An Act to Amend the Public Utilities Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1 The Public Utilities Act,

chapter P-27 of the Revised Statutes, 1973, is amended by adding the following after

section 34.1: REVIEW 34.11(1) The New Brunswick Power Corporation shall, before making any direct capital expenditure in respect of a new generating facility, make an application to the Board for the Board’s recommendation as to the proposed capital expenditures. 34.11(2) The New Brunswick Power Corporation shall make an application to the Board for the Board’s recom- mendation as to a proposed expenditure, before making the expenditure, if the estimated expenditure exceeds a to- tal of seventy-five million dollars in relation to (

a) the decommissioning of a generating facility; or (

b) a proposed maintenance program or a proposed upgrading program for a generating facility, or a com- bination of such programs for a generating facility. PROJET DE LOI Loi modifiant la

chapitre P-27 des Lois révisées de 1973, est modifiée par l’adjonc- tion, après l’article 34.1 : RÉVISION 34.11(1) La Société d’énergie Nouveau-Brunswick doit, avant de faire toute dépense d’immobilisation directe relativement à une nouvelle installation de production, faire une demande à la Commission pour obtenir de celle- ci ses recommandations quant aux dépenses en immobili- sations proposées. 34.11(2) La Société d’énergie Nouveau-Brunswick doit faire une demande à la Commission pour obtenir de celle- ci ses recommandations quant à une dépense proposée avant de faire cette dépense si elle dépasse une somme to- tale de soixante-quinze millions de dollars à l’égard

a) du déclassement d’une installation de production; ou

b) d’un programme d’entretien proposé ou d’un pro- gramme d’amélioration proposé d’une installation de production, ou l’un et l’autre de ces programmes pour une installation de production. 2 Projet de loi Loi modifiant la

Loi sur les entreprises de service public 34.11(3) The Board shall, upon receipt of an application made under subsection (1) or (2), (

a) give notice to the New Brunswick Power Corpo- ration of the date of the hearing of the application; and (

b) proceed under

section 22. 34.11(4) The Board at the conclusion of the hearing shall forward its recommendations in writing to the New Brunswick Power Corporation. 34.11(5) The New Brunswick Power Corporation shall not be bound by the recommendations forwarded to it un- der subsection (4). Commencement This Act or any provision of it comes into force on a day or days to be fixed by proclamation. 34.11(3) La Commission doit, sur réception d’une de- mande faite en vertu du paragraphe (1) ou (2) :
