Mavillette Beach Provincial Park Designation

made under

Section 8 of the

Provincial Parks Act

The Governor in Council on the report and recommendation of the Minister of Lands and

Forests dated the 29th day of April, A.D., 1983, pursuant to

Section 2 of

Chapter 244 of the

Revised Statutes of Nova Scotia, 1967, the Provincial Parks Act , is pleased to:

(

a) constitute all that area of land situate at Mavillette, in the County of Digby,

owned by Her Majesty the Queen in right of the Province of Nova Scotia, to be

a Provincial Park, the said area of land being described in

Schedule “A” and

shown outlined in red on the copy of Crown Land Records Plan No. E-5-67

marked

Schedule “B”, both Schedules attached to and forming part of the

report and recommendation, and

(

b) declare that the park shall be known by the name of “Mavillette Beach

Provincial Park”.

Schedule “A”

All that certain lot, piece or parcel of land, situate, lying and being at Mavillette, County of

Digby, Province of Nova Scotia, shown on Plan No. E-5-67 filed in the Crown Land Records

Office, Department of Lands and Forests, Halifax, said land being more particularly described

as follows:

Beginning at Survey Marker No. 352 situated at the intersection of the southerly boundary of

the John Doucette Road with the southeasterly boundary of a public road leading from Cape St.

Marys to Provincial Highway Route No. 1;

From thence (by astronomic bearings) following the southeasterly boundary of the public road

leading from Cape St. Marys to Provincial Highway Route No. 1 in a northeasterly direction

390 feet more or less to Survey Marker No. 353, said Survey Marker being N 37° 50' E, 388.4

feet from the before described point of beginning;

Thence S 59° 52' E, 680 feet more or less to an unmonumented point designated as point “A”

on the aforementioned Plan No. E-5-67, said point also being situated on the northwesterly edge

of a watercourse flowing into the Atlantic Ocean;

Thence following the northwesterly edge of the said watercourse in a southwesterly direction

70 feet more or less to point “B” situated on the northerly boundary of the aforementioned John

Doucette Road;

Thence following the northerly boundary of the said John Doucette Road in an easterly

direction 110 feet more or less to point “C” situated on the southeasterly edge of the before

described watercourse flowing into the Atlantic Ocean;

Thence following the southeasterly edge of the said watercourse in a northeasterly direction to

the edge of a marsh area, and then continuing to follow the edge of the marsh in a generally

southeasterly direction for a total distance of 1480 feet more or less to Survey Marker No. 355,

said Survey Marker being S 62° 54' E, 1618.6 feet from before described Survey Marker No.

353;

Thence S 66° 40' E, 1013.0 feet to Survey Marker No. 356;

Thence S 23° 20' W, 86.2 feet to Survey Marker No. 357;

Thence S 34° 46' W, 68.5 feet to a rock monument designated as R1 on the aforementioned

Plan No. E-5-67;

Thence S 47° 16' W, 41.6 feet to rock monument R2;

Thence N 74° 39' W, 365 feet more or less to point “D” situated on the easterly boundary of the

aforementioned John Doucette Road;

Thence following the easterly boundary of the said John Doucette Road in a southerly direction

180 feet more or less to Survey Marker No. D453;

Thence N 89° 34' E, 301.3 feet to Survey Marker No. D454;

Thence S 00° 26' E, 40.2 feet to Survey Marker No. D455;

Thence S 89° 34' W, 293.6 feet to Survey Marker No. D456 situated on the easterly boundary

of the aforementioned John Doucette Road;

Thence following the easterly boundary of the said John Doucette Road S 11° 01' E, 133.9 feet

to Survey Marker No. D434;

Thence N 89° 34' E, 420.6 feet to Survey Marker No. D435;

Thence S 03° 07' E, 352.8 feet to Survey Marker No. D436;

Thence S 89° 33' W, 330.0 feet to Survey Marker No. D437 situated on the easterly boundary

of the aforementioned John Doucette Road;

Thence following the easterly boundary of the said John Doucette Road 220 feet more or less

to Survey Marker No. D438, said Survey Marker being S 32° 05' E, 219.0 feet from the last

mentioned Survey Marker No. D437;

Thence N 89° 35' E, 259.8 feet to Survey Marker No. D439;

Thence S 12° 05' E, 110.0 feet to Survey Marker No. D440;

Thence S 69° 01' W, 150.0 feet to Survey Marker No. D441 situated on the easterly boundary

of the aforementioned John Doucette Road;

Thence continuing S 69° 01' W, 66.5 feet more or less crossing the said John Doucette Road to

point “E” situated on the westerly boundary thereof;

Thence following the westerly boundary of the said John Doucette Road in a southerly

direction 680 feet more or less to Survey Marker No.359, said Survey Marker being S 27° 51'

E, 680.1 feet from the last mentioned Survey Marker No. D441;

Thence S 47° 00' W, 15.5 feet to Survey Marker No. 360;

Thence continuing S 47° 00' W, 45 feet more or less to point “F” situated on the ordinary high

water mark of the Atlantic Ocean;

Thence following the ordinary high water mark of the Atlantic Ocean in a southeasterly

direction, 370 feet more or less to point “G” situated on the northerly boundary of a brook

flowing into the said Atlantic Ocean;

Thence following the northerly boundary of the said brook upstream in an easterly direction

700 feet more or less to point “H”;

Thence N 07° 36' W, 119 feet more or less to Survey Marker No. 363 situated on the southerly

boundary of the aforementioned John Doucette Road;

Thence following the southerly boundary of the said John Doucette Road N 72° 07' E, 67.1 feet

to Survey Marker No. 364;

Thence S 07° 33' E, 97.7 feet to Survey Marker No. 365;

Thence S 69° 26' E, 67.6 feet to Survey Marker No. 366;

Thence S 69° 43' E, 1185'.6 feet to Survey Marker No. 367;

Thence S 22° 57' W, 64.1 feet to Survey Marker No. 368;

Thence S 66° 40' E, 643.0 feet to Survey Marker No. 369;

Thence S 45° 44' E, 176.8 feet to Survey Marker No. 370;

Thence S 42° 23' E, 136.5 feet to Survey Marker No. 371;

Thence S 15° 35' E, 32.7 feet to Survey Marker No. 372;

Thence S 45° 42' W, 1680.45 feet to Survey Marker No. 373 on the shore of the Atlantic

Ocean;

Thence continuing S 45° 42' W, 670 feet more or less to point “J” situated at the ordinary high

water mark of the Atlantic Ocean;

Thence following the ordinary high water mark of the Atlantic Ocean in a northwesterly

direction 5680 feet more or less to point “K”;

Thence due north, 1680 feet more or less to Survey Marker No.351;

Thence N 01° 57' E, 14.5 feet to the place of beginning containing 250 acres more or less.

The Governor in Council on the report and recommendation of the Minister of Natural

Resources dated the 9 th day of August, A.D., 1993, pursuant to

Section 8(

b) of

Chapter 367 of

the Revised Statutes of Nova Scotia, 1989, the Provincial Parks Act , is please to approve the

decrease in the size of Mavillette Beach Provincial Park, in the County of Digby, so constituted

by Order in Council 83-575, dated the 31st day of May, A.D., 1983, by approving the

withdrawal of approximately 0.574 hectares of Crown land show outlined in red on the plans

marked

Schedule “A” and “B”, both attached to and forming part of the report and

recommendation, to facilitate the upgrading of the John Doucette Road, and to authorize the

Minister of Natural Resources to execute such documents as may be necessary to achieve the

purposes of this Order.
