B.C. Reg. 120/2009 , deposited March 13, 2009, pursuant to the WILDLIFE ACT [Sections 19 and 108]. Order in Council 196/2009, approved and ordered March 11, 2009.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders the following:

(

a) effective March 16, 2009, the Designation and Exemption Regulation, B.C. Reg. 168/90, is amended as set out in

Schedule 1;

(

b) effective March 16, 2009, the Permit Regulation, B.C. Reg. 253/2000, is amended as set out in

Schedule 2;

(

c) effective April 1, 2010, the Permit Regulation, B.C. Reg. 253/2000, is amended as set out in

Schedule 3.

Schedule 1

Section 1 (

t) of

Schedule A of the Designation and Exemption Regulation, B.C. Reg. 168/90, is repealed.

Section 4 of

Schedule A is amended

(

a) by repealing paragraph (d), and

(

b) by adding the following paragraph:

(

p) Crotalus oreganus — western rattlesnake.

Schedule 2

Section 4 of the Permit Regulation, B.C. Reg. 253/2000, is amended by adding the following paragraphs:

(

f) if satisfied that special circumstances exist, authorizing a person to possess a species individual of a controlled alien species that was not in British Columbia on March 16, 2009, or

(

g) if satisfied that special circumstances exist, authorizing a person who possesses a species individual of a controlled alien species to allow that species individual to breed.

Section 5 is amended by adding the following subsection:

(3) Despite subsection (2), a permit under

section 4 (

f) or (

g) must not be issued to a person who is under 19 years of age.

Section 22 (2) is amended by adding " or 4 (f) " after " (y) ".

Section 1 (

p) of

Schedule 1 is repealed.

Section 4 (

a) of

Schedule 1 is repealed.

6 The table in

Schedule 3 is amended by adding the following as indicated:

Section 4 (

f) and (

g) of the Permit Regulation, B.C. Reg. 253/2000, is repealed and the following substituted:

(

f) authorizing a person to possess a species individual of a controlled alien species if

(

i) the species individual was in British Columbia on March 16, 2009,

(ii) the person operates a zoo or is an educational or research institution, or

(iii) the director is satisfied that special circumstances exist,

(

g) authorizing a person who possesses a species individual of a controlled alien species and who operates a zoo or is an educational or research institution to allow that species individual to breed, or

(

h) authorizing a person to ship or transport a species individual of a controlled alien species in British Columbia.

Section 5 (3) is amended by striking out "

section 4 (

f) or (g) " and substituting "

section 4 (

f) to (h) ".

Section 21 is amended

(

a) by adding the following subsection

(2.1) An applicant for, and a holder of, a permit under

section 4 (f) (ii) for the purpose of operating a zoo must have and maintain public liability and property damage insurance in the amount of not less than $2 million which must be

(

a) valid for the same term as the permit, and

(

b) applicable to the operation of a zoo. , and

(

b) in subsection (3) by adding " or (2.1) " after " subsection (2) ".
