chapter E-1.12 of the Acts of New Brunswick, 1997, is repealed and the following is substituted: 1(1) L’alinéa 6b.2) de la

Section 10 of the Act is repealed and the follow- ing is substituted: 1(2) L’article 10 de la Loi est abrogé et remplacé par ce qui suit : 10(1) A superintendent shall refuse school admission to a person who is school age and shall not permit a pu- pil to continue to attend school who, within the time pe- riod established by the Minister in a provincial policy, does not provide proof, or his or her parent does not pro- vide proof, of immunization required under subsection 42.1(1) of the Public Health Act. 10(1)

Section 1 of the Public Health Act,

chapter P-22.4 of the Acts of New Brunswick, 1998, is amended by adding the following

definitions in alphabetical or- der: 2(1) L’article 1 de la

Section 42.1 of the Act is amended 2(2) L’article 42.1 de la Loi est modifié (

a) by repealing subsection (1) and substituting the following:

a) par l’abrogation du paragraphe (1) et son rem- placement par ce qui suit : 42.1(1) In order to attain proof of immunization for a disease prescribed by regulation, a superintendent of a school district, through the principal of a school, shall ensure that the following information is provided to him or her for every person who is of school age and attend- ing or planning to attend school in the Province: 42.1(1) En vue d’établir la preuve d’immunisation contre toute maladie prescrite par règlement, le directeur général du district scolaire, par l’entremise du directeur d’école, exige que lui soient fournis, pour chaque per- sonne d’âge scolaire qui fréquente une école dans la pro- vince ou qui prévoit le faire, les renseignements suivants : (

a) the name, date of birth and the Medicare number of the person if the principal of the school reasonably believes that information in respect of immunizations given to the person is included in the immunization registry established by the Minister under

section 42.3, or

a) son nom, sa date de naissance et son numéro d’assurance maladie, s’agissant d’une personne dont le directeur d’école a tout lieu de croire que les rensei- gnements portant sur l’immunisation figurent au ré- pertoire d’immunisation que crée le Ministre en vertu de l’article 42.3; (

b) any other proof of immunization that meets the standards established by policy by the chief medical officer of health if the principal of the school reasona- bly believes that information in respect to immuniza- tions given to the person is not included in the immu- nization registry established by the Minister under

section 42.3.

b) par l’abrogation du paragraphe (2) et son rem- placement par ce qui suit : 42.1(2) An operator of an early learning and childcare facility shall require that for each child attending that fa- cility, proof of immunization for a disease prescribed by regulation is provided to the operator that meets the standards established by policy by the chief medical offi- cer of health. 42.1(2) L’exploitant d’un établissement de garderie éducative exige que lui soit fournie pour chaque enfant qui fréquente celui-ci une preuve d’immunisation contre toute maladie prescrite par règlement, cette preuve de- vant répondre aux normes établies dans les politiques émanant du médecin-hygiéniste en chef. d) by repealing subsection (3) and substituting the following:

d) par l’abrogation du paragraphe (3) et son rem- placement par ce qui suit : 42.1(3) Despite subsection (1) or (2), proof of immuni- zation is not required if the parent or guardian of a child or pupil provides a medical exemption, on a form pro- vided by the Minister, signed by a medical practitioner or nurse practitioner, or if the child is an independent pu- pil and provides the medical exemption himself or her- self. 42.1(3) Par dérogation aux paragraphes (1) et (2), la preuve d’immunisation n’est pas exigée lorsque l’élève autonome ou le parent ou le tuteur d’un enfant ou d’un élève fournit une exemption médicale établie au moyen de la formule que fournit le Ministre et signée par un médecin ou une infirmière praticienne. e) in subsection (4) by striking out “or written statement”;

f) in subsection (6) by striking out “each child” and substituting “each person who is of school age”.

a) prescribing what constitutes satisfactory proof of immunization for the purposes of paragraph 42.1(1)(

b) and subsection 42.1(2), and

a) section 2 and sections 7 to 15 of the Canadian Charter of Rights and Freedoms,

Part I of the Con- stitution Act, 1982, being

Schedule B to the Canada Act 1982 (UK), 1982, c 11, and
