OIC Text: The Governor in Council on the Report and Recommendation of Minister of Economic Development dated August 17, 2005, pursuant to Sections 2, 3, and 5 of

Chapter 222 of the Revised Statutes of Nova Scotia, 1989, the Industrial Development Act, and Sections 70 and 71 of

Chapter 365 of the Revised Statutes of Nova Scotia, 1989, the Provincial Finance Act, is pleased to, effective August 19, 2005: (

a) revoke Order in Council 76-373 dated March 30, 1976, and revoke Order in Council 97-310, dated June 3, 1997; (

b) order that: \x09 (

i) the Waterfront Development Corporation Limited shall continue for the purposes of redeveloping and revitalizing the lands surrounding Halifax Harbour and any other lands as designated by its shareholder; \x09 (ii) with respect to the lands of the Waterfront Development Corporation Limited: \x09\x09(A)\x09those lands immediately adjacent to waterfrontage and conveyed or transferred to the Waterfront Development Corporation Limited on or before August 1, 2005 shall remain available for public use and shall not be sold; \x09\x09(B)\x09those lands, other than those described in clause (

A) and conveyed or transferred to the Waterfront Development Corporation Limited on or before August 1, 2005, shall not be conveyed, transferred or otherwise disposed of for development except by lease; and \x09\x09(C)\x09those lands other than those described in clauses (

A) and (B), may be sold, leased or otherwise conveyed by the Waterfront Development Corporation Limited. (

c) continue the status of Crown corporation conferred on Waterfront Development Corporation Limited by Order in Council 76-373 pursuant to Sections 70 and 71 of the Provincial Finance Act; (

d) assign the responsibility for administration and undertakings related to Waterfront Development Corporation Limited to the Minister of Economic Development; and (

e) authorize the Minister of Economic Development to execute such agreements, documents and instruments as may be required to give effect to this Order.
