PART 1 PURPOSE AND

INTERPRETATION

PARTIE 1 OBJET ET INTERPRÉTATION Purpose of Act Objet de la loi 1 The purposes of this Act are: 1 La présente loi vise : (

a) to ensure and strengthen a sustainable local food economy in New Brunswick;

b) to promote local food procurement in New Brunswick;

Definitions Définitions 2 The following

definitions apply in this Act. 2 Les définitions qui suivent s’appliquent à la présente loi. “farm” means premises the whole or part of which are used for agricultural purposes and, without limiting the generality of the foregoing, includes premises used for: (

a) the production of plants for the purpose of the sale of such plants, or any part thereof; and (

b) the production, including breeding, rearing, or fattening of animals for the purpose of the sale of such animals, or any part thereof. (ferme) “food, agriculture, and garden-based education” means curriculum that conveys an understanding of local food systems by way of direct educational experiences, including local food tasting and sampling, participation in school gardens, composting programs, food prepara- tion, and farm tours. (éducation en matière d’alimenta- tion, d’agriculture et de jardinage) “healthy food education” means curriculum that con- veys an understanding of local food systems, including food-related life skills, and the impact of food system practices and food choices on health, the environment, and the economy. “local food” means (

a) food produced or harvested in New Brunswick, and (

b) subject to any limitation in the regulations, food and beverages made in New Brunswick if at least 80% of their ingredients were produced or harvested in New Brunswick. (aliments locaux) “local food assessment” means an assessment of local food systems that provides an inventory of food resour- ces available at the community level, and an investiga- tion into the scope of, barriers to, and opportunities for local food production and distribution with the goal of increasing food availability. (évaluation de l’alimenta- tion locale) “local food system” means a chain of activities and processes related to the production, processing, distribu- tion and consumption of local food. (système alimentaire local) “local organic food” means food that is local which meets the Canadian Organic Certification Standards. (aliments biologiques locaux) “Minister” means, unless the context requires other- wise, the Minister of Agriculture, Aquaculture and Fish- eries or such other member of the Executive Council as may be assigned the administration of this Act. (minis- tre) “public body” means: (

a) a department, secretariat or office of the Prov- ince of New Brunswick, including but not limited to those portions of the public service specified in

Part I of the First

Schedule of the Public Service Labour Re- lations Act; (

b) a government body, board, Crown corporation or commission listed under

Part IV of the First Sched- ule of the Public Service Labour Relations Act; (

c) a regional health authority as defined in the Re- gional Health Authorities Act; (

d) a District Education Council established under the Education Act; (

e) an institution as defined in the Adult Education and Training Act; and des programmes de compostage, la préparation d’ali- ments et des visites de fermes. f) a nursing home as defined in the Nursing Homes Act. (organisme public) “sustainable development” means development that meets the needs of the present, without compromising the ability of future generations to meet their own needs. (développement durable)

PART 2 LOCAL FOOD SECURITY STRATEGY AND TARGETS

PARTIE 2 STRATÉGIE DE SÉCURITÉ ALIMENTAIRE LOCALE ET CIBLES Targets Cibles 3(1) Within 12 months of the coming into force of this Act, the Minister shall establish targets in relation to: 3(1) Dans les douze mois suivant l’entrée en vigueur de la présente loi, le ministre fixe des cibles relativement à ce qui suit : (

a) local food procurement;

b) local food distribution; and

New Brunswick Local Food Security Strategy Stratégie de sécurité alimentaire locale du Nouveau- Brunswick 4(1) Within 12 months of the coming into force of this Act, the Minister shall develop a New Brunswick Local Food Security Strategy. 4(1) Dans les douze mois suivant l’entrée en vigueur de la présente loi, le ministre élabore la Stratégie de sé- curité alimentaire locale du Nouveau-Brunswick. 4(2) The New Brunswick Local Food Security Strat- egy shall include 4(2) À la Stratégie de sécurité alimentaire locale du Nouveau-Brunswick sont intégrés : (

a) a vision for achieving the purposes of this Act, and

b) the targets established under this Act and how those targets assist in achieving the purposes of this Act.

4(3) The New Brunswick Local Food Security Strat- egy shall be reviewed every 5 years and, where appropri- ate, amended to reflect new and improved targets and developments in New Brunswick in respect of health, environmental protection, access and education in rela- tion to local food. 4(3) La Stratégie de sécurité alimentaire locale du Nouveau-Brunswick est révisée tous les cinq ans et est modifiée, s’il y a lieu, pour tenir compte des nouvelles cibles et des nouveaux développements au Nouveau- Brunswick en matière de santé, de protection de l’envi- ronnement, d’accès et d’éducation relatifs aux aliments locaux. 4(4) The Minister shall table a report with the Legisla- tive Assembly on the New Brunswick Local Food Secur- ity Strategy every 5 years, with the first report to be ta- bled by December 31, 2025. 4(4) Le ministre dépose à l’Assemblée législative, à partir du 31 décembre 2025, un rapport quinquennal sur la Stratégie de sécurité alimentaire locale du Nouveau- Brunswick. 4(5) Notwithstanding subsection (4), the Minister shall provide annual progress reports to the Legislative As- sembly, with the first being due no later than December 31 of the year following the coming into force of this Act. 4(5) Par dérogation au paragraphe (4), le ministre dé- pose des rapports annuels d’étape à l’Assemblée législa- tive à partir du 31 décembre de l’année qui suit l’entrée en vigueur de la présente loi. 4(6) The contents of reports referred to in subsections (4) and (5) shall include a description of actions taken to support the New Brunswick Local Food Security Strat- egy and progress made in achieving targets established under

PART 3 LOCAL FOOD ASSESSMENT AND PROCUREMENT

a) examination of a baseline for agricultural pro- duction output in New Brunswick, including data on

b) identification of barriers that limit the access of the food and farming sector to production, distribu- tion, and consumer markets within New Brunswick.

Local food procurement Approvisionnement en aliments locaux 6(1) The Minister shall direct public bodies to increase the percentage of their food budgets spent on local or lo- cal organic food, annually, until such local food procure- ments constitute a significant percentage of their overall food budgets specified through relevant targets. 6(1) Le ministre demande aux organismes publics d’augmenter chaque année la part de leur budget alimen- taire consacrée à des aliments locaux ou à des aliments biologiques locaux jusqu’à ce que ces aliments repré- sentent une

part importante de leur budget alimentaire global en fonction des cibles fixées. 6(2) To meet the goals set forth in this section, a pub- lic body contract for the purchase of food may give pref- erence to an otherwise qualified bidder who provides lo- cal or local organic food, provided that the cost included in the bid is not more than 10% greater than the cost in- cluded in a bid that is not for local or local organic food where that food will enhance the security of the local food system in New Brunswick and will contribute to the sustainable development of New Brunswick. 6(2) Dans le but d’atteindre les objectifs énoncés au présent article, lorsque des aliments locaux ou des ali- ments biologiques locaux contribuent à la sécurité ali- mentaire locale et au développement durable au Nouveau-Brunswick, les organismes publics peuvent conclure des contrats d’achat d’aliments qui privilégient des soumissionnaires admissibles offrant ce type d’ali- ments, à condition que le coût additionnel qui en découle ne dépasse pas les 10 %. 6(3) This

section does not apply to procurements that are contrary to national or international trade agreements to which New Brunswick is bound by agreement with Canada. 6(3) Le présent

PART 4 LABELLING OF LOCALLY PRODUCED AND PROCESSED FOODS

Food, agriculture, and garden-based education Éducation en matière d’alimentation, d’agriculture et de jardinage 9 The ministers shall promote food, agriculture, and garden-based education in schools maintaining kinder- garten, or any of grades one to 12, inclusive. 9 Les ministres encouragent l’éducation en matière d’alimentation, d’agriculture et de jardinage dans toutes les écoles à partir de la maternelle jusqu’à la douzième année.

PART 6 OFFENCES AND PENALTIES

PARTIE 6 INFRACTIONS ET PEINES Offences Infractions 11 Every public body that contravenes a direction is- sued under subsection 6(1) is guilty of an offence. 11 Est coupable d’une infraction tout organisme public qui contrevient à une directive donnée en application du paragraphe 6(1). En cas de conflit entre la présente loi ou ses règle- ments et une disposition d’une autre loi, d’un autre rè- glement ou d’un arrêté municipal relatif à l’alimentation locale, à l’éducation nutritionnelle, aux aliments biologi- ques ou encore à la production, à l’approvisionnement ou à la distribution alimentaires, la disposition qui offre la meilleure protection à la santé humaine ou à l’environ- nement l’emporte.

PART 8 REGULATIONS AND COMMENCEMENT

PARTIE 8 RÈGLEMENTS ET ENTRÉE EN VIGUEUR Regulations Règlements 14 The Lieutenant-Governor in Council may make regulations: 14 Le lieutenant-gouverneur en conseil peut, par règle- ment : (

a) clarifying any

definitions included in

section 2;

b) governing the development of targets under sec- tion 3;

c) governing the development of the strategy under

section 4;

c) réglementer l’élaboration de la stratégie prévue à l’article 4; (

d) governing the development of local food assess- ments under

section 5;

d) réglementer l’élaboration des évaluations de l’alimentation locale prévues à l’article 5; (

e) governing the direction, development and imple- mentation of local food procurement measures under

section 6;

e) réglementer l’imposition, l’élaboration et la mise en œuvre des mesures d’approvisionnement en ali- ments locaux prévues à l’article 6; (

f) governing the development and implementation of a labelling system for food produced and processed in New Brunswick under

section 7;

f) réglementer l’élaboration et la mise en œuvre du système d’étiquetage prévu à l’article 7 pour les ali- ments produits et transformés au Nouveau- Brunswick; (

g) governing the development of educational and professional development programs under sections 9 and 10; and

h) respecting any other matter the Lieutenant Gov- ernor in Council considers necessary or advisable for the purposes of this Act.
