An Act to Amend the Workers’ Compensation Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section 38.11 of the Workers’ Compensation Act,

chapter W-13 of the Revised Statutes, 1973, is amended (

a) by repealing subsection (4) and substituting the following: 38.11(4) The Commission shall not pay compensation to a worker in respect of the period of time referred to in subsection (3) except as provided for in subsection (5), (6), (7), (8), or (8.1). (

b) by adding after subsection (8) the following: 38.11(8.1) Where a peace officer or firefighter is injured in the course of his or her employment the Commission shall pay compensation in respect of the period of time re- ferred to in subsection (3) unless compensation is paid un- der subsection (5), (6), or (7). chapitre W-13 des Lois révisées de 1973, est modifiée

a) par l’abrogation du paragraphe (4) et son rem- placement par ce qui suit : 38.11(4) La Commission ne verse une indemnité au tra- vailleur relativement à la période visée au paragraphe (3) que dans les cas prévus au paragraphe (5), (6), (7), (8), ou (8.1).

b) par l’adjonction suivant le paragraphe (8) de ce qui suit : 38.11(8.1) Lorsqu’un agent de la paix ou un pompier se blesse dans l’exercice de ses fonctions, la Commission doit l’indemniser dans le délai à laquelle il est référé au paragraphe (3) à moins qu’il soit indemnisé en vertu du paragraphe (5), (6) ou (7).
