Order in Council 310/2024, approved and ordered June 10, 2024.

On the recommendation of the undersigned, the Lieutenant Governor, by and with

the advice and consent of the Executive Council, orders that

(

a) Order in Council 564/1988 is repealed,

(

b) the Sechelt Indian Government District Enabling Act Continuation Regulation,

B.C. Reg. 302/2005, is repealed, and

(

c) the regulations set out in the attached

Schedule are amended as set out in

that Schedule.

Schedule

Adoption Regulation

1 The table in

Schedule 1 of the Adoption Regulation, B.C. Reg. 291/96, is amended

in column 1 by striking out " Sechelt First Nation " and substituting " shíshálh Nation ".

Child, Family and Community Service Regulation

Section 10.1 (

b) of the Child, Family and Community Service Regulation, B.C.

Reg. 527/95, is repealed and the following substituted:

(

b) shíshálh Nation continued under the shíshálh Nation Self-Government Act (Canada).

3 The table in

Schedule 1 is amended in columns 1 and 2 by striking out " Sechelt First Nation " and substituting " shíshálh Nation ".

Fees and Student Tuition Protection Fund Regulation

Section 1 of the Fees and Student Tuition Protection Fund Regulation, B.C. Reg. 140/2016,

is amended by repealing paragraph (

e) of the definition of "Indigenous institution" and substituting the following:

(

e) the shíshálh Nation; .

Housing Needs Report Regulation

Section 11 (1) (

d) of the Housing Needs Report Regulation, B.C. Reg. 90/2019,

is amended

(

a) by striking out " Sechelt lands " and substituting " shíshálh lands ", and

(

b) by striking out " Sechelt Indian Band Self-Government Act (Canada) " and substituting " shíshálh Nation Self-Government Act (Canada) ".

Liquor Control and Licensing Regulation

Section 5 (

b) of the Liquor Control and Licensing Regulation, B.C. Reg. 241/2016,

is repealed and the following substituted:

b) the shíshálh Nation Government District Council.

Local Elections Campaign Financing Regulation

7 Sections 3 (1) (f), 4 (

c) and 16 (2) (

l) of the Local Elections Campaign Financing

Regulation, B.C. Reg. 281/2021, are amended by striking out " Sechelt Indian Government District Enabling Act " and substituting " shíshálh Nation Government District Enabling Act ".

Sechelt Indian Band Designation Regulation

8 The title of the Sechelt Indian Band Designation Regulation, B.C. Reg. 489/88,

is repealed and the following substituted:

SHÍSHÁLH NATION DESIGNATION REGULATION .

Section 1 is repealed and the following substituted:

Nation designated

1 The shíshálh Nation referred to in the shíshálh Nation Self-Government Act (Canada) is designated for the purpose of applying the Torrens system to Indian land

of the Nation.

Sechelt Indian Government District Advisory Council Regulation

10 The title of the Sechelt Indian Government District Advisory Council Regulation,

B.C. Reg. 156/2014, is repealed and the following substituted:

COUNCIL REGULATION .

Section 1 (1) is amended by striking out " Sechelt Indian Government District Advisory Council " and substituting " shíshálh Nation Government District Advisory Council ".

Section 2 (2), (3) (

a) and (

b) and (4) is amended by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".

Section 2 (2) (

a) is amended by striking out " Sechelt Indian Band Self-Government Act (Canada) " and substituting " shíshálh Nation Self-Government Act (Canada) ".

Section 2 (3) (b) (

i) to (iv) is amended by striking out " Sechelt Band Lands " and substituting " shíshálh lands ".

15 Sections 5 (1) (

a) and (d), (2) and (3) and 6 (1) and (3) are amended by striking

out " Sechelt Indian Government District " wherever it appears and substituting " shíshálh Nation Government District ".

Sechelt Indian Government District Municipal Benefits Regulation

16 The title of the Sechelt Indian Government District Municipal Benefits Regulation,

B.C. Reg. 243/88, is repealed and the following substituted:

MUNICIPAL BENEFITS REGULATION .

Section 1 is amended by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".

Sechelt Indian Government District Property Taxation Suspension Regulation

18 The title of the Sechelt Indian Government District Property Taxation Suspension

Regulation, B.C. Reg. 126/88, is repealed and the following substituted:

SHÍSHÁLH NATION GOVERNMENT DISTRICT PROPERTY

TAXATION SUSPENSION REGULATION .

Section 1 is repealed and the following substituted:

Interpretation

1 In this regulation:

"former Act" has the same meaning as in

section 2 (1) of the shíshálh Nation Self-Government Act (Canada);

"shíshálh lands" means the lands transferred to the shíshálh Nation under

section 23 of the former

Act;

"shíshálh Nation" means the shíshálh Nation continued under the shíshálh Nation Self-Government Act (Canada).

Section 2 is amended by striking out " Sechelt lands " wherever it appears and substituting " shíshálh lands ".

21 Sections 2 (b) (ii) and 3 are amended by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".

Sechelt Indian Government District-Sunshine Coast Regional District Participation

Regulation

22 The title of the Sechelt Indian Government District-Sunshine Coast Regional

District Participation Regulation, B.C. Reg. 244/88, is repealed and the following

substituted:

COAST REGIONAL DISTRICT PARTICIPATION

REGULATION .

Section 1 is amended by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".

Strata Property Regulation

Section 12.1 (

b) of the Strata Property Regulation, B.C. Reg. 43/2000, is amended

(

a) by striking out " Sechelt Indian Band " and substituting " shíshálh Nation ", and

(

b) by striking out " Sechelt Indian Band Self‑Government Act (Canada) " and substituting " shíshálh Nation Self‑Government Act (Canada) ".

Taxation Rate Cap for Class 2 Property Regulation

Section 1 of the Taxation Rate Cap for Class 2 Property Regulation, B.C. Reg. 329/96,

is amended in the definition of "municipality" by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".

Ticket Sales Regulation

Section 2 (1) (f) (

i) and (i) (iii) of the Ticket Sales Regulation, B.C. Reg. 129/2021,

is amended

(

a) by striking out " Sechelt Indian Band " and substituting " shíshálh Nation ", and

(

b) by striking out " Sechelt Indian Government District " and substituting " shíshálh Nation Government District ".
