B.C. Reg. 316/2007, deposited October 18, 2007, pursuant to the HOMEOWNER PROTECTION ACT [Section 33 (b)]. Regulation of the Minister of Forests and Range and Minister Responsible for Housing M270/2007, dated October 17, 2007.

I, Rich Coleman, Minister of Forests and Range and Minister Responsible for Housing, order that, effective November 19, 2007, the Form of Evidence Regulation, B.C. Reg. 334/2000, is repealed and the following substituted:

FORM OF EVIDENCE REGULATION

Form of evidence prescribed

1 For the purposes of

section 30 (1) of the Act, the form of evidence to be provided by an applicant for a building permit to a municipality or regional district is as follows:

(

a) if the application is for a new home to be built by an owner builder, a document certifying under the seal of the office that the new home may be built by the owner builder named in the document;

(

b) if the application is for a new home to be built by a residential builder, a document

(

i) certifying under the seal of the office that the residential builder is licenced under the Act to build the new home, and

(ii) certifying under the seal of a warranty provider that the new home is covered by home warranty insurance;

(

c) if the application is for a new home that is exempt under

section 2 of the Homeowner Protection Act Regulation, B.C. Reg. 29/99, a declaration by the builder of the new home or the owner of the property on which the new home is to be built that the new home is exempt from the requirement to be covered by home warranty insurance.
