“archaeological field research” means any activity car- ried out on, above or under land or water for the purpose of obtaining and documenting data or recovering archaeo- logical objects, burial objects or human remains or any other evidence of past human use or activities, and in- cludes monitoring, assessing, exploring, surveying, recov- ering and excavating. (travaux archéologiques sur le ter- rain) “archaeological object” means an object which shows evidence of manufacture, alteration or use by humans that may provide information about past human activities and which meets any criteria set by regulation, and includes a sample collected from that object. (objet archéologique) “archaeological site” means a place in the Province where evidence of past human activities, such as archaeo- logical objects and features, is discovered on, buried or partially buried beneath the land, or submerged or partially submerged beneath the surface of a watercourse or per- manent body of water. (site archéologique) “burial ground” means a place that has been used for the placement of human remains or burial objects, but does not include a cemetery regulated under the Cemetery Com- panies Act. (lieu de sépulture) “burial object” means an object that is directly associ- ated with the interment of a human, but does not include human remains. (objet de sépulture) “council” means a council as defined in the Municipal- ities Act. (conseil) “court” means The Court of Queen’s Bench of New Brunswick, and includes any judge of that court. (cour) “First Nation” means an aboriginal people sharing a common traditional territory and having a common tradi- tional language, culture and lands. (Première nation) “human remains” means the skeletal, cremated or any other traces of human bodies. (restes humains) “Minister” means the Minister of Wellness, Culture and Sport. (ministre) “municipality” means a municipality as defined in the Municipalities Act. Conflict Incompatibilité 4(1) If, with respect to a matter affecting the conserva- tion of a heritage place or heritage object, there is a conflict between a provision of this Act or the regulations and a provision of another Act or regulation, the provision of this Act or the regulations prevails. 4(1) S’agissant d’une question touchant la conservation d’un lieu ou d’un objet du patrimoine, en cas d’incompa- tibilité entre la présente loi ou son règlement d’application et une autre loi ou un règlement, la présente loi ou son règlement d’application l’emporte. 4(2) If there is a conflict between an order of the Min- ister designating a provincial heritage place and a by-law made by a municipality under this Act or another Act, the order prevails to the extent of the conflict, but in all other respects the by-law remains in full force and effect. 4(2) Les dispositions incompatibles d’un arrêté minis- tériel désignant un endroit lieu du patrimoine provincial l’emportent sur les dispositions incompatibles d’un arrêté municipal pris en vertu de la présente loi ou de toute autre loi.

HERITAGE OBJECTS OBJETS DU PATRIMOINE Property in archaeological, palaeontological or burial objects Propriété des objets archéologiques ou paléontologiques ou des objets de sépulture 5(1) The property in, and the title and right of possession to, an archaeological object, palaeontological object or burial object discovered in the Province after the com- mencement of this

section is and vests in the Crown. 5(1) La propriété et le droit de possession des objets ar- chéologiques ou paléontologiques ou des objets de sépul- ture découverts dans la province après l’entrée en vigueur du présente article, tout comme le

titre dans ceux-ci, ap- partiennent à la Couronne et lui sont dévolus. 5(2) The Minister may require a person in possession of an archaeological object, palaeontological object or burial object discovered in the Province after the commencement of this
