WHEREAS by Order in Council OC2006-296 dated July 20, 2006, the Lieutenant Governor in Council authorized the following Terms of Reference for a review to be undertaken by the Honourable J. Derek Green, Chief Justice of the Supreme Court of Newfoundland and Labrador (Trial Division): This issue does not contain any Subordinate Legislation

THE NEWFOUNDLAND AND LABRADOR August 4, 2006 332 1. Chief Justice Green is authorized to undertake an independent review and ev aluation of the policies and procedures regarding compensation a nd constituency allowances for Members of the House of Assembly that includes:

i) An assessment of Members of the House of Assembly (M HA) Constituency Allowances to determine if they are the most effective and efficient vehicle to reimburse MHAs for expenses incurred during the normal execution of their duties; ii) A comparison of all components of compensation of members of the legislature in Newfoundland and Labrador, including but not limited to indemnities, allowances and pensions, with that in other provincial and territorial legislatures in Canada; iii) An evaluation of best practices for compensation of members of legislatures in other provinces and territories; and iv) A determination of whether proper safeguards are in pl ace to ensure accountability and compliance with all rules and guidelines governing payments of all aspect s of MHA compensation and Constituency Allowances; 2.

The Chief Justice is authorized to undertake an independe nt review and evaluation of the policies and procedures for control of the types of expenditures reviewed by the Aud itor General in his report, “Pay ments Made by the House of Assembly to Certain Suppliers;” 3. A matter that is necessarily incidental to a matt er specified above may be included in the review and evaluation by the Chief Justice; 4. The Chief Justice is authorized to develop recommendati ons on policies and practices resulting from the review and evaluation as outlined above.

Additionally, the Chief Justic e is authorized to bring forward recommendations that would ensure the accountability and compliance practices employed in the House of Assembly meet or exceed the best in the country. Such recommendations must take into account opportunities to enhance the accountability and transparency of MHA expenditures without undermining th e autonomy of the legislature and its elected members; 5.

All Ministers and Officials of th e Government of Newfoundland and Labrador , and its agencies, are to provide the Chief Justice with their comp lete and unreserved cooperation in all aspects of this review; 6. Recommendations should be brought forward for the consid eration of Cabinet as soon as reasonably possible, to enable the House to address any pot ential legislative and administrative changes in its Fall 2006 session; and 7.

The Department of Justice and the Public Service S ecretariat, in collaboration with Executive Council and the Department of Finance, are directed to take the necessary actions to provide Chief Justice Green with the necessary resources to undertake this review e xpeditiously with such resources to incl ude a part-time legal counsel, a part-time accountant, a part-time advisor from Me morial University, an individual to provide administrative and research support, a policy advisor and an actuary.

WHEREAS subsection 2(1) of the “Public Inquiries Act” provides as follows: Where the Lieutenant-Governor in Council considers it expedient to make an in quiry into a matter connected with the peace, order and good government of this province, or the conduct of a part of the public business, or the administration of justice, or into the industries of th is province, or into other matters which he or she considers to be for the public good, the Lieutenant-Governor in C ouncil may by Commission under the Great Seal appoint the person or persons, called the commissioner or commissioners, that he or she may select to hold the inquiry.

NOW THEREFORE by Order in Council OC2006-297 dated July 20 , 2006, by Commission under the Great Seal and under the authority of the “ Public Inquiries Act ,” the Lieutenant Governor in Council a ppoints the Honourable J. Derek Green, Chief Justice of the Supreme Court of Newfoundland and Labrador (Trial Division), a Commissioner. AND

BE IT ORDERED that the scope of the Commissioner’s inquiry will be to summon a witness or witnesses, and to require the witness or witnesses to give evidence orally or in writin g upon oath or affirmation, and to produce the documents and thing s that may be considered necessary within the Terms of Refere nce identified in OC2006-296 in the limited circumstance where the Chief Justice is unable to obtai n the full cooperation of an individual or indivi duals during the conduct of his review separat ely ordered by OC2006-296 (reproduced above). F) Zone to the Rural (

R) Zone. In general terms, the purpose of the St. John’s Development Regulations Amendment Number 366, 2006 is to make provision in the Development Regulations for the regulation of float plane hangar lots. St. John’s Municipal Plan Amendment No. 19, 2005 and St. John’s Development Regul ations Amendment Numbers 340, 2005 and 366, 2006 are in reference to an application from the Land Management Divi sion of the Department of Environment and Conservation to rezone land on the southern shore of Paddy’s Pond, Trans Canada Highway, to permit the development of additional float plan hangar lots.
