An Act to Amend the Members’ Conflict of Interest Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1S ection of the Members’ Conflict of Interest Act,

chapter M-7.01 of the Acts of New Brunswick, 1999, is amended by adding the following definition in alphabet- ical order: “immediate family” means the member’s spouse, chil- dren, siblings, parents, spouse’s siblings, mother-in-law, father-in-law and any other adult who shares a residence with the member and is primarily dependent on the mem- ber or spouse for financial support; 2 Subsection 18(4) of the Act is amended (

a) in paragraph (

a) by striking out “and” at the end of the paragraph; (

b) in paragraph (

b) by striking out the period at the end of the paragraph and substituting a comma; (

c) by adding after paragraph (

b) the following: (

Loi sur les conflits d’intérêts des députés et des membres du Conseil exécutif, chapi tre M-7.01 des Lois du Nouveau-Brunswick de 1999, est modifié par l’adjonction de la définition sui- vante selon l’ordre alphabétique : « famille immédiate » s’entend du conjoint, des en- fants, de la fratrie, des père et mère, de la fratrie du con- joint, de la belle-mère et du beau-père du député ou du membre du Conseil exécutif, ainsi que de tout autre adulte qui partage son logement et qui dépend principalement de lui ou du conjoint sur le plan financier; 2 Le paragraphe 18(4) de la Loi est modifié

a) à l’alinéa a) par la suppression de « et » à la fin de l’alinéa;

b) à l’alinéa b) par la suppression du point à la fin de l’alinéa et son remplacement par une virgule;

c) par l’adjonction de ce qui suit après l’alinéa b) :

d) disclosure of the engagement, contracting or hir- ing of any member of the member’s immediate family pursuant to a personal service contract with a depart- ment or office of the Government of New Brunswick or a Crown corporation, (

e) disclosure of the holding of any office by any member of the member’s immediate family by reason of an appointment by or nomination approved by the Executive Council, a member of the Executive Council or an employee of a department or office of the Gov- ernment of New Brunswick or a Crown corporation, to which a salary or stipend is attached, (

f) disclosure of any contract with a department or of- fice of the Government of New Brunswick or a Crown corporation under which a member of the member’s immediate family receives a benefit, and (

g) disclosure of any contract with a department or office of the Government of New Brunswick or a Crown corporation and any business or private corpo- ration in which a member of the member’s immediate family has an interest in or is an officer or director thereof. 3 Subsection 20(2) of the Act is amended (

a) in paragraph (

b) by striking out “and” at the end of the paragraph; (

b) in paragraph (

c) by striking out the period at the end of the paragraph and substituting a comma fol- lowed by “and”; (

c) by adding after paragraph (

c) the following: (

d) state any employment, contracts, offices or bene- fits provided to a member of the member’s immediate family that have been disclosed to the Commissioner under

e) la divulgation qu’un membre de la famille immé- diate du député ou du membre du Conseil exécutif oc- cupe des fonctions rémunérées à la suite d’une nomina- tion faite ou approuvée par le Conseil exécutif, un membre du Conseil exécutif ou un employé d’un minis- tère ou d’un organisme du gouvernement du Nouveau- Brunswick ou d’une société de la Couronne,

f) la divulgation de tout contrat avec un ministère ou un organisme du gouvernement du Nouveau- Brunswick ou une société de la Couronne en vertu du- quel un membre de la famille immédiate du député ou du membre du Conseil exécutif reçoit un avantage, et

g) la divulgation de tout contrat avec un ministère ou un organisme du gouvernement du Nouveau- Brunswick ou une société de la Couronne et avec une corporation commerciale ou privée dans laquelle un membre de la famille immédiate du député ou du mem- bre du Conseil exécutif a des intérêts ou est dirigeant ou administrateur. 3 Le paragraphe 20(2) de la Loi est modifié

a) à l’alinéa b) par la suppression de « et » à la fin de l’alinéa;

b) à l’alinéa c) par la suppression du point à la fin de l’alinéa et son remplacement par une virgule suivie de «e t» ;

c) par l’adjonction de ce qui suit après l’alinéa c) :

d) indiquer tous emplois, contrats, postes ou avan- tages accordés à un membre de la famille immédiate du député ou du membre du Conseil exécutif qui ont été divulgués au Commissaire en vertu de l’arti- cle 18.
