To all Whom these Presents shall come GREETING
Terry Matchett, Deputy Minister of Justice and
Deputy Attorney General
WHEREAS the Alberta Official Song Committee has, in accordance with
section 7 of
the Alberta Official Song Act, made a final report to the Minister of Community
Development recommending that the lyrics and music to the song "Alberta" be the
official song for Alberta; and
WHEREAS a resolution has been introduced in the Legislative Assembly in
accordance with
section 8 of the Alberta Official Song Act concurring with the report
of the Alberta Official Song Committee and recommending that the Lieutenant
Governor in Council proclaim the lyrics and music to the song "Alberta" as the
Official Song for Alberta; and
WHEREAS the resolution was agreed to unanimously by the Legislative Assembly;
and
WHEREAS it is expedient to proclaim the lyrics and music to the song "Alberta" as
the Official Song for Alberta on the recommendation of the Alberta Official Song
Committee:
NOW KNOW YE THAT by and with the advice and consent of Our Executive
Council of Our Province of Alberta, by virtue of the provisions of the said Act
hereinbefore referred to and of all other power and authority whatsoever in Us vested
in that behalf, We have ordered and declared and do hereby proclaim the lyrics and
music to the song "Alberta" as the Official Song for Alberta.
IN TESTIMONY WHEREOF We have caused these Our Letters to be made Patent
and the Great Seal of Our Province of Alberta to be hereunto affixed.

The Lieutenant Governor in Council orders that
(
a) effective January 1, 2004, the land described in Appendix A and shown on the
sketch in Appendix B is separated from The County of Newell No. 4 and annexed
to the Village of Duchess,
(
b) any taxes owing to The County of Newell No. 4 at the end of December 31, 2003,
in respect of the annexed land are transferred to and become payable to the Village
of Duchess together with any lawful penalties and costs levied in respect of those
taxes, and the Village of Duchess upon collecting those taxes, penalties and costs
must pay them to The County of Newell No. 4, and
(
c) the assessor for the Village of Duchess must assess, for the purposes of taxation in
2004, the annexed land and the assessable improvements to it,
and makes the order in Appendix C.

APPENDIX C
ORDER
1 In this Order, "annexed land" means the land described in Appendix A and
shown on the sketch in Appendix B.
2 For taxation purposes in 2004 and subsequent years, the annexed land and the
assessable improvements to it
(
a) must be assessed by the Village of Duchess on the same basis as if they had
remained in The County of Newell No. 4, and
(
b) must be taxed by the Village of Duchess in respect of each assessment class
that applies to the annexed land and the assessable improvements to it using
the tax rate established by The County of Newell No. 4.
3 Where in any taxation year a portion of the annexed land is disposed of by one or
both of the current landowners to a third party,
section 2 ceases to apply at the
end of that taxation year in respect of that portion of the annexed land and the
assessable improvements to it.
4 Where, in any taxation year, a portion of the annexed land
(
a) becomes a new parcel of land created as a result of subdivision or separation
of title by registered plan of subdivision or by instrument or any other
method that occurs at the request of, or on behalf of, the landowner,
(
b) is redesignated at the request of, or on behalf of the landowner under the
Village of Duchess' Land Use Bylaw to another designation, or
(
c) is connected to water and sewer services provided by the Village of Duchess
section 2 ceases to apply at the end of that taxation year in respect of that portion
of the annexed land and the assessable improvements to it.
5 After
section 2 ceases to apply to a portion of the annexed land in a taxation year,
that portion of the annexed land and the assessable improvements to it must be
assessed and taxed for the purposes of property taxes in that year in the same
manner as other property of the same assessment class in the Village of Duchess
is assessed and taxed.
