q) and (u)]. Order in Council 829/2015, approved and ordered December 17, 2015.

On the recommendation of the undersigned, the Lieutenant Governor, by and with the advice and consent of the Executive Council, orders that the Correction Act Regulation, B.C. Reg. 58/2005, is amended

(

a) as set out in the attached

Schedule 1, and

(

b) effective on the later of the date this order is deposited and the date that

section 2 of the Tobacco Control Amendment Act, 2015 , S.B.C. 2015, c. 11, is brought into force, as set out in the attached

Schedule 2.

Schedule 1

Section 1 of the Correction Act Regulation, B.C. Reg. 58/2005, is amended by repealing the definition of “Ombudsman” and substituting the following:

“Ombudsperson” means the Ombudsperson appointed under the Ombudsperson Act or a person to whom the Ombudsperson has delegated any of his or her powers or duties under

section 30 of that Act; .

Section 13 is amended

(

a) by repealing paragraph (

f) and substituting the following:

(

f) the Ombudsperson; , and

(

b) by adding the following paragraph:

(

i) the B.C. Human Rights Clinic.

Section 17 is amended

(

a) in subsection (1) (

a) by adding “ or ” at the end of subparagraph (iv), by striking out “ or ” at the end of subparagraph (

v) and by repealing subparagraph (vi),

(

b) by repealing subsections (1) (

b) and (3), and

(

c) in subsection (2) by striking out “ subsection (3) and ”.

Section 18 (1) (a) (

i) is amended by striking out “ or (3) ”.

Section 21 (1) is amended

(

a) in paragraph (

c) by striking out “ without permission ” and substituting “ without the permission ”,

(

b) by repealing paragraph (

f) and substituting the following:

(

f) possess property or food that is not the property or food of the inmate without the permission of a staff member, ,

(

c) in paragraph (

s) by striking out “ without permission, ” and substituting “ , or food, without the permission of a staff member, ”,

(

d) in paragraph (

t) by striking out “ without permission ” and substituting “ without the permission of a staff member ”, and

(

e) in paragraph (

v) by striking out “ without permission, ” and substituting “ without the permission of a staff member, ”.

Section 27 (4) is amended by striking out “ the person presiding over a disciplinary hearing ” and substituting “ the person who presided over a disciplinary hearing ”.

Section 31 (1) (

g) is repealed and the following substituted:

(

g) the Ombudsperson.

Schedule 2

Section 21 (1) (

v) is amended by striking out “ tobacco product ” and substituting “ tobacco or vapour product within the meaning of the Tobacco and Vapour Products Control Act ”.
