Bill 241 Mr. Notley BILL 241 1978 THE DENTAL HEALTH WORKERS ACT (Assented to , 1978) HER MAJESTY, by and with the advice and consent of the Legislative Assembly oJ Alberta, enacts as follows: 1.. In this Act, (a) "dental health worker" means a dental nurse, dental hygienist, dental technician, or a dental assistant who is trained and qualified to perform such dental services as 'are prescribed by the regulations and is duly registered in accordance with this Act; (b) "Minister" means the member of the Executive Council to whlOm the administration of this Act is assigned. 2.

The Minister may m'ake such arl'langements as he considers necessary to provide for the education and training of dental health workers, either through a commission or a department of Government or in conjunction with a university or other educa tional institution in the Province. 3. ( 1 ) The Minister shall cause to be kept and maintained a register in which shall be entered the names and addresses and date of registration of every duly qualified dental health worker who has applied for and been granted registration ,and has paid the fee, if any, prescribed by the regulati'Ons.

(2) Upon completion of registration under subsection (1), the Minister lOr a person acting under his authority shall issue a certi ficate 'Of registration to the dental health worker.

(3) A person who, on Dr after the commencement 'Of this Act, is in the opinion of the Minister, duly qualified as a dental health worker shall, upon payment of the prescribed fee, if any, be registered under this section. ( 4) l1he Minister may delegate his functions and duties under this

section to a board appointed by the Lieutenant Governor in Council.

Explanatory Notes I.

Definitions. 2. Provides for education and training of dental health workers. 3. Registration of dental health workers.

4. For the purpose of carrying 'Out the provisi'Ons of this Act according to their intent, the Lieutenant Governor in Council may make such regulations as are ancillary to it and are not inconsis tent with it and, withDut restricting the generality of the foregoing, the Lieutenant G'Oevrn'Or in Council may make regulatiDns (

a) prescribing fees payable on registfation under

section 3; (

b) prescribing what services constitute dental services; (

c) prescribing thDse dental 'serivces that may be oarried out by a dental health worker without the supervision of a duly qualified dentist; (

d) prescribing thDse dental services that shall not be carried 'Out by a dental health wDrker except under the super vision and oontrol of a duly qualified dentist or duly qualified medical practitioner; (

e) presenting the qualifications required for registration under

section 3 and the grDunds on which registration may be revoked, suspended OT revived; (.

f) prescribing the period of time during which a certifioate of registration is valid and providing for the renewal thereof; (

g) appointing persons as inspectors under this Aot and pre scribing vheir powers and duties fDr the purpDse of deter mining the quality of dental services being rendered by dental health workers; (

h) appointing a board for the purpose of this Act and pre scribing its powers and duties; and (

i) respecting 'such other matters as he deems necessary for carrying out the purpDses and 'Objeots of this Act. 5. This Act comes into force on a date to be fixed by Proclama tion which shall not be earlier than the date upon which the Legislature appropriates money t'O the purposes contained herein. 2
