Section 10 of the Electricity Act,

chapter E-4.6 of the Acts of New Brunswick, 2003, is amended 1 L’article 10 de la

(projet) “out of service period” means the period of time begin- ning when the Point Lepreau nuclear generating station is out of service due to the project until such time that the station returns to normal service. (project) 143.1(2) The Nuclear Corporation shall establish and maintain the accounts, books and records that are neces- sary to record the following non-capital costs and expenses incurred by the Nuclear Corporation in relation to the pro- ject during the out of service period, notwithstanding that the Point Lepreau nuclear generating station is out of ser- vice: 143.1(2) La Corporation d’énergie nucléaire doit, pen- dant la période d’interruption de service, établir et main- tenir les comptes, les livres et les dossiers nécessaires à l’inscription de ses coûts et de ses dépenses liés au projet, autres que ceux en capital, au

a) costs and expenses related to the supply of addi- tional electricity to the Distribution Corporation to be sold by the Distribution Corporation to its customers within the Province; and

143.1(11) For the purposes of an application to the Board for approval of a change in charges, rates or tolls for its services, the Distribution Corporation shall present its revenue requirements to the Board in such a manner that the costs and expenses associated with the project are shown separately from the other revenue requirements of the Distribution Corporation. 143.1(11) Aux fins d’une demande à la Commission en vue d’obtenir l’approbation d’un changement aux frais, taux et droits pour ses services, la Corporation de distri- bution doit présenter ses besoins en revenus pour les coûts et les dépenses liés au projet de manière séparée de ses autres besoins en revenus. 8

Section 149 of the Act is amended 8

a) by adding after paragraph (1)(

section 37, including making any provision of the Income Tax Act (Canada) and the New Brunswick Income Tax Act, with or without modifications, applicable to the Cor- poration or the subsidiary of the Corporation for the purposes of calculating the payment; d.1) concernant les paiements par la Corporation ou une de ses filiales et qui sont prévus par l’article 37, et rendant toute disposition de la Loi de l’impôt sur le re- venu (Canada) ou toute disposition de la Loi de l’impôt sur le revenu du Nouveau-Brunswick applicable à la Corporation ou à l’une de ses filiales, et ce avec ou sans adaptations, pour les fins du calcul de ces paiements; (

EXPLANATORY NOTES NOTES EXPLICATIVES

Section 1

Article 1 (

a) The existing provision is as follows:

a) Texte de la disposition actuelle : 10(1) The Corporation shall, within 6 months after the termination of its fiscal year, submit to the Minister an audited report, in such form as the Minister may direct, on the operations of the Corporation and the subsidiaries of the Corporation for that fiscal year and the Minister shall table the report in the Legislative Assembly if it is then sitting or, if it is not then sitting, when it next sits. 10(1) Dans un délai de six mois après la fin de son exercice financier, la Corporation soumet au Ministre un état vérifié en la forme que ce dernier exige et qui porte sur les activités de la Corporation et des filiales de la Corporation au cours de cet exercice financier.

Le Ministre doit déposer ce rapport à l’Assemblée législative si elle est en session, sinon le rapport est déposé à la session suivante. (
