Wildlife Act

WILDLIFE AMENDMENT REGULATION

Filed: August 5, 1998

Made by the Minister of Environmental Protection (M.O. 25/98) pursuant to

sections 15, 25 and 96 of the Wildlife Act.

1 The Wildlife Regulation (AR 143/97) is amended by this Regulation.

Section 30(17) is amended by striking out "200 to 208, 214 to 224, 230

to 238, 254, 256, 300 to 312, 322, 324, 332, 348, 505, 507 and 508" and

substituting "200, 202, 204, 206, 214, 216, 221 to 238, 258, 260, 300 to

312, 322, 324, 332, 348, 500 to 502, 504, 505, 507 and 508".

Section 31 is amended

(

a) in subsection (4)(

f) by striking out "any of the 4 preceding

fiscal years" and substituting "the preceding fiscal year";

(

b) in subsection (8) by striking out "any of the 4 preceding

fiscal years" and substituting "the preceding fiscal year".

Section 33(1) is amended by adding "and" at the end of clause (c), by

striking out "and" at the end of clause (

d) and by repealing clause (e).

Section 35 is amended by adding "and" at the end of clause (b), by

c) and by repealing clause (d).

Section 57(1)(

a) is amended by striking out the portion preceding

subclause (

i) and substituting "is an individual who is an adult resident

or non-resident who, in the case of a non-resident, is a Canadian citizen

or has been admitted to permanent residence in Canada, is a designated

guide and has held".

Section 104 is repealed.

(2) The onus is on the holder of a cougar hunting licence to

determine whether the hunting season is open, based on the application of

(3) The Minister may close the cougar hunting season if any of

the following quotas have been reached:

(

a) in Cougar Management Area 1, 4 female cougar or 7

cougar,

(

b) in Cougar Management Area 1A, 6 female cougar or 12

cougar,

(

c) in Cougar Management Area 2, 8 female cougar or 16

cougar,

(

d) in Cougar Management Area 3, 8 female cougar or 15

cougar,

(

e) in Cougar Management Area 4, 5 female cougar or 10

cougar,

(

f) in Cougar Management Area 5, 1 female cougar or 2

cougar,

(

g) in Cougar Management Area 6, 9 female cougar or 17

cougar,

(

h) in Cougar Management Area 7, 11 female cougar or 21

cougar,

(

i) in Cougar Management Area 8, 11 female cougar or 22

cougar,

(

j) in Cougar Management Area 9, 4 female cougar or 8

cougar,

(

whichever of the female number and the total number of cougar

are killed first.

(4) For the purposes of subsection (3) with respect to a

cougar management area, the quota is reached when the number of cougars

killed under the authority of a recreational licence and registered under

section 130(4) of this Regulation, plus cougars that have been estimated to

have been removed from the wildlife population by the actions of any

person, including a collision with any vehicle, reaches the quota for that

cougar management area.

(

Alberta Regulation 160/98

Gaming and Liquor Act

GAMING AND LIQUOR AMENDMENT REGULATION

Filed: August 12, 1998

Made by the Lieutenant Governor in Council (O.C. 340/98) pursuant to

section 126 of the Gaming and Liquor Act.

1 The Gaming and Liquor Regulation (AR 143/96) is amended by this

Regulation.

Section 51 is repealed and the following is substituted:

General merchandise liquor store licence

51(1) The board may not issue or renew a general merchandise liquor

store licence for a general merchandise liquor store located in a

municipality if a retail liquor store licence is in force for a retail

liquor store located in the same municipality.

(2) The board may not issue a general merchandise liquor store

licence, other than a renewal, for a general merchandise liquor store

located in a municipality if a general off sales licence is in force for a

hotel located in the same municipality.

(3) The board shall make policies establishing additional criteria

for issuing general merchandise liquor store licences.

FREEDOM OF INFORMATION AND PROTECTION OF

PRIVACY AMENDMENT REGULATION

Made by the Lieutenant Governor in Council (O.C. 341/98) pursuant to

section 88 of the Freedom of Information and Protection of Privacy Act.

1 The Freedom of Information and Protection of Privacy Regulation (AR

200/95) is amended by this Regulation.

2 The following is added after

section 17:

Meeting in absence of the public

18(1) A meeting of a local public body's elected officials,

governing body or committee of its governing body may be held in the

absence of the public only if the subject-matter being considered in the

absence of the public concerns

(

a) the security of the property of the local public

body,

(

b) personal information of an individual, including an

employee of a public body,

(

c) a proposed or pending acquisition or disposition of

property by or for a public body,

(

d) labour relations or employee negotiations,

(

e) a law enforcement matter, litigation or potential

litigation, including matters before administrative tribunals affecting the

local public body, or

(

f) the consideration of a request for access for

information under the Freedom of Information and Protection of Privacy Act

if the governing body or committee of the governing body is itself

designated as the head of the local public body for the purposes of the

Freedom of Information and Protection of Privacy Act,

and no other subject-matter is considered in the absence of the

public.

(2) Subsection (1) does not apply to a local public body if another

Act

(

a) expressly authorizes the local public body to hold

meetings in the absence of the public, and

(

b) specifies the matters that may be discussed at

those meetings.

Definitions

1 In this Regulation,

(a) "agreement" means an agreement or arrangement entered into by a

person or persons holding the office of Transmission Administrator relating

to a duty or function of the Transmission Administrator;

(b) "Board" means the Alberta Energy and Utilities Board.

Board order

2(1) Where in the Board's opinion it is just and reasonable to do so, the

Board may make an order that a person or persons holding the office of

Transmission Administrator after the date of the order are bound by an

agreement entered into by a person or persons holding the office of

Transmission Administrator on or before the date of the order.

(2) The Board may make an order under subsection (1) in respect of an

agreement that has, as of the date of the order,

(

a) not been entered into, or

(

b) been entered into subject to Board approval and is not yet

effective

if the Board is satisfied that the agreement will commence and become

effective within a reasonable time after the order is made.

Effect of Board order

3(1) The person or persons who are the subject of an order made under

section 2(1) are bound by the agreement to which the order relates as if

they had been a party to the agreement.

(2) The person or persons who are the subject of an order made under

section 2(2) are bound by the agreement to which the order relates as if

they had been a party to the agreement only if the agreement commences and

becomes effective within a reasonable time after the order was made.

4 The Board shall not rescind an order made under

section 2 during the

term of the agreement to which the order relates.

Repeal

5 This Regulation is made under

section 72(1) of the Electric Utilities

Act and is repealed in accordance with

section 72(2) of the Electric

Utilities Act.

Real Estate Act

REAL ESTATE (MINISTERIAL) AMENDMENT REGULATION

Made by the Minister of Municipal Affairs (M.O. H:078/98) pursuant to

sections 83(2)(

c) and 83(2)(

d) of the Real Estate Act.

1 The Real Estate (Ministerial) Regulation (AR 113/96) is amended by this

Regulation.

2 Sections 9 and 10 are repealed and the following are substituted:

Payments from Fund

9 For the purposes of

Part 4 of the Act, money may be paid from the

Fund where the judgment referred to in

section 56(3) of the Act is in

respect of any industry member.

Assessments

10 All industry members and applicants to become industry members

are liable for assessments for the purposes of

section 56(5) of the Act.

Section 12 is repealed and the following is substituted:

Maximum payments

12 The maximum payments that may be made from the Fund under

section 59 of the Act are as follows:

(

a) with respect to applicants who have obtained

judgments against a real estate agent, designated representative or

salesperson based on a finding of fraud or breach of trust that occurred

before October 1, 1996,

(i) $25 000 per applicant, and

(ii) $250 000 for all claims against the

real estate agent, designated representative or salesperson arising, in the

Council's opinion, from one event;

(

b) with respect to applicants who have obtained

judgments against a real estate agent, designated representative or

salesperson based on a finding of fraud or breach of trust that occurred on

or after October 1, 1996,

(i) $35 000 per applicant, and

(ii) $350 000 for all claims against the

real estate agent, designated representative or salesperson arising, in the

Council's opinion, from one event;

(

c) with respect to applicants who have obtained

judgments against a mortgage agent, designated representative or

salesperson based on a finding of fraud or breach of trust that occurred on

or after October 1, 1998,

(i) $25 000 per applicant, and

(ii) $100 000 for all claims against the

mortgage agent, designated representative or salesperson arising, in the

Council's opinion, from one event.

4 This Regulation comes into force on October 1, 1998.
