Marketing of Agricultural Products Act

ALBERTA MILK MARKETING AMENDMENT REGULATION

the Alberta Agricultural Products Marketing Council on February 29, 2016 pursuant

to sections 26 and 27 of the Marketing of Agricultural Products Act.

1 The Alberta Milk Marketing Regulation (AR 151/2002) is

amended by this Regulation.

Section 1(1) is amended by adding the following after

clause (g):

(g.1) "dairy animal care policy" means Alberta Milk's policy

relating to dairy animal care as amended from time to time;

Section 6 is amended

(

a) in subsection (6) by striking out "Effective August 1,

2009,";

(

b) by adding the following after subsection (8):

(9) All producers shall comply with Alberta Milk's dairy animal

care policy.

Section 7 is amended

(

a) in subsection (2)

(

i) in clause (

a) by striking out "the Board" and

substituting "Alberta Milk";

(ii) by striking out "or" at the end of clause (f);

(iii) by repealing clause (

g) and substituting the

following:

(

g) a producer fails to meet the qualifications of and

register with the Canadian Quality Milk Program,

(iv) by adding the following after clause (g):

(

h) a producer fails to comply with the dairy animal

care policy.

(

b) in subsection (2.1) by striking out "30.1" and

substituting "30.1, 30.11, 30.12";

(

c) in subsection (2.2) by striking out "30.1" and

substituting "30.1, 30.11, 30.12".

Section 7.1 is repealed and the following is substituted:

Reinstatement of suspended licence

7.1(1) Subject to subsection (2), Alberta Milk may reinstate a

producer's licence that was suspended under

section 7(2.1) if Alberta

Milk receives written confirmation from an analyst at an approved

laboratory that samples of milk produced and taken from the

producer's bulk milk tanks after the licence was suspended meet the

requirements of

Schedule 2 to the Dairy Industry Regulation

(AR 139/99).

(2) If Alberta Milk grades the producer's milk under sections 30 and

30.11 as Somatic Cell Grade 6 or Somatic Cell Grade 7, Alberta

Milk may not reinstate a producer's licence until a minimum of

(a) 6 days has elapsed from the date of suspension for milk

graded as Somatic Cell Grade 6, or

(b) 12 days has elapsed from the date of suspension for milk

graded as Somatic Cell Grade 7.

6 The following is added after

section 7.1:

Reinstatement of cancelled licence

7.2(1) Subject to subsection (2), Alberta Milk may reinstate a

producer's licence that was cancelled under

section 7(2.2) if Alberta

Milk receives written confirmation from an analyst at an approved

laboratory that samples of milk produced and taken from the

producer's bulk milk tanks after the licence was cancelled meet the

requirements of

Schedule 2 to the Dairy Industry Regulation

(AR 139/99).

(2) If Alberta Milk grades the producer's milk under sections 30 and

30.11 as Somatic Cell Grade 8, Alberta Milk may not reinstate a

producer's licence until a minimum of 12 days has elapsed from the

date of cancellation.

Applications for stay

7.3 Sections 7.1 and 7.2 apply where a producer has applied for a

stay of suspension or cancellation under

section 7(4)(b).

Section 30 is amended

(

a) in subsection (3) by striking out "Bacteria Grade,

Somatic Cell Grade and Freezing Point Grade" and

substituting "Bacteria Grade";

(

b) by adding the following after subsection (3):

(3.1) Each month Alberta Milk must determine the Somatic Cell

Grade of a producer's milk that is received by a processor in

accordance with this

section and

section 30.11.

(3.2) Each month Alberta Milk must determine the Freezing

Point Grade of a producer's milk that is received by a processor

in accordance with this

section and

section 30.12.

(1.2) The Minister of Economic Development and Trade is

designated as the Minister responsible for the Promoting Job

Creation and Diversification Act.

Section 8 is amended

a) by repealing subsection (1)(q);

(

b) by adding the following after subsection (2.1):

(2.2) The Minister of Environment and Parks is designated as

the Minister responsible for the Energy Efficiency Alberta Act.

Section 10.1(1)(

a) is repealed.

Section 13.1 is amended by adding the following after

subsection (1.1):

(1.2) The Minister of Labour is designated as the Minister

responsible for the Post-traumatic Stress Disorder (PTSD)

Awareness Day Act.

Section 14.1 is amended by adding the following after

(1.1) The Minister of Seniors and Housing is designated as the

Minister responsible for the Seniors' Home Adaptation and Repair

Act.

Section 15 is amended by adding the following after

subsection (2):

(3) The Minister of Service Alberta is designated as the Minister

responsible for

Section 18 is amended

(

a) in subsection (1)(

r) by striking out "63(1), (2), (3)"

and substituting "63(1), (1.1), (1.2), (2), (3) and (6)";

(

b) by adding the following after subsection (2.4):

(2.5) The responsibility for the Alberta Public Agencies

Governance Act is transferred to the President of Treasury

Board, Minister of Finance.

(2.6) The President of Treasury Board, Minister of Finance is

designated as the Minister responsible for the Climate

Leadership Act, except sections 16, 51, 59, 69(1), (2), (3), (4),

(7) and (8), 71, 77(

b) and 79(1) and (2)(e).

(2.7) The President of Treasury Board, Minister of Finance

and the Minister of Agriculture and Forestry are designated as

the Ministers with common responsibility for sections 16, 51,

59, 69(1), (2), (3), (4), (7) and (8), 71, 77(

b) and 79(1) and

(2)(

e) of the Climate Leadership Act.

c) in subsection (4) by striking out "63(1), (2), (3)" and

ALBERTA RESEARCH AND INNOVATION AMENDMENT REGULATION

1(1) The Alberta Research and Innovation Regulation

(AR 203/2009) is amended by this section.

(2) Section 1(

c) is amended by adding "in or under the Act or"

after "established".

(3) Section 2 is repealed.

(4) Section 3(1) is amended by striking out "Each corporation"

and substituting "A corporation".

(5) Section 5 is repealed.

(6) Section 8 is amended

(

a) in subsection (3)(

b) by striking out "section 14" and

substituting "section 6.2 or 7(2)(h)";

(

b) by repealing subsection (7).

(7) Section 9 is amended

(

Annual report

14(1) A corporation shall, after the end of each fiscal year, prepare

an annual report, in a form and at a time determined by the

Minister, summarizing its transactions and affairs during the

preceding year and containing audited financial statements and any

additional information requested by the Minister in writing.

(2) Without limiting the requirements of subsection (1), a

corporation shall report on the corporation's performance in the

preceding fiscal year in respect of the goals, desired outcomes and

targets outlined in the business plan for that fiscal year in its annual

report.

(3) As soon as an annual report prepared under subsection (1) is

approved by the board, a corporation shall forward it to the

Minister for the Minister's approval.

(11) Section 15 is amended by striking out "The corporation"

and substituting "A corporation".

(12) Section 17 is amended by striking out "one or more of the

corporations" and substituting "a corporation".

(13) Section 18 is repealed.

2(1) The Lobbyists Act General Regulation (AR 247/2009) is

amended by this section.

(2) Schedule 1 is amended in the list under the heading
