B.C. Reg. 156/2018 , deposited July 16, 2018, under the MISCELLANEOUS STATUTES AMENDMENT ACT, 2018 [section 23] and the COOPERATIVE ASSOCIATION ACT [section 211]. Order in Council 387/2018, approved and ordered July 16, 2018.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that, effective August 1,

2018,

(

a) sections 17 to 19 of the Miscellaneous Statutes Amendment Act, 2018 , S.B.C. 2018, c. 5, are brought into force, and

(

b) the Cooperative Association Regulation, B.C. Reg. 391/2000, is amended as

set out in the attached Appendix.

Appendix

Section 4 of the Cooperative Association Regulation, B.C. Reg. 391/2000, is amended

(

a) by repealing subsection (0.1),

(

b) in subsection (1) by striking out “ If the members of a housing cooperative ” and substituting “ If the directors of a housing cooperative serve notice of the termination of a

membership under

section 36 (2) (

e) of the Act or if the members of a housing cooperative ”,

(

c) in subsection (3) by adding “ 36 (2) (

e) or ” after “ notice under

section ”, and

(

d) in subsection (5) by striking out “ of the members ” and substituting “ of the directors or the members, as the case may be, ”.

Section 4.1 is repealed and the following substituted:

Notice of right to appeal termination of membership

4.1

(1) For the purpose of

section 36 (3) of the Act, Form 9.1 of

Schedule C is prescribed.

(2) For the purpose of

section 37 (2.1) (a) (ii) of the Act, Form 9 of

Schedule C

is prescribed.

3 Form 9.1 of

Schedule C is amended by striking out “ (Section 36 (2) (e) ) ” and substituting “ (Section 36 (3)) ”.
