a) firefighters employed full time by a local gov- ernment as members of a fire department and repre- sented for the purposes of collective bargaining by a bargaining agent that has the exclusive authority to bargain collectively on their behalf only with the local government that is the employer of the firefighters, and

section 80, authorize arbitration to deal with a dispute between the parties and to formulate a first collective agreement or renew or revise an existing agreement or make a new agreement when 80.1(1) Le Ministre, à la demande d’un employeur ou d’un agent négociateur mentionnés à l’article 80, auto- rise l’arbitrage pour régler un différend entre les parties et pour ou bien formuler une première convention col- lective, ou bien reconduire ou réviser celle en vigueur, ou encore, en formuler une nouvelle, dans les circons- tances suivantes : (

c) the Minister is satisfied that the collective bar- gaining has been carried on in good faith but that it is unlikely that the parties will reach an agreement within a reasonable time.

Arbitration by single arbitrator Arbitrage par un seul arbitre 80.3(1) Despite the arbitration provisions in a collec- tive agreement, when disputes have been submitted to arbitration under

section 80.1, the arbitration shall be conducted by a single arbitrator. 80.3(1)

Appointment of arbitrator Nomination d’un arbitre 80.4(1) Within 10 days of the date that the Minister authorizes the arbitration under subsection 80.1, the par- ties shall nominate, by agreement, a person to act as ar- bitrator. 80.4(1) Dans les dix jours suivant la date à laquelle le Ministre autorise l’arbitrage en vertu de l’article 80.1, les parties désignent, par accord, une personne pour agir à

section has the powers and duties conferred and imposed on an arbi- tration board under this Act. 80.4(5) L’arbitre nommé en vertu du présent

a) the results of a comparison of the terms and con- ditions of employment, as between the employees that are subject to the arbitration and other employees in the public and private sectors;

b) the results of a comparison of collective bar- gaining settlements reached by the same local govern- ment and comparable local governments, including those reached by employees in bargaining units to which this Act applies, and the relative economic health of the local governments;

d) the employer’s ability to attract and retain quali- fied firefighters or police officers, as the case may be;

e) the interest and welfare of the community served by the firefighters or police officers, as the case may be; and

section 80 of the Industrial Relations Act,

chapter I-4 of the Revised Statutes, 1973, before this Act receives first reading in the Legislative Assem- bly,

section 80 of the Industrial Relations Act, as that

section read immediately before the commencement of this Act, continues to apply in respect of the dispute to which the application relates, including any appeal of any decision or award made in respect of that dispute. 9 Si une demande d’autorisation de la constitution d’un conseil d’arbitrage ou de la nomination d’un ar- bitre a été faite conformément à l’article 80 de la
