B.C. Reg. 265/2003, deposited June 27, 2003, pursuant to the WILDLIFE ACT [Section 108 (2) and (3)]. Regulation of the Minister of Water, Land and Air Protection M304/2003, dated June 26, 2003.

I, Joyce Murray, Minister of Water, Land and Air Protection, order that the Closed Areas Regulation, B.C. Reg. 76/84, is amended in

Schedule 5

(

a) by repealing

section 77 and substituting the following:

Fording Coal Limited Coal Mountain Mine

77 That portion of the Province of British Columbia in Kootenay District that is contained within the following described boundaries:

Commencing at the southwestern corner of the boundary where Nivan Creek passes under the Flathead Road; thence proceeding north along the eastern side of the Flathead Road to the Corbin Road; thence northwesterly along the north side of Corbin Road to the railroad crossing; thence due north to the gas line right of way; thence southeasterly along the gas line right of way to the intersection of the gas pipeline right of way with the height of land on Middle Mountain; thence due east to the mine clearing/exploration road; thence easterly along the exploration road for a distance of 1300 m; thence proceeding southerly to the height of land on Middle Mountain; thence easterly along the height of land to the eastern boundary of District Lot 7292; thence due south approximately 1.5 km east of the Corbin valley bottom for 4500 m to the southeast corner of District Lot 7294; thence due west along the southerly boundaries of district Lots 7294 and 6295 to the height of land on Coal Mountain; thence northerly to Nivan Creek; thence easterly on the south side of Niven Creek to the point of commencement. , and

b) in

section 131 by striking out "interceptor ditch access road to the end of the ditch" and substituting "cut line to the end". — J. MURRAY , Minister of Water, Land and Air Protection.
