B.C. Reg. 145/2011 , deposited July 25, 2011, pursuant to the CHILD CARE SUBSIDY ACT [section 13]. Order in Council 367/2011, approved and ordered July 25, 2011.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Child Care Subsidy Regulation, B.C. Reg. 74/97, is amended as set out in the attached Schedule.

Schedule

Section 1 of the Child Care Subsidy Regulation, B.C. Reg. 74/97, is renumbered as

section 1 (1) and is amended

(

a) in subsection (1) by repealing the definition of " care surrounding school day " and substituting the following:

"care surrounding school day" means, for children of school age, the provision of child care that

(

a) begins no earlier than 6 a.m. and ends no later than 7 p.m., and

(

b) takes place on

(

i) any one of the days in session, or

(ii) Good Friday, Easter Monday, Victoria Day, Labour Day, Remembrance Day or Thanksgiving Day; ,

(

b) in subsection (1) by adding the following

definitions:

"days in session" has the same meaning as in the School Calendar Regulation, B.C. Reg. 114/2002;

"school age" , except in the definition of "licensed child care setting", means school age as determined under subsection (2);

"school year" means the period commencing on July 1 and ending on the following June 30; , and

(

c) by adding the following subsection:

(2) A person is deemed

(

a) to be of school age beginning on September 1 in a school year if the person will have reached age 5 on or before December 31 of that school year, and

(

b) to continue to be of school age until the end of the school year in which the person reaches age

Section 3 is amended

(

a) in subsection (1) by striking out " or " at the end of paragraph (a), by adding " or " at the end of paragraph (

b) and by adding the following paragraph:

(

c) the child care is recommended under the Community Living Authority Act in respect of a child who has a parent approved for or receiving community living support under the Community Living Authority Act and the minister is satisfied that the child care is needed. , and

(

b) in subsection (4) by adding " unless the child care is provided to a child of school age " after " licensed preschool ".

Section 10 (3) is amended

(

a) in paragraph (

b) by striking out " subject to paragraph (c.1) ",

(

b) in paragraphs (b) (

i) and (

c) by striking out " has not reached 6 years of age " and substituting " has not reached school age ",

(

c) in paragraph (b) (ii) by striking out " has reached 6 years of age " and substituting " is of school age ", and

(

d) by repealing paragraph (c.1).

Schedule A is amended

(

a) in column 1 of items 3, 7 and 16 by striking out " children 37 months and over but under 73 months, or children described in

section 10 (3) (c.1) " and substituting " children who have reached 37 months of age but who have not reached school age ",

(

b) in column 1 of items 4, 8 and 17 by striking out " children 73 months and over, other than children described in

section 10 (3) (c.1) " and substituting " children of school age ",

(

c) by repealing the heading " Licensed Out of School Care (Kindergarten) ",

(

d) by repealing item 9,

(

e) in column 1 of item 10 by striking out " children 30 months - school entry " and substituting " children who have reached 30 months of age but who have not reached school age ", and

(

f) by repealing item 18 and substituting the following as indicated:
