An Act to Amend the Ambulance Services Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 Subsection 4(1) of the Ambulance Services Act,

chapter A-7.3 of the Acts of New Brunswick, 1990, is re- pealed and the following is substituted: 4(1) The Minister may appoint an Ambulance Services Advisory Committee to conduct the following: (

a) advise the Minister on matters relating to ambu- lance services that the Minister refers to the Committee for its consideration or that the Committee considers appropriate, and (

b) bring before the government and the public, mat- ters of interest and concern to the Committee. 2 Subsection 4(2) of the Act is amended (

a) in paragraph (

b) by striking out “New Bruns- wick Ambulance Operators Association” and substi- tuting “Paramedic Association of New Brunswick”; PROJET DE LOI 44 Loi modifiant la

a) de le conseiller sur les questions relatives aux ser- vices d’ambulance dont il a saisi le Comité ou que celui-ci juge pertinentes;

b) de porter à l’attention du gouvernement et du pu- blic des questions qui intéressent et préoccupent le Co- mité. 2 Le paragraphe 4(2) de la Loi est modifié

a) à l’alinéa b) par la suppression de « l’Association des opérateurs ambulanciers du Nouveau- Brunswick » et son remplacement par « l’Association des travailleurs paramédicaux du Nouveau- Brunswick »;

d) by striking out “New Bruns- wick Hospital Association” and substituting “Para- medics Union CUPE 4848”; (

c) in paragraph (

h) by striking out “and” at the end of the paragraph; (

d) in paragraph (

i) by striking out the period at the end of the paragraph and substituting a comma fol- lowed by “and”; (

e) by adding after paragraph (

i) the following: (

j) a person appointed at the discretion of the Minis- ter. 3 The Act is amended by adding after subsection 4(2) the following: 4(3) The Ambulance Services Advisory Committee, in carrying out its duties, may (

a) undertake research on matters relevant to ambu- lance services, certifications, regulations, complaints, billing, and the role of stakeholders in the ambulance services, (

b) receive and hear petitions and suggestions from individuals and groups from both official language communities concerning matters relevant to ambulance services, (

c) establish committees consisting of members of the Ambulance Services Advisory Committee and other persons who are not members to assist and advise the Committee, (

d) make referrals and proposals to, and consult and collaborate with, government agencies, voluntary asso- ciations, private businesses, universities and individu- als with respect to matters relevant to ambulance ser- vices, including without limiting the generality of the foregoing: (

i) research areas that may be studied; (ii) programs that may be developed or modified; and (iii) legislation, policies and practices that may be adopted, and

j) une personne nommée à l’appréciation du Minis- tre. 3 La Loi est modifiée par l’adjonction de ce qui suit après le paragraphe 4(2) : 4(3) Dans l’exercice de ses attributions, le Comité con- sultatif des services d’ambulance peut :

a) faire de la recherche sur des questions qui touchent les services d’ambulance, la certification, la réglemen- tation, les plaintes, la facturation et le rôle des parties intéressées dans les services d’ambulance;

b) recevoir et entendre des pétitions et suggestions de particuliers ou de groupes des deux communautés lin- guistiques officielles concernant des questions qui tou- chent les services d’ambulance;

c) créer des comités composés de membres du Co- mité consultatif sur les services d’ambulance et d’autres personnes qui ne sont pas membres, chargés d’aider et de conseiller le Comité;

d) renvoyer des questions qui touchent les services d’ambulance à des organismes gouvernementaux, à des associations de bénévoles, à des entreprises privées, à des universités et à des particuliers et leur faire des pro- positions, les consulter et collaborer avec eux sur ces questions, dont notamment : (

i) les domaines possibles de recherche, (ii) les programmes à élaborer ou à modifier, (iii) les mesures législatives, les lignes directrices et les méthodes à adopter;

e) prepare from time to time such reports, studies and recommendations as the Ambulance Services Ad- visory Committee considers necessary. 4(4) Each year, on or before July 31, the Ambulance Services Advisory Committee shall submit to the Minister an estimate of the money required for the operation of the Ambulance Services Advisory Committee during the next fiscal year. 4(5) The accounts of the Ambulance Services Advisory Committee shall be audited each year by the Auditor Gen- eral and his or her report shall be included in the annual report of the Ambulance Services Advisory Committee. 4(6) Before the commencement of each fiscal year, the Ambulance Services Advisory Committee shall submit to the Minister for approval a work plan setting out the man- ner in which the Ambulance Services Advisory Commit- tee intends to carry out its duties during the fiscal year. 4(7) The Ambulance Services Advisory Committee may amend a work plan at any time during the fiscal year and shall submit the amended work plan to the Minister for approval. 4(8) The Ambulance Services Advisory Committee shall within 3 months after the end of each fiscal year sub- mit to the Minister an annual report that shall contain (

a) a report of all meetings conducted by the Ambu- lance Services Advisory Committee during the year, (

b) a report of the findings, conclusions and recom- mendations referred or made by the Ambulance Ser- vices Advisory Committee to the Minister during the year, (

c) a report of the progress of the Ambulance Ser- vices Advisory Committee in relation to the implemen- tation of the work plan referred to in subsection (6) or, if an amended work plan has been approved by the Minister under subsection (7), in relation to the imple- mentation of the most recent amended work plan ap- proved by him or her, and (

d) the report of the Auditor General referred to in subsection (5). 4(9) The Minister shall lay the annual report before the Legislative Assembly if it is then sitting, or, if the Legis- lative Assembly is not then sitting, with the Clerk of the Legislative Assembly.

e) dresser les rapports, réaliser les études et faire les recommandations qu’il juge nécessaires. 4(4) Au plus tard le 31 juillet de chaque année, le Co- mité consultatif sur les services d’ambulance présente au Ministre une estimation des crédits nécessaires à son fonctionnement pour le prochain exercice. 4(5) Le vérificateur général vérifie chaque année les comptes du Comité consultatif sur les services d’ambu- lance, et son rapport est incorporé au rapport annuel du Comité. 4(6) Avant le début de chaque exercice, le Comité con- sultatif sur les services d’ambulance soumet à l’approba- tion du Ministre un plan de travail exposant la manière dont il entend exercer ses attributions durant l’exercice. 4(7) Le Comité consultatif sur les services d’ambulance peut modifier le plan de travail à tout moment durant l’exercice, auquel cas il soumet le plan de travail modifié à l’approbation du Ministre. 4(8) Dans les trois mois qui suivent la fin de chaque exercice, le Comité consultatif sur les services d’ambu- lance présente au Ministre un rapport annuel contenant :

a) un compte rendu de toutes les réunions qu’il a te- nues au cours de l’exercice;

b) un compte rendu des constatations, conclusions et recommandations qu’il a adressées au Ministre au cours de l’exercice;

c) un rapport d’étape sur la mise en œuvre du plan de travail visé au paragraphe (6) ou, le cas échéant, du der- nier plan de travail modifié que le Ministre a approuvé en vertu du paragraphe (7);

d) le rapport du vérificateur général visé au paragraphe (5). 4(9) Le Ministre dépose le rapport annuel à l’Assemblée législative si elle siège, ou, sinon, auprès du greffier de l’Assemblée législative.

Loi sur les services d’ambulance 4(10) The Ambulance Services Advisory Committee may, subject to budgetary constraints, employ or engage such persons as it considers necessary to carry out the pur- poses of this Act. 4(11) The Ambulance Services Advisory Committee may hold its meetings at any place in the Province. 4(12) The Ambulance Services Advisory Committee shall meet at least 4 times in each year at such times and places designated by the Chair or otherwise determined in accordance with the by-laws of the Ambulance Services Advisory Committee. 4(13) Subject to the approval of the Lieutenant- Governor in Council, the Ambulance Services Advisory Committee may make by-laws for its internal manage- ment. 4 This Act comes into force on a day to be fixed by proclamation. 4(10) Le Comité consultatif sur les services d’ambu- lance peut, dans les limites de son budget, employer ou engager les personnes qu’il estime nécessaires pour réali- ser les objets de la présente loi. 4(11) Le Comité consultatif sur les services d’ambu- lance peut tenir ses réunions en tout lieu dans la province. 4(12) Le Comité consultatif sur les services d’ambu- lance se réunit au moins quatre fois par année aux dates, heures et lieux fixés par son président ou ses règlements administratifs. 4(13)

Sous réserve de l’approbation du lieutenant-gou- verneur en conseil, le Comité consultatif sur les services d’ambulance peut prendre des règlements administratifs relatifs à sa régie interne. 4 La présente loi entre en vigueur à la date fixée par proclamation.
