An Act to Amend the New Brunswick Income Tax Act Loi modifiant la Loi de l’impôt sur le revenu du Nouveau-Brunswick Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section 14 of the New Brunswick Income Tax Act,

chapter N-6.001 of the Acts of New Brunswick, 2000, is amended 1 L’article 14 de la Loi de l’impôt sur le revenu du Nouveau-Brunswick,

chapitre N- 6.001 des Lois du Nouveau-Brunswick de 2000, est modifié (

a) in subsection (3) in the portion preceding para- graph (

a) by striking out “for the 2011 taxation year and subsequent taxation years” and substituting “for the 2011 and 2012 taxation years”;

a) au passage qui précède l’alinéa a ) du paragra- phe (3), par la suppression de « pour l’année d’impo- sition 2011 et les années d’imposition subséquentes » et son remplacement par « pour les années d’imposi- tion 2011 et 2012 »; (

b) by adding after subsection (3) the following:

Section 16.1 of the Act is amended by adding after subsection (1.3) the following: 2 L’article 16.1 de la Loi est modifié par l’adjonction après le paragraphe (1.3) de ce qui suit : 16.1(1.4) This

section does not apply to subsection 14(3.1) for the 2013 taxation year. 16.1(1.4) Le présent

Section 35 of the Act is amended 3 L’article 35 de la Loi est modifié (

a) in paragraph (

a) of the English version by strik- ing out “and” at the end of the paragraph;

a) à l’alinéa (

a) de la version anglaise par la sup- pression de « and » à la fin de l’alinéa; (

b) in paragraph (

b) b) à l’alinéa b) (

i) by striking out the portion preceding subpara- graph (

i) and substituting the following: (

b) effective January 1, 2007, to December 31, 2009, both dates inclusive,

section of the Federal Act shall be read as a reference to 53/200 to yield a New Brunswick dividend tax credit rate of 5.3%; and (

Section 55 of the Act is amended by adding after subsection (2.3) the following: 4 L’article 55 de la Loi est modifié par l’adjonction après le paragraphe (2.3) de ce qui suit : 55(2.31) Effective July 1, 2013, the tax payable by a corporation under this Part for a taxation year is 12% of the corporation’s taxable income earned in the year in New Brunswick. 55(2.31) À partir du 1er juillet 2013, l’impôt payable par une corporation pour une année d’imposition, en vertu de la présente partie, s’établit à 12 % de son revenu imposable gagné dans l’année au Nouveau-Brunswick. 5

Section 56 of the Act is amended by adding after subsection (4.3) the following: 5 L’article 56 de la Loi est modifié par l’adjonction après le paragraphe (4.3) de ce qui suit : 56(4.31) Effective July 1, 2013, the reference to “14.5%” in subsection (1) shall be read as a reference to “12%”. 56(4.31) À partir du 1 er juillet 2013, le renvoi à « 14,5 % » au paragraphe (1) doit être interprété comme un renvoi à « 12 % ». 6(1)

Section 1 of this Act shall be deemed to have come into force on January 1, 2013. 6(1) L’article 1 de la présente loi est réputé être entré en vigueur le 1er janvier 2013. 6(2)

Section 3 of this Act shall be deemed to have come into force on January 1, 2010. 6(2) L’article 3 de la présente loi est réputé être entré en vigueur le 1er janvier 2010.
