An Act to Amend the Elections Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Elections Act,

chapter E-3 of the Revised Statutes, 1973, is repealed and the following is substituted: 13(1) Every election shall be commenced by an order of the Lieutenant-Governor in Council. 13(2) Nothing in this

section affects the powers of the Lieutenant-Governor to dissolve the Legislative Assem- bly, by proclamation in Her Majesty’s name, when the Lieutenant-Governor sees fit. 13(3) Subject to the powers of the Lieutenant-Governor referred to in subsection (2), (

a) a general election shall be held on Monday, Octo- ber 18, 2010, and, thereafter, (

b) general elections shall be held on the third Mon- day in October in the fourth calendar year following polling day in the most recent general election. 13(4) An Order in Council referred to in subsection (1) shall (

a) direct the issue of a writ of election for each elec- toral district in which an election is to take place, PROJET DE LOI Loi modifiant la Loi électorale Sa Majesté, sur l’avis et du consentement de l’Assem- blée législative du Nouveau-Brunswick, décrète : 1 L’article de la Loi électorale,

article n’a aucune incidence sur le pou- voir du lieutenant-gouverneur de dissoudre l’Assemblée législative par proclamation prise au nom de Sa Majesté, lorsqu’il le juge opportun. 13(3)

Sous réserve du pouvoir du lieutenant-gouverneur visé au paragraphe (2),

a) une élection générale aura lieu le lundi octobre et, par la suite,

b) des élections générales auront lieu le troisième lundi d’octobre de la quatrième année civile qui suit le jour du scrutin de la dernière élection générale. 13(4) Le décret en conseil visé au paragraphe (1) doit :

a) prescrire l’émission d’un bref d’élection pour cha- que circonscription électorale où une élection doit avoir lieu, 2 Projet de loi Loi modifiant la Loi électorale (

b) fix the date on which the writs shall be issued and the date on which they shall be returnable in accor- dance with subsection (3), and (

c) fix the date for the nomination of candidates, which shall be not more than twenty-one days nor less than eleven days after the date of the writs.

b) fixer la date d’émission des brefs d’élection ainsi que la date à laquelle ils doivent être rapportés confor- mément au paragraphe (3), et

c) fixer la date du jour de la déclaration des candida- tures, qui doit être au plus tard vingt et un jours et au plus tôt onze jours après l’émission des brefs.
