An Act to Amend the Assessment Act Her Majesty, by and with the advice and consent of the Legislative Assembly of New Brunswick, enacts as fol- lows: 1

Section of the Assessment Act,

chapter A-14 of the Revised Statutes, 1973, is amended by adding after subsection (1) the following: 25(1.1) Notwithstanding the time requirement for mak- ing a request for review of assessment under subsection (1), where in any year after an assessment has been en- tered in the assessment and tax roll, the Director deter- mines that (

a) real property has been assessed in the name of someone other than the owner, (

b) real property has been left off the roll, (

c) real property has been entered on the roll in error, (

d) real property has been improperly classified, (

e) real property has been improperly assessed as tax- able or exempt, or PROJET DE LOI Loi modifiant la

Loi sur l’évaluation,

chapitre A-14 des Lois révisées de 1973, est modifié par l’adjonction de ce qui suit après le paragraphe (1) : 25(1.1) Nonobstant le délai prévu au paragraphe (1) pour demander la révision de l’évaluation, le directeur peut, à tout moment avant la fin d’une année fiscale, déli- vrer un avis d’évaluation et d’impôts modifié assorti des corrections nécessaires, s’il constate, après avoir inscrit une évaluation au rôle d’évaluation et d’impôt, l’un des faits suivants :

a) des biens réels ont été évalués au nom d’une per- sonne qui n’en est pas le propriétaire;

b) des biens réels ont été omis du rôle;

c) des biens réels ont été inscrits au rôle par erreur;

d) des biens réels ont été mal classés;

e) des biens réels ont été évalués incorrectement comme imposables ou exemptés; 2 Projet de loi Loi modifiant la

f) a gross and manifest error has occurred in the as- sessment, the Director may, at any time before the end of the taxa- tion year in respect of which the roll has been filed, issue an amended assessment and tax notice with the changes required to correct the error. 25(1.2) The amended assessment and tax notice, setting out clearly the change in assessment, the right of the per- son to appeal the amended assessment and tax notice and the time within which the right to appeal shall be exer- cised, shall be served by mailing it to the person assessed by postage prepaid addressed to the last address known to the Director. 25(1.3) Any amended assessment and tax notice made under this

section may be appealed in accordance with sections through of this Act.

article peut faire l’objet d’un appel confor- mément aux articles 27 à 37 de la présente loi.
