B.C. Reg. 127/2018 , deposited June 25, 2018, under the BUSINESS PRACTICES AND CONSUMER PROTECTION (PAYDAY LOANS) AMENDMENT ACT, 2007 [section 12] and the BUSINESS PRACTICES AND CONSUMER PROTECTION ACT [section 112.15]. Order in Council 322/2018, approved and ordered June 25, 2018.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that, effective September 1, 2018,

(

a) the following provisions of the Business Practices and Consumer Protection (Payday Loans) Amendment Act, 2007 , S.B.C. 2007, c. 35 are brought into force:

(

i) section 4, as it enacts sections 112.12 to 112.15 of the Business Practices and Consumer Protection Act , S.B.C. 2004, c. 2;

(ii)

section 8, as it enacts

section 189 (4) (f.6) of the Business Practices and Consumer Protection Act , and

(

b) the attached Government Cheque Cashing Fees Regulation is made.

GOVERNMENT CHEQUE CASHING FEES REGULATION

Definition

1 In this regulation, “government assistance cheque” means a government cheque that is issued

(

a) to a recipient under the Employment and Assistance Act to provide income assistance, hardship assistance or a supplement under that Act, or

(

b) to a recipient under the Employment and Assistance for Persons with Disabilities Act to provide disability assistance, hardship assistance or a supplement under that Act.

Government cheques

2 Subject to this regulation, a person may charge, require or accept a cheque cashing fee.

Government assistance cheques

3 Despite

section 2, a person may charge, require or accept a cheque cashing fee in relation to a government assistance cheque only if the cheque cashing fee does not exceed the lesser of

(a) $2.00 plus 1% of the face value of the government assistance cheque, and

(b) $10.00.
