An Act to Amend the Electricity Act Loi modifiant la

Loi sur l’électricité Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as follows: Sa Majesté, sur l’avis et avec le consentement de l’Assemblée législative du Nouveau-Brunswick, édicte : 1

Section 1 of the Electricity Act,

chapter 7 of the Acts of New Brunswick, 2013, is amended by adding the following

definitions in alphabetical order: 1 L’article 1 de la

chapitre 7 des Lois du Nouveau-Brunswick de 2013, est modifié par l’adjonction des définitions suivantes selon l’ordre al- phabétique : “First Nation” means a band as defined in the Indian Act (Canada) located in the province. (Première nation) “local entity” means (

a) a municipal distribution utility, (

b) a local government or local service district, (

c) a First Nation or a partnership or limited partner- ship between two or more First Nations, (

d) a not-for-profit company incorporated under the Companies Act and in which a majority of the voting shares is beneficially owned or controlled, directly or indirectly, by one or more residents of the province, (

e) an association as defined in the Co-operative As- sociations Act and in which the majority of members who are entitled to vote are residents of the province, « entité locale » S’entend, selon le cas :

a) d’une entreprise municipale de distribution d’électricité;

b) d’un gouvernement local ou d’un district de ser- vices locaux;

c) d’une Première nation ou encore d’une société en nom collectif ou d’une société en commandite entre deux ou plusieurs Premières nations;

d) d’une compagnie sans but lucratif constituée sous le régime de la

Loi sur les compagnies , dans laquelle la majorité des actions avec droit de vote appar- tiennent à

titre bénéficiaire à un ou plusieurs résidents de la province ou sont contrôlées, même indirecte- ment, par ceux-ci;

e) d’une association selon la définition que donne de ce terme la

f) an educational institution that is designated by the Lieutenant-Governor in Council as a degree grant- ing institution under the Degree Granting Act or is au- thorized by

an Act of the Legislature to grant degrees, (

g) a regional service commission within the mean- ing of the Regional Service Delivery Act, or (

h) a partnership or limited partnership between any of the entities listed in paragraphs (

a) to (

g) and a per- son who is a resident of the province, the majority in- terest in which is owned by the entity and in which the majority of benefits, under the partnership agree- ment, accrues to the entity. (entité locale) “municipality” means a municipality as defined in the Local Governance Act. (municipalité) “small-scale generation facility” means a generation facility that is located in the province and that has a max- imum installed capacity of 20 MW. h) d’une société en nom collectif ou d’une société en commandite entre des entités énumérées aux ali- néas

g) et une personne qui est résidente de la province, dont l’intérêt majoritaire appartient à l’enti- té et dans laquelle la majorité des bénéfices, selon le contrat d’association, reviennent à l’entité. (local enti- ty) « installation de production à petite échelle » Installa- tion de production érigée dans la province et ayant une puissance installée maximale de 20 MW. (small-scale generation facility) « municipalité » S’entend selon la définition que donne de ce terme la

Section 72 of the Act is amended 2 L’article 72 de la Loi est modifié (

a) by repealing subsection (6) and substituting the following:

a) the electricity is generated within the province of New Brunswick,

c) the electricity is purchased in accordance with that municipal distribution utility’s policy regarding

section 116 the following: 3 La Loi est modifiée par l’adjonction de ce qui suit après l’article 116 : Development of distribution tariff Élaboration d’un tarif de distribution 116.1 The Corporation shall, within one year of the commencement of this section, develop in consultation with stakeholders and make an application to the Board for a distribution tariff necessary to facilitate the pur- chase of electricity as provided for in subsections 72(6) and (7). 116.1 La Société doit, dans l’année qui suit l’entrée en vigueur du présent article, élaborer en consultation avec les parties intéressées un tarif de distribution pour l’achat d’électricité prévu aux paragraphes 72(6) et (7) et sollici- ter l’approbation de la Commission. 4 This Act comes into force on a day to be fixed by proclamation. 4 La présente loi entre en vigueur à la date fixée par proclamation.
