Regulation (AR 165/2011) is amended by this Regulation.

Franchises Act

FRANCHISES ACT EXEMPTION

(2016) AMENDMENT REGULATION

on October 31, 2016 pursuant to

section 6(1) of the Franchises Act.

1 The Franchises Act Exemption Regulation (AR 312/2000)

is amended by this Regulation.

Section 1 is amended by striking out "and" at the end of

clause (a), by adding "and" at the end of clause (

b) and by

adding the following after clause (b):

(

c) if neither the franchisor (including any person who is

included in that term) nor any of its associates, directors,

general partners or officers has had any conviction,

judgment, order or award made against that person in Canada

in the 5 years immediately preceding the date of the

disclosure document, relating to

(

i) fraud,

(ii) unfair or deceptive business practices, or

(iii) the Act or any equivalent statute of any other

jurisdiction in Canada specifically regulating the

subject-matter of franchises.

Section 3 is repealed.

Gas Utilities Act

NATURAL GAS BILLING AMENDMENT REGULATION

section 28.1 of the Gas Utilities Act.

1 The Natural Gas Billing Regulation (AR 185/2003) is

amended by this Regulation.

Section 1(1) is amended by adding the following after

clause (c);

(c.1) "carbon levy" means the carbon levy a gas distributor must

remit to the Minister under

section 8 of the Climate

Leadership Implementation Act;

Section 4 is amended

(

a) by repealing clause (a)(iv) and substituting the

following:

(iv) the franchise fee paid or payable by the retailer to the

gas distributor for the account of the customer, and the

name of the municipality that will receive the fee;

(

v) under the heading "Carbon Levy" the amount remitted

to the gas distributor for the account of the customer for

the carbon levy, in dollars.

(

b) by repealing clause (

b) and substituting the

following:

(

b) specify the customer's consumption of gas on which the

charge in clauses (a)(

i) and (

v) are based;

Section 11 is repealed.

5 This Regulation comes into force on January 1, 2017.

Gas Utilities Act

DEFAULT GAS SUPPLY AMENDMENT REGULATION

November 28, 2016 pursuant to

section 28.1 of the Gas Utilities Act.

1 The Default Gas Supply Regulation (AR 184/2003) is

amended by this Regulation.

Section 1 is amended by adding the following after

clause (a);

(a.1) "carbon levy" means the carbon levy a gas distributor must

remit to the Minister under

section 8 of the Climate

Leadership Implementation Act;

Section 9 is amended

(

a) by adding the following after clause (a):

(a.1) under the heading "Carbon Levy" the amount remitted

to the gas distributor for the carbon levy, in dollars.

(

b) by repealing clause (

b) and substituting the

following:

(

b) the customer's consumption of natural gas on which the

charges in clauses (

a) and (a.1) are based;

(

c) in clause (

f) by adding ", and the name of the

municipalities that will receive the fee" after "applicable".

Section 10 is repealed.
