B.C. Reg. 125/2012 , deposited June 5, 2012, pursuant to the LIQUOR CONTROL AND LICENSING ACT [section 84] and the OFFENCE ACT [section 132]. Order in Council 377/2012, approved and ordered June 4, 2012.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that

(

a) the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002, is amended as set out in the attached Appendix 1, and

(

b) the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended as set out in the attached Appendix 2.

Appendix 1

1 The following

section is added in

Schedule 4 of the Liquor Control and Licensing Regulation, B.C. Reg. 244/2002:

Monetary penalties – failure by manufacturer to comply with agreement

(1) Despite

section 68 (1) of this regulation, the enforcement actions under

section 64 (2) (

a) or referred to in

section 65 (1) of this regulation that apply to the contravention set out in subsection (2) of this

section include a monetary penalty for each contravention, and the amount of the monetary penalty that may be imposed for each contravention may be up to $25 000.

2 Items 5, 6 and 38 in the table in

Schedule 4 are repealed.

3 Item 45 in the table in

Schedule 4 is amended in the column entitled " Contravention "

(

a) by striking out " under

section 67 " wherever it appears and substituting " under

section 67 (3) ", and

(

b) by adding " immediately " after " refusing to ".

Appendix 2

Schedule 1 of the Violation Ticket Administration and Fines Regulation, B.C. Reg. 89/97, is amended

(

a) by striking out " 33, " in Column 3 in items 1A (h), 7A (a), 8 (a), 14 (

a) and 16 (a), and

(

b) in item 26 by adding " 33 (1), " after " 13 (3) and (4), " in Column 2.

Schedule 2 is amended after the heading " Liquor Control and Licensing Act "

(

a) by adding the following as indicated:

section 33 (1) (

a) Sell, give or otherwise supply liquor to a minor
