified from further participation in that or any other certified dental assistant examination, except with the consent of the certified dental assistant examination committee. 10.11 Upgrading requirements.

Either the registrar or the certified dental assistant examination committee shall require a registered certified dental assistant who applies for an annual licence and who has not practised as a certified dental assistant for at least 900 practice hours within the three years preceding the date of application for an annual licence, to pass a certified dental assistant examination to determine that such person's skills and knowledge are still adequate to perform the applicable duties and procedures which may be delegated under the Rules.

If any such person fails that examination, the certified dental assistant examination committee may require that person to take and successfully complete courses of study and training, prior to taking the certified dental assistant examination for a second time. 10.12 Training programs. Council may approve training programs, called modules, to teach specific skills to allied dental personnel.

If an allied dental personnel successfully completes the relevant module, then the registrar will note that on the person's licence and, duly licensed members may then delegate such skills to such persons, in accordance with these Rules. 10.13 Personal supervision or direction. Dental assistants and certified dental assistants, and dental hygienists may work only under the personal supervision or direction of a duly licensed member as set forth in these Rules. "Personal supervision" means that: 3

(

a) except as set forth in

Article 10.13(b), a duly licensed member must examine the patient at the beginning of the appointment if that would be considered necessary or appropriate in accordance with good dental practice, and in any event, prior to any diagnostic radiographs being taken; (

b) if a patient returns for follow-up treatment which a duly licensed member has specifically authorized, a duly licensed member need not examine the patient on that occasion if it occurs within 60 days after the first appointment or unless such examination would be considered necessary or appropriate in accordance with good dental practice; (

c) a duly licensed member must give the dental assistant or certified dental assistant, as the case may be, specific and appropriate instructions for the performance of the delegated duties or procedures within 60 days or within such shorter period as may be considered necessary or appropriate in accordance with good dental practice; and (

d) a duly licensed member must be in the dental office at the time the dental assistant, or certified dental assistant, as the case may be, is performing any delegated duties or procedures. (The employer member need not provide the personal supervision so long as a duly licensed member is present). "Direction", which applies only to dental hygienists, means that: (

e) a duly licensed member must examine the patient during the course of the appointment, or at the beginning of the appointment if that would be necessary or appropriate in accordance with good dental practice, except that if a patient returns for follow-up treatment which a duly licensed member has specifically authorized, a duly licensed member need not examine the patient on that occasion if it occurs within 365 days after the first appointment or unless such examination would be considered necessary or appropriate in accordance with good dental practice; (

I) a duly licensed member must give the dental hygienist specific and appropriate instructions for the performance of the delegated duties or procedures within 365 days or within such shorter period as may be considered necessary or appropriate in accordance with good dental practice; and (

g) a duly licensed member need not be present in the dental office at the time the duties or procedures are carried out, except as set forth in

Article 10.20(

j) or except if his presence or examination would be appropriate or necessary in accordance with good dental practice. 10.14 Dental public health programmes. Notwithstanding

Article 10.13, in dental public health programmes, where health promotion activities are carried out and the provision of dental treatment is excluded, the requirements for personal supervision or direction may be modified to the extent set forth in this

Article 10.14. Any such programme must be under the direction of a duly licensed member who will undertake the professional responsibility for the programme's content and the conduct of the public health workers involved. Dental hygienists may work in such a programme under the direction of a duly licensed member. Such direction may be from a distance and not require day to day supervision. Public health hygienists approved by the Director of Dental Services may assume the responsibility for supervising other dental hygienists for the directing member.

Dental assistants or certified dental assistants working in public health programmes require the day to day supervision of a duly licensed member or of a dental hygienist who is working under the direction of a duly licensed member or of a category of dental hygienists approved by the Director of Dental Services. 10.15 Association with licensed members.

No dental assistant, certified dental assistant, or dental hygienist may carry out delegated duties or procedures independently hut, rather, must do so in regular association with a duly licensed member and in the central office core from which that member conducts his practice, except that such persons may carry out delegated duties or procedures in institutions or places which council approves such as, but not limited to, extended care hospitals or group homes, on such terms as council may prescribe. 4

10.16 Delegation of duties to a dental assistant. A duly licensed member may delegate the following duties or procedures to a dental assistant if he is satisfied, from his personal knowledge, that the dental assistant is properly trained to perform the delegated duties or procedures but only under the personal supervision of a duly licensed member: (

a) recording medical, dental, and nutritional histories; (

b) providing individualized home care instructions; (

c) processing exposed radiographic films; (

d) passing dental instruments and material; (

e) irrigating the oral cavity; (

f) applying air to the teeth or oral cavity; (

g) cleansing prepared cavities; (

h) inserting and removing cotton rolls into the oral cavity; placing and removing rubber dams and clamps; (

j) pouring, trimming, and articulating study casts; (

k) polishing dentures; (0 taking temperature, blood pressure, pulse, and respiration rate; (

m) taking intra-oral and extra-oral photographs; (

n) preserving and packaging biopsy specimens for shipment; (

o) applying topical anaesthetic agents; (

p) holding in place and removing impression materials after the supervising member has placed them; (

q) applying topical fluoride; (

r) selecting denture shades and moulds; (

s) after successfully completing training approved by council, exposing infra-oral and extra-oral dental radiographs; and (

t) other procedures that the general examination committee may authorize while the dental assistant is participating in courses of study and training approved by the general examination committee, and subject to the requirements of that committee with respect thereto. 10.17 Delegation of duties to a certified dental assistant. A duly licensed member may delegate the following duties or procedures to a certified dental assistant if he is satisfied, from his personal knowledge, that the certified dental assistant is properly trained and licensed to perform the delegated duties or procedures but only under the personal supervision of a duly licensed member: (

a) those duties or procedures which a dental assistant may perform under

Article 10.16; (

b) polishing clinical crowns of teeth with rubber cup or brush and pashing pastes; (

c) applying topical anticariogenic agents; (

d) taking study model impressions; (

e) applying fissure sealants; (0 evaluating dietary habits and providing nutritional counseling as it pertains to dentistry;

(

g) providing instruction in the use and maintenance of partial and complete dentures and other appliances; (

h) removing sutures; (

i) placing and removing matrices and wedges; (

j) performing first aid procedures; (

k) applying desensitizing agents; (0 removing periodontal dressings; (

m) performing pulp vitality tests using electric pulp tester and thermal pulp tester; (

n) taking simple face-bow transfer; (

o) acid etching prepared cavities; (

p) applying non-invasive identification discs; (

q) after completing the orthodontic module to the satisfaction of the general examination committee, performing those duties or procedures set forth in

Article 10.19; (

r) other procedures that the general examination committee may authorize while the certified dental assistant is participating in courses of study and training approved by the general examination committee, and subject to the requirements of that committee with respect thereto; (

s) applying treatment liners in teeth without pulpal involvement, and (

t) removing retraction cord. 10.18 Procedures during training. Council may also approve the performance of other procedures by dental assistants and by certified dental assistants if they are undergoing courses of study and training approved by council, and may establish standards of supervision while such procedures are being performed. 10.19 Modules (expanded training program).

A duly licensed member may delegate the following duties or procedures to a certified dental assistant or to a dental hygienist, who has taken and successfully completed the specific module concerned, if he is satisfied, from his personal knowledge, that the certified dental assistant or dental hygienist, as the case may be, is properly trained and licensed to perform the delegated duties or procedures but only under the personal supervision of a member: (

a) instructing in the placement and care of removable orthodontic appliances; (

b) tying-in arch wires that a dentist has fitted; (

c) removing orthodontic arch wire; (

d) removing excess cement or bonding material by means of hand instruments or ultrasonic hand instruments following banding/bonding and debandingidebonding procedures; (

e) fitting orthodontic bands prior to assessment by a member; (0 taking impressions for the fabrication of orthodontic appliances; (

g) fitting space maintainers prior to assessment by a member; (

h) removing orthodontic bands and bonded attachments by means of hand instruments; preparing teeth for direct bonding of attachments; (

j) applying wax or other material to offending components or removing offending components;

(

k) placing and removing orthodontic separators; (

I) fitting headgear prior to assessment by a member; and (

m) these duties within the Prosthodontic Module: (

i) fabricating provisional restorations intraorally; (ii) trying-in provisional restorations and adjusting occlusion outside of the mouth; (iii) removing provisional cement; (iv) removing provisional restorations; (

v) temporary cementation of provisional restorations prior to assessment by a member. 10.20 Delegation of duties to a dental hygienist. A duly licensed member may delegate the following duties or procedures to a dental hygienist if he is satisfied, from his personal knowledge, that the dental hygienist is properly trained and licensed to perform the delegated duties or procedures but only under the direction of a duly licensed member: (

a) those duties and procedures which a certified dental assistant may perform under

Article 10.17; (

b) examining the head and neck as it pertains to dentistry; (

c) examining the infra-oral structures; (

d) placing and removing temporary restorations; (

e) applying periodontal dressings; removing supra and subgingival calculus; (

g) root planing; (

h) recontouring existing restorations; (

i) desensitizing hypersensitive teeth; administering local anesthetics but only after the completion of approved training to the satisfaction of the general examination committee, and only while a duly licensed member is present and immediately available in the office; and (

k) other procedures that the general examination committee may authorize while the dental hygienist is participating in courses of study and training approved by the general examination committee and subject to the requirements of that committee with respect thereto. 10.21 Changes in duties and procedures. Council, by resolution, may add to or delete from the lists of duties and procedures which may be delegated as set forth in this

Article 10. 10.22 Ultimate responsibility. No member may delegate duties or procedures except to a person who is qualified by training and by licensure to perform them and except in accordance with these Rules. Each member must comply with this Rule strictly and in utmost good faith. The ultimate responsibility for the proper delegation of duties or procedures and for the standard of treatment performed by a dental assistant, certified dental assistant, or dental hygienist, as the case may be, lies with the member under whose personal supervision or direction the treatment is performed.

PROPOSED AMENDMENT

ARTICLE 12 - DENTAL TECHNICIANS AND DENTURISTS 12.01 Dental technicians. Subject to the Act and the Rules, a duly licensed member may direct a dental technician who is a member of the College of Dental Technicians of British Columbia to provide services authorized by the Dental Technicians' Regulation under the Health Professions Act and the Bylaws of the College of Dental Technicians of British Columbia. A member using the services of such dental technician must: (

a) be satisfied from their own personal knowledge that such dental technician is a registered member in good standing of the College of Dental Technicians of British Columbia; (

b) be satisfied from their own personal knowledge that such dental technician is permitted to perform the services pursuant to the Dental Technicians' Regulation under the Health Professions Act and the Bylaws of the College of Dental Technicians of British Columbia; and (

c) give such dental technician a signed, written prescription in respect of such services. 12.01A Persons other than members of the College of Dental Technicians. Subject to the Act and the Rules, a duly licensed member may direct a person other than a registered member of good standing of the College of Dental Technicians of British Columbia to perform services authorized by the Dental Technicians' Regulation under the Health Professions Act where such person is a person described in

Section 5(2) or 5(3) of the Dental Technicians' Regulation under the Health Professions Act. 12.02 Denturists. Subject to the Act and the Rules, a duly licensed member may authorize a denturist to carry out such non-surgical intraoral procedures, as the denturist is permitted to carry out pursuant to the Denturists Regulation under the Health Protection Act and the Bylaws of the College of Denturists of British Columbia. A member using the services of a denturist must: (

a) be satisfied from their own personal knowledge that the denturist is a registered member in good standing of the College of Denturists of British Columbia; (

b) be satisfied from their own personal knowledge that the denturist is permitted to perform the authorized services pursuant to the Denturists Regulation under the Health Protection Act and the Bylaws of the College of Denturists of British Columbia; and (

c) give the denturist a signed, written prescription in respect of such services. 12.03 Removable dental prostheses A member who takes impressions, extracts teeth, or performs other professional services preparatory or incidental to the insertion of a removable dental prosthesis must strongly advise the patient and must use all possible efforts to ensure that the requirements set forth in this

article are complied with, and must not directly or indirectly in any way condone any breach of such requirements. In addition to the other requirements of this Article, the duly licensed member: (

a) must ensure that the removable dental prosthesis is fitted by a duly licensed member or by a denturist pursuant to the terms of a written prescription provided by a duly licensed member, and (

b) shall be responsible for the preparation of the hard and soft oral tissues, the design of the removable dental prosthesis, the passive and dynamic fit of the removable dental prosthesis and the integrity of the hard and soft oral tissues.

ARTICLE 12 REVISION, DECEMBER 2000, WITHOUT STRIKEOUTS

PROPOSED AMENDMENT

ARTICLE 15 - PROMOTIONAL ACTIVITIES 15.01

Interpretation. In this

Article (a) "Promotional Activity" means the dissemination of information or the distribution of products and materials by any method and in any form by, or on behalf of, a registrant that may reasonably be regarded as having as its purpose, directly or indirectly, wholly or in part: (

i) the enhancement of the reputation, or the profitability of the practice, or both, of a registrant; (ii) the enhancement of the profitability of a commercial venture with which a registrant is identified or from which the registrant derives a benefit; or (iii) both (

i) and (ii) above. (b) "Registrant" includes a member, a person registered under the Rules and a dental corporation registered under the Dentists 9ct and the Rules. 15.02 Limitations on promotional activities. No registrant will authorize or engage in promotional activity that: (

a) is false; (

b) contains material inaccuracies; (

c) omits relevant content; (

d) is reasonably capable of deceiving or misleading a member of the public; (

e) is reasonably capable of confusing a member of the public; (1) exploits or takes advantage of: (

i) the physical or emotional states, or (ii) the lack of knowledge of dental subject matters, of members of the public; (

g) contains claims or assertions the legitimacy of which cannot be verified by a member of the public acting as a reasonable consumer of dental health care services; or (

h) tends to undermine the professionalism, ethics, integrity or dignity of the dental profession or otherwise brings the dental profession into disrepute. 15.03 Guidelines. Council may publish guidelines for the assistance of registrants wishing to authorize or engage in promotional activity that complies with the requirements of this Article.

2 15.04 Trade names. A registrant who uses a trade name that is not otherwise prohibited under this

Article is exempted from the prohibitions found in

Section 73 of the Dentists Act. 15.05 Academic degrees. Members may, in promotional activities, refer only to academic and professional degrees earned through accredited university programs, or fellowships, memberships and diplomas earned by examination. Members may not refer to the university at which the degree, fellowship, membership or diploma was earned. In communications with the public, members may not refer to earned qualifications and memberships in dental associations granted without examination. 15.06 Certified specialists.

Certified specialists, in promotional activities, must use the terminology "Certified Specialist in [a recognized specialty branch in dentistry]". 15.07 Practice limitations. A dentist registered before January I. 1992, vvho limits the member's dental practice to only one specialty of dentistry must use "practice limited to [a recognized specialty branch of dentistry in promotional activities]".

A general dentist who is registered after January 1, 1992, and who limits the member's dental practice to only one specialty of dentistry, must use "general practitioner, practice limited to [a recognized specialty]". 15.08 Listing of services. A member may list services that the member provides in accordance with the terminology used in the Association of Dental Surgeons of BC fee guide. A member must preface the list of services with either "general practitioner providing services in .." or "certified specialist providing services in...".

PROPOSED AMENDMENT

ARTICLE 17 - MANDATORY CONTINUING EDUCATION 17.01

Preamble. The dental profession, as a self-governing body, is ultimately responsible for the quality of dentistry that is provided to the public. Lifelong learning is a fundamental responsibility of the professional person. The exponential rate of technological change through research, innovations in patterns of health care delivery, new clinical procedures, and an increasing social awareness have accentuated the need for each registrant to remain abreast of professional developments.

The College, in order to formalize its commitment to these principles, has established continuing education requirements for the re-licensure of registrants to complement the necessary professional reading and consultations related to every day practice. ' 17.02 Objectives. The College's objectives are to: (

a) encourage registrants to maintain their professional knowledge; and (

b) try to ensure that an adequate number of continuing education opportunities are available, with an emphasis on making these opportunities accessible and relevant to local needs. 17.03 Credit requirements. Registered members are required to obtain a minimum of 90 credit hours of continuing education during three-year cycles. Registered certified dental assistants are required to obtain a minimum of 36 credit hours of continuing education during three-year cycles. 17.04 Courses.

Courses or their educational equivalents must have significant intellectual or practical content, directly related to the practice of dentistry or certified dental assisting, as the case may be, or to the professional responsibility or ethical obligations of the participant. For licensed specialists at least 50% of the requirement of 90 hours during each three-year cycle must be acquired through programs pertaining to the specialty in which the specialist is certified. 17.05 Failure to comply with continuing education requirements. If a registrant fails to comply with the requirements of

Article 17.06 then such registered person will cease to be registered except if the Council otherwise directs. 17.06 Quality assurance committee. Council will appoint from time to time a quality assurance committee and a chairman thereof, both to hold office at Council's pleasure. The quality assurance committee will, from time to time: (

a) determine when each three-year cycle begins; (

b) determine the maximum number of hours in each 24 hour period which may be credited toward continuing education; (

c) determine how each registrant will report to the College on, and verify the number of continuing education hours engaged in, by that registrant; (

d) approve continuing education courses, or their equivalents, and their sponsors; (

e) determine the maximum number of credit hours that may be claimed in respect of any particular continuing education course or equivalent; (0 impose such other requirements concerning continuing education as it considers reasonable and necessary; (

g) review and make recommendations to Council concerning guidelines for continuing education requirements; (

determine credit valuations of those courses which do not readily fit into an existing area of the then current requirements for continuing education; guide the office administration relating to continuing education requirements; encourage the appropriate sponsoring agencies to offer a sufficient number and variety of continuing education courses to enable registrants to meet College requirements; encourage registrants to meet continuing education requirements; investigate and review registrants who fail to meet their requirements and report thereon to Council.

PROPOSED AMENDMENT

ARTICLE 18 — COMMITTEES 18.01 Appointment. Council hereby appoints the following committees to act as standing advisory committees: (

a) Accreditation Committee; (

b) Certified Dental Assistant Examination Committee; (

c) Communications Committee; (

d) Ethics Committee; (

e) Finance Committee; (

f) Fines Disposition Committee; (

g) Inquiry Committee; (

h) Legislation Committee; (

i) Nominations Committee; (

j) Quality Assurance Committee; (

k) Recognition and Awards Committee; (

I) Registration Committee; and (

m) Review Committee; Council may appoint such other committees as Council, by resolution, deems necessary from time to time.
