An Act to Amend the Real Property Transfer Tax Act Loi modifiant la Loi de la taxe sur le transfert de biens réels Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: Sa Majesté, sur l’avis et avec le consentement de l’As- semblée législative du Nouveau-Brunswick, édicte : 1

Section of the Real Property Transfer Tax Act,

chapter R-2.1 of the Acts of New Brunswick, 1983, is amended L’article de la Loi de la taxe sur le transfert de biens réels,

chapitre R-2.1 des Lois du Nouveau-Brunswick de 1983, est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 2(1) Every person who before June 1, 2012, tenders for registration in the Province a deed shall, before the deed is registered, pay a tax computed at the rate of 0.25% of the greater of 2(1) La personne qui présente avant le er juin un acte de transfert à l’enregistrement dans la province paie, avant l’enregistrement, une taxe calculée au taux de 0,25 % sur le plus élevé des deux montants suivants : (

a) the consideration for the transfer; or

a) la contrepartie du transfert; (

b) the assessed value of the real property.

a) the consideration for the transfer; or

b) the assessed value of the real property.

b) la valeur d’évaluation du bien réel. 1 2(1.02) Despite subsection (1.01), in respect of an agree- ment for sale or purchase executed before March 28, 2012, the percentage referred to in subsection (1.01) shall be read as 0.25%, regardless of the date on which the deed is ten- dered for registration. 2(1.02) Par dérogation au paragraphe (1.01), s’agissant d’une convention de vente ou d’achat passée avant le mars 2012, le pourcentage fixé au paragraphe (1.01) s’interprète comme étant 0,25% peu importe la date de présentation à l’enregistrement de l’acte de transfert. 2 This Act shall be deemed to have come into force on June 1, 2012. 2 La présente loi est réputée être entrée en vigueur le 1er juin 2012.
