An Act to Amend the Workers’ Compensation Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 1 of the Workers’ Compensation Act,

chapter W-13 of the Revised Statutes, 1973, is amended (

a) by repealing the definition “member of a munic- ipal volunteer fire brigade” and substituting the fol- lowing: “member of a fire brigade” means a person who is available on a full time, part time or casual basis, with or without remuneration, including a volunteer, to respond as needed to fire or emergency calls and whose membership in the fire brigade has been approved by the chief of the fire department of a municipal corporation, rural commu- nity, local service district, commission, committee, body or other local authority; (

b) in the definition “worker” by repealing para- graph (

b) and substituting the following: (

a) par l’abrogation de la définition « membre d’un corps municipal de pompiers volontaires » et son rem- placement par ce qui suit : « membre d’un corps de pompiers » désigne une per- sonne qui fait du travail à temps plein, à temps partiel ou temporaire, avec ou sans rémunération, incluant un volon- taire, pour répondre au besoin aux appels d’incendie ou aux appels d’urgence et dont la qualité de membre a été approuvée par le chef du service d’incendie d’une corpo- ration municipale, d’une communauté rurale, d’un district de services locaux, d’une commission, d’un comité ou autre organisme de municipalité, ou d’un autre pouvoir lo- cal;

b) par l’abrogation du l’alinéa b) à la définition de « travailleur » et son remplacement par ce qui suit :

section 7: 7.1(1) In this section, “full-time firefighter” means a full-time member of a fire brigade; “part-time firefighter” means a casual, volunteer or part-time member of a fire brigade. 7.1(2) If a worker who is or has been a full-time fire- fighter or part-time firefighter suffers an injury that is (

a) a primary site brain cancer; (

b) a primary site bladder cancer; (

c) a primary site kidney cancer; (

d) a primary non-Hodgkin’s lymphoma; (

e) a primary leukemia; (

f) a primary site colorectal cancer; (

g) a primary site ureter cancer; or (

h) a primary site lung cancer; the injury must be presumed to be an occupational disease the dominant cause of which is the employment as a fire- fighter, unless the contrary is proven. 7.1(3) The presumption in subsection (2) applies to a worker (

a) who has been employed as a full-time firefighter or part-time firefighter for a minimum period pre- scribed by the Lieutenant-Governor in Council by reg- ulation; and (

c) un cancer primitif du rein;

d) un lymphome primitif non hodgkinien;

e) une leucémie primitive;

f) un cancer primitif du côlon et du rectum;

g) un cancer primitif de l’uretère;

h) un cancer primitif du poumon. 7.1(3) La présomption prévue au paragraphe (2) s’appli- que aux ouvriers :

a) qui ont été employés à

titre de pompiers à temps plein ou à temps partiel pendant la période minimale fixée par règlement par le lieutenant-gouverneur en conseil;

b) qui ont été régulièrement exposés, pendant toute cette période, aux dangers existant sur les lieux d’in- cendie, à l’exclusion des incendies de forêt. 7.1(4) La présomption relative à un cancer primitif du poumon s’applique seulement aux ouvriers qui étaient des

An Act to Amend the Workers’ Compensation Act Bill 61 only to a worker who has been a non-smoker immediately before the day of the accident for a minimum period of time prescribed by the Lieutenant-Governor in Council by regulation. 7.1(5) The presumption in subsection (2) applies to ac- cidents that happen to (

a) full-time firefighters on or after January 1, 2000; or (

b) part-time firefighters on or after the day this sub-

section comes into force. 7.1(6) If a worker who is a full-time firefighter or part- time firefighter suffers an injury to the heart within 24 hours after attendance at an emergency response, the in- jury must be presumed to be an accident arising out of and in the course of the employment, unless the contrary is proven. 7.1(7) The Lieutenant-Governor in Council may make regulations (

a) prescribing minimum periods of employment for the purpose of subsection (3), which may be different for different diseases set out in subsection (2), and dif- ferent for full-time firefighters and part-time firefight- ers; (

b) prescribing the minimum period of time for which a worker must be a non-smoker for the purpose of subsection (4). 3 This Act or any provision of it comes into force on a day or days to be fixed by proclamation. non-fumeurs immédiatement avant le jour de l’accident et qui n’ont pas fumé pendant la période minimale fixée par règlement par le lieutenant-gouverneur en conseil. b) aux accidents subis par des pompiers à temps par- tiel à compter de l’entrée en vigueur du présent para- graphe. 7.1(6) La lésion cardiaque que subit l’ouvrier qui est pompier à temps plein ou à temps partiel dans les vingt- quatre heures suivant une intervention d’urgence est pré- sumée être un accident survenu du fait et au cours de l’em- ploi, sauf preuve contraire. 7.1(7) Le lieutenant-gouverneur en conseil peut, par règlement :

a) fixer des périodes d’emploi minimales pour l’ap- plication du paragraphe (3), lesquelles périodes peu- vent varier en fonction des maladies mentionnées au paragraphe (2) et ne pas être les mêmes pour les pom- piers à temps plein et à temps partiel;

b) fixer la période minimale pendant laquelle un tra- vailleur doit être non-fumeur pour l’application du pa- ragraphe (4). 3 La présente loi ou l’une quelconque de ses disposi- tions entre en vigueur au jour ou aux jours fixés par pro- clamation.
