WHEREAS in or about 1921 the Rural Municipality of Morris, the Rural Municipality of Macdonald and the Rural Municipality of Dufferin contributed jointly to the construction of a curling and skating rink in the community known as Sperling, in the Rural Municipality of Morris;

AND

WHEREAS by

an Act to create "The Community District of Sperling" for Certain Purposes ,

chapter 99 of the Statutes of Manitoba, 1926 , a community district known as "Sperling Community District" was created, establishing a board of trustees for the purpose of holding in trust the skating and curling rink and the premises connected to them, and for the management of the affairs of the rink and the associated premises;

AND

WHEREAS the members of the Board of Trustees created by

An Act to create "The Community District of Sperling" for Certain Purposes , aforesaid, are the registered owners of land under Certificates of Title Nos. A 26339 and A 26340;

AND

WHEREAS pursuant to

Section 439 of The Municipal Act , the municipalities have by by-law provided for the establishment of a joint community centre district, known as "The Sperling Joint Community Centre District" and have entered into an agreement to establish a joint community centre district board known as "The Sperling Joint Community Centre District Board" to supervise and co-ordinate the maintenance and operation of a community centre for the use of the residents of the municipalities;

AND

WHEREAS the municipalities have agreed that the land at Sperling, on which the curling and skating rink is situated, and the buildings and premises on it, be vested in the Rural Municipality of Morris for the purposes of the Sperling Joint Community Centre District and under the supervision and control of the Sperling Joint Community Centre District Board;

ATTENDU QUE dans ou vers l'année 1921, les municipalités rurales de Morris, de Macdonald et de Dufferin ont contribué conjointement à la construction d'une patinoire et d'un terrain de curling dans la communauté de Sperling, dans la municipalité rurale de Morris;

ATTENDU QUE le « Sperling Community District » a été créé à des fins précises par la loi intitulée «

An Act to create "The Community District of Sperling" »,

chapitre 99 des « Statutes of Manitoba, 1926 », et qu'un conseil d'administration a été nommé pour recevoir en fiducie le terrain de curling, la patinoire et les locaux y rattachés et d'en administrer les affaires;

ATTENDU QUE les membres du conseil d'administration créé par la loi intitulée «

An Act to create "The Community District of Sperling" » à des fins précises, comme il est indiqué ci-dessus, sont les propriétaires inscrits des terrains visés aux certificats n os A 26339 et A 26340;

ATTENDU QUE les municipalités ont prévu, par arrêté, conformément à l'article 439 de la

Loi sur les municipalités , l'établissement du « The Sperling Joint Community Centre District » et qu'elles ont conclu une entente en vue de la création de la « The Sperling Joint Community Centre District Board » pour voir à la supervision et à la coordination des activités du centre communautaire à l'usage des résidants des municipalités;

ATTENDU QUE les municipalités ont convenu de confier à la municipalité rurale de Morris les biens-fonds sur lesquels sont situés, à Sperling, le terrain de curling, la patinoire et les immeubles y érigés, pour la réalisation des objets généraux du « Sperling Joint Community Centre District », sous la supervision et la gestion de la « Sperling Joint Community Centre District Board »;

THEREFORE HER MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

PAR CONSÉQUENT, SA MAJESTÉ, sur l'avis et du consentement de l'Assemblée législative du Manitoba, édicte :

Lands vested in R.M. of Morris

1 The following lands are hereby vested in the Rural Municipality of Morris:

Parcel 1: In the Village of Sperling, in Manitoba, and being Lot 1, in Block A, shown on a Plan of Survey of the Village, registered in the Morden Land Titles Office as No. 842-C;

Parcel 2: In the Village of Sperling, in Manitoba, and being Lot 8, in Block A, shown on a Plan of Survey of the Village, registered in the Morden Land Titles Office as No. 842-C.

Lands held for community centre

2 The Rural Municipality of Morris shall hold the lands for the use of a community centre for the public use of the residents of The Rural Municipality of Morris, The Rural Municipality of Macdonald and The Rural Municipality of Dufferin, to be maintained and operated by the Sperling Joint Community Centre District Board.

2 La municipalité rurale de Morris détient les biens-fonds du centre communautaire à l'usage des résidants des municipalités rurales de Morris, de Macdonald et de Dufferin. L'entretien et l'exploitation en sont confiés à la Commission du district du centre communautaire conjoint de Sperling.
