On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended as set out in the attached Appendix 1, and

(

b) the Liquor Distribution Regulation, B.C. Reg. 611/76, is amended as set out in the attached Appendix 2.

Appendix 1

Section 9.1 (1) of the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016, is amended by striking out " and " at the end of paragraph (

b) and by adding the following paragraph:

(b.2) a licensee to enclose in a container a mixed drink containing liquor and non-liquor ingredients and

(

i) deliver and sell the mixed drink in the container in accordance with paragraph (a), or

(ii) sell and transfer possession of the mixed drink in the container in accordance with paragraph (b), and .

Section 16.1 is amended

(

a) in subsection (1) by striking out " and " at the end of paragraph (

b) and by adding the following paragraph:

(b.2) a licensee to enclose in a container a mixed drink containing liquor and non-liquor ingredients and

(

i) deliver and sell the mixed drink in the container in accordance with paragraph (a), or

(ii) sell and transfer possession of the mixed drink in the container in accordance with paragraph (b), and , and

(

b) in subsection (3) by striking out " subsection (1) (

a) and (b) " and substituting " subsection (1) (

a) to (b.2) ".

Appendix 2

1 The Liquor Distribution Regulation, B.C. Reg. 611/76, is amended by adding the following section:

Manufacture

4.2 The liquor prescribed for the purposes of the definition of "manufacture" in

section 1 (1) of the Liquor Distribution Act is liquor that a licensee encloses in a container under

section 9.1 (1) (b.2) or 16.1 (1) (b.2) of the Liquor Control and Licensing Regulation.
